ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING
AND DISCONTINUING AS A PUBLIC STREET A PORTION OF BENTON
STREET, RESERVING TO THE CITY AN EASEMENT IN THE RIGHT OF
WAY VACATED FOR SANITARY SERVER, SURFACE WATER DRAINAGE, AND
PUBLIC UTILITY PURPOSES, AND AUTHORIZING AND DIRECTING ;'I)
THE MAYOR AND THE CITY CLERK OF THE CITY TO EXECUTE ALL '
INSTRUMENTS REQUIRED TO CONFIRM IN THE ABUTTING PROPERTY OWNERS
THEIR RIGHT OF REVERSION IN THE VACATED AREA.
WHEREAS the City of Jefferson Missouri, has been
petitioner toy vacate a portion of Benton Street, as herein-
after described, so that the right of way thereof will be
discontinued for purposes of a public street, and
WHEREAS, said petition has been studied by the City
Council of the City, and
WHEREAS, the City Council finds that the portion of
Benton Street petitioned for vacation has never been improved,
and
WHEREAS, the City Council finds that the portion of the
existing right of way of Benton Street petitioned for vacation
has been 'occupied by sewer and public utility facilities, and
WHEREAS, the City Council finds and believes that it would
be appropriate and reasonable and in the public interest to
vacate as a public street that part o Benton Street herein-
after described, subject to a reservation in the Cit,y__of -an ,,
easement in that portion of Benton Street vacated for the
maintenance, repair, location and relocation of all sanitary
sewer, surface water sewer or public utility facilities now
existing or hereafter to be constructed within said right
of way, now therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON','
MISSOURI, AS FOLLOWS:
Section 1. Having considered a petition for the vacation
of the following described portion of the right of way of
Benton Street for public street purposes, and having found
that it is appropriate, reasonable and in the public interest
to grant,the petition, the City Council does hereby declare
that the following described portion of the right of way of
Benton Street is, and it is hereby, vacated and forever -
discontinued as a right of way for public street purposes,
subject to the reservation in the City of the.easement mentioned
in Section 2 of this ordinance:

under, over and upon that portion of the right of way of Benton
Street, as described in Section 1 of this ordinance, for purposes
of repairing, maintaining, servicing, locating and relocating
all sanitary sewer, surface water drainage and public utility
facilities now existing or hereafter to be constructed within
said area.
Section 3. The statutory right of reversion in the owners
of the abutting property is hereby confirmed, subject to the
easement expressly reserved in Section 2 of this ordinance,
as is provided by the laws of the State of Missouri, and the
Mayor and the City Clerk of the city are hereby authorized
and directed to execute all instruments required to confirm
the reversionary rights of the owners of property abutting on
the area vacated, as described in Sec ion 1 of this ordinance,
in the right of way vacated. r -
Section 4. This ordinance shall take effect and be in
force from and after its passage and approval.
