INTRODUCED BY COUNCILMAN: Cuffe w RoQ�r�son� ORDINANCE NO. _ '7V3 4 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELATING TO THE TH OPERATION OF E MUNICIPAL OFF-STREET PARKING 9RAGE PROVIDING A PENALTY, AND REPEALING ORDINANCE 7307 OF THE CITY 6F JEFFERSON, MISSOURI. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Control and supervision. The Mayor shall supervise the operation of the Municipal Off-Street Parking Garage and promulgate such regulations as he deems necessary for the efficient operation and use thereof. Section 2. Operating Personnel. The Mayor shall appoint such employees as he deems necessary to efficiently operate and maintain the municipal off-street parking garage. He shall designate one of the employees as the parking garage supervisor. The employees shall serve at the pleasure of the )Mayor and they shall perform such ditues and Work such days and hours as the Mayor may prescribe. Section 3. Parking; reserved and non-reserved._ The Mayor may designate a number of spaces in the municipal off street parking garage as "reserved parking' spaces, and the Mayor, with the advice and consent of the council, shall establish a monthly rate of charge therefor. Non-reserved parking spaces shall be available to the general public for use upon payment of a parking fee of ten cents (5.100) per hour, or any fraction thereof, by the user thereof. Section 4. Garage receipts- and_ EArkin r tickets„ audit the_ rre f,_, All receipts and parking tickets from the daily use of the *unicipal off-street parking garage shall be transmitted to the City Collector in such manner as the Mayor shall designate, and the City Collector shall audit each day all receipts from the municipal off-street parking garage for the preceding day or week-end and report any discrepancy found by such audits to the Mayor. Section S. Parking Garage Fund. All revenue from the operation of the munbipal off-street parking garage shall be placed in the General Revenue Fund to the account of the Municipal Parking Garage, and all operational and maintenance expenses of the off-street parking garage shall be paid, to the extent possible, from funds credited to such account in the General Revenue Fund. Section 6. Careless and Reckless Driving within MuniciRal Parkin�a Ggrage. It is hereby declared to be unlawful for any person to operate a motor vehicle within the premises of the Municipal Parking Garage in a careless and reckless manner. Careless and reckless manner is defined as such a manner as to indicate a willful disregard for the safety of persons or property within the Municipal Parking Garage. Section 7. Improper Parking; Removal of Vehicle. It is hereby declared to be unlawful for the operator of a motor vehicle to park the same within the Municipal Parking Garage in such manner as to obstruct or interfere with the movement and operation of other motor vehicles in the garage, and any motor vehicle parked in such manner as described above shall be towed away from the garage at the expense of the owner thereof. Section 8. Damacre to or Destruction of Garage. It is hereby declared unlawful for any person to damage in any manner whatsoever any portion or part of the Municipal Parking Garage or any of the facilities, equipment or apparatus of any kind or description located therein. Section 9. Failure to Pay, Parking Fees. It is hereby declared unlawful for any person to operate any motor vehicle from the municipal Parking Garage without first paying the attendant on duty the amount due the City for the period of time the motor vehicle was parked within the garage; provided that this section shall not apply to holders of currently valid parkards. Pow_erg Each attendant of the garage shall be a conservator of the peace while on duty within the garage and shall have the same power as a policeman of the City within the garage and may arrest any person observed in violation of any provision of this ordinance or any other ordinance of the City. Upon making an arrest of any person within the garage as provided above, the attendant shall immediately contact the Police Department and place the person arrested in the custody of a city policeman. Each attendant, before entering upon the discharge of his duties shall take the same oath, as is administered to policemen of the City by the Police Judge, before the Police Judge, or his qualified and appointed substitute. Section 11. Penalty Clause. Anyone violating any of the terms of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than One ($1.00) Dollar, nor more than One Hundred ($100.00) Dollars. Section 12. Reveal Clause. Ordinance Number 7307 of the City of Jefferson, Missouri, be and the same is hereby, repealed. Section 13. Effective Date.
