HomeMy Public PortalAboutORD07473 v BILL NO„ INTRODUCED BY COUNCILMEN, ORDINANCE NO. rI AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROVIDING FOR AN ELECTION IN THE CITY OF JEFFERSON, MISSOURI FOR THE PURPOSE OF SUB- MITTING TO THE QUALIFIED VOTERS OF THE CITY THE FOLLOWING PROPOSITION, NAMELY: SHOULD AN ANNUAL TAX, AT A RATE OF TWO MILLS ON THE DOLLAR, BE LEVIED ANNUALLY FOR A PERIOD OF TEN YEARS ON ALL TAXABLE PROPERTY IN JEFFERSON CITY, MISSOURI, FOR THE ERECTION OF FREE PUBLIC LIBRARY BUILDINGS IN JEFFERSON CITY, MISSOURI WHEREAS, the voters of Jefferson City, Missouri have heretofore decided to establish and maintain a free public library in Jefferson City, Missouri, under the provisions of Sections 182. 140 (as amended, Laws of Mo. , 1961, page 404) to 182. 301, R. S. Mo. 1959, and WHEREAS, the City of Jefferson, Missouri has established and is presently maintaining a free public library in said city under the provisions of the aforementioned statutes, and n WHEREAS, on the /,/-01 day of v , 1964, quali•y fied electors of Jefferson City, Missouri, equaling more an five per cent of the total cast for Governor in said city at the last gubernatorial election of the State of Missouri did in writing petition the mayor and the city council, as the proper authorities, asking that an annual tax be levied at an increased rate of taxation for free public library buildings in Jefferson City, and for the sub- mission to the voters of Jefferson City, at the next election to be held in the city on April 7, 1964, of the following proposition,to-wit: PROPOSITION "For a two mill tax for the erection of free public library buildings in Jefferson City, " or "Against a two mill tax for the erection of free • public library buildings in Jefferson City. " and WHEREAS, the petitioners did specify in their petition that the in- creased rate of taxation shall be two mills on the dollar annually on all taxable property in the city for a period of ten years, and WHEREAS, the Board of Trustees of the Jefferson City Free Public Library deem it necessary that the aforementioned library buildings be erected and have so expressed its opinion by resolution filed with the Ma or and City Council of the City of Jefferson, Missouri, on the day of , 1964, and WHEREAS, under the conditions hereinabove referred to and the provisions of Section 182. 260 R. S. Mo. , 1959, the proper authorities of Jefferson City, Missouri, must give notice in the next legal notice of a regular city election of the submission of the aforementioned proposition to the qualified voters of Jefferson City, Missouri, and WHEREAS, if a majority of the qualified voters of Jefferson City, Missouri, voting on the aforementioned proposition at the election, vote "for the increased tax for the erection of free public library buildings", the tax specified in the notice of the election shall be levied and collected in like manner with other general taxes of the city and shall be known as the "Library Building Fund", and WHEREAS, the City Council of Jefferson City, Missouri, does hereby find and declare that it is in the public interest and required by law that an election be held to determine if a majority of qualified voters of Jefferson City, Missouri, voting on the aforementioned proposition at the election, are in favor of the proposition, now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. At the general city election, to be held in the City of Jefferson, County of Cole, Missouri, on the 7th day of April, 1964, there shall be submitted to the qualified voters of the city the following proposition, to--wit: PROPOSITION ® "For an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City, " or "Against an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City". Section 2. The city clerk shall, and she is hereby directed, to give notice of said election by publication in the Jefferson City Post Tribune, a .daily newspaper printed, published and of general circulation in Jefferson City, Missouri. The notice of said election shall be published in that newspaper once a week for four consecutive weeks and on the same day in each week. The first publication shall be made at least twenty- one days before the date of the election and the last publication shall be made within ten days of the ® date of the election. The city clerk shall make and file in her office a return of. service of the notice in the manner provided by law for publication of legal notices by newspapers. The notice to be published shall be in the following form: NOTICE OF ELECTION CITY OF JEFFERSON, MISSOURI Notice is hereby given that at the general city election to be held in the City of Jefferson, Cole County, Missouri, on Tuesday, April 7, 1964, there shall be submitted to the qualified voters of the city the following proposition: PROPOSITION "For an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City, " or -2- "Against an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City". The polls at said election shall be open at the hour of 6:00 A. M. , and continue to be open until the hour of 7:00 P. M. , on the date of the election. All persons who are legal voters in Jefferson City, Missouri, shall be entitled to vote at said election. Given under my hand and corporate seal of the City of Jefferson, Missouri, on this day of 1964. (SEAL) City Clerk Section 3. The city clerk is hereby directed to furnish the judges and clerks of said election with all ballots, poll books and other necessary election Items, and the expense of the election shall be paid out of the city treasury in the same manner with like effect and by the same officers as in case of other city elections. The ballot to be provided shall be printed in the following form: OFFICIAL BALLOT TAX FOR THE ERECTION OF FREE PUBLIC LIBRARY BUILDINGS CITY OF JEFFERSON, COLE COUNTY, MISSOURI TUESDAY, APRIL 7, 1964 PROPOSITION ® For an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City. Against an increased rate of taxation for ten years of two mills tax per annum for the erection of free public library buildings in Jefferson City. INSTRUCTIONS TO VOTERS To vote in favor of the proposition place an X in the square q=) immediately preceding the words: "For an increased rate of taxation etc. " To vote against the proposition, place an X in the • square (Q) immediately preceding the words: "Against an increased rate of taxation etc. " -3- r Section 4. That the said election shall be held in all the wards and precincts of said city and at the same polling places designated for the election of city officials. Polls of said election shall be open at the hour of six A. M. and continue open until the hour of seven P. M., , on said date. Said election shall be held and conducted and the results thereof shall be certified, can- vassed, and declared in all respects in conformity with the Constitution and Laws of the State of Missouri governing elections in said City of Jefferson and In accordance with the ordinances of said city.
