AN ORDINANCE MODIFYING THE PROCEDURE FOR ISSUANCE OF PERMITS
FOR MOVED -ON COMMERCIAL STRUCTURES WITHIN THE CITY OF MOAB AND
SETTING FEES THEREFORE.
WHEREAS, the City Council on the advice of the Moab City Planning
Commission deems that it is necessary to amend the criteria and procedure for issuance
of permits for moved -on commercial structures within the City of Moab:
NOW THEREFORE, IT IS HEREBY ORDAINED AS FOLLOWS:
That the procedure for the issuance of permits for moved -on commercial
structures within the City of Moab is as follows:
DEFINITION:
MOVED -ON COMMERCIAL STRUCTURE: Any structure or vehicle used for
commercial purposes that is temporarily moved onto a site, with the intent of moving
the structure off -site at a later date or time.
ISSUANCE OF PERMITS:
Moved -on commercial structure permits may be issued under the following
terms:
1. The applicant must obtain a conditional use permit and a Moab City
transient merchant's license:
2. The maximum time limit a moved -on commercial structure can be placed
and operated on a designated site shall be nine months per year.
3. The applicant must submit a plot plan to scale identifying where the moved -
on commercial structure will be located.
4. The applicant must verify that the condition, location, parking requirements
and use of the structure or vehicle will comply with all City ordinances and other
applicable state and County codes.
5. The applicant must verify that the moved -on commercial structure will have
no appreciable detrimental effect on the living environment and property values in the
area where the structure or vehicle will be moved.
6. Moved -on commercial structures are limited to commercial zones.

7. There will be a fee of $375.00 for a nine month licensing period that will be
assessed in addition to the $250.00 Transient Merchant licensing fee.
8. The moved -on commercial structure must be completely independent and
not attached in any way to another structure. The power of the moved -on structure
must be self-contained or the power must have an approved temporary service drop.
9. Moved -on structures used for Special Event sales are exempt from the
provisions of this ordinance, but must adhere to the provisions 5. 12. 160 of the
Transient Merchant license.
