AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND THE CITY CLERK OF THE CITY TO EXECUTE IN BEHALF OF THE CITY AN AGREEMENT WITH THE CONSULTING ENGINEERING FIRM OF HORNER & SHIFRIN, ST. LOUIS, MISSOURI, TO SUPPLEMENT AND MODIFY A PREVIOUS AGREEMENT, DATED FEBRUARY 5, 1962, EXECUTED BY THE CITY AND HORNER & SHIFRIN RELATING TO NAMED PROFESSIONAL SERVICES TO BE FURNISHED BY HORNER & SHIFRIN TO THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : Section 1 . The Mayor and the City Clerk are hereby ® authorized to execute in behalf of the City of Jefferson, Missouri, an agreement with the consulting engineering firm of Horner & Shifrin, St. Louis, Missouri, to supplement and modify a previous agreement, dated February 5, 1962, executed by the City and Horner & Shifrin which related to named professional services to be furnished by Horner & Shifrin to the City of Jefferson in connection with the City's sewer improvement program. Section 2. The agreement, supplementing and modifying the agreement of February 5, 1962, shall read in words and figures as follows: e SUPPLEMENTAL AGREEMENT This Supplemental Agreement modifies the Agreement dated February 5, 1962, by and between the City of Jefferson, Cole County, Missouri, and Horner & Shifrin, Consulting Engineers, St. Louis, Missouri, The scope of the February 5, 1962 Agreement is hereby modified to include the following services to be performed by Horner & Shifrin. ' 1. Provide the plans, specifications, contract documents and other data required for the Sewerage Improvement Project. 2. Attend bid openings and prepare and submit tabulation of bids. 3. Submit a report once a month to the City with a copy for the HHFA Field Engineer covering the general progress of the job and describiiig any problems or factors contributing to delay (only on parts of project related to APW Grant). 4, Provide supervision of project construction including periodic inspection to assure compliance with plans, specifications and contract documents 5. Prepare and submit proposed contract change orders. 6. Review and approve contractor's schedule of amounts for contract payment. 7. Certify payments to contractors. 8. Notify the HHFA Field Engineer as to the date construction started. Construction start is defined as the date upon which on-site labor payments have commenced. (Only on parts of project related to APW program). 9. Submit a weekly report to the HHFA Field Engineer as to the percentage of construction completed with an explanation of any delays that have occurred. (only on parts of project related to APW Program). 10. Provide resident engineering services to supervise construction of the project. The services enumerated in items 1 through 9 shall be included in the work outlined in Phase II of the February 5, 1962 Agreement and payment therefor shall be included in the fee specified for Phase II of said Agreement. The services of a resident engineer shall be paid for on the basis of $16, 764 per year, payable in 12 monthly installments of $1, 397 per month. The effective beginning date of the resident engineering services shall be May 1, 1964 and shall continue through April 30, 1965, and shall thereafter automatically be renewed from year to year unless notice of termination is given by either party not less than 30 days prior to any annual renewal date, with the provision that either party may request renegotiations of the scope and/ or fee after April 30, 1965. It is understood that the City of Jefferson will supply inspectors to work directly under the supervision of Horner & Shifrin's resident engineer. Should Horner & Shifrin be required to furnish inspectors, such services shall be paid for on the basis of $50 per day per inspector for work performed on or with relation to the project. Should it be found during the course of certain portions of the work that the resident engineer will be able to spend part of his time on activities not directly related to the supervision of construction, but still on activities Alk related directly to the overall sewerage improvement program, the City will be billed only for that portion of the resident engineer's time applicable to the supervision of construction. Upon the execution of the aforementioned agreement, a fully executed copy thereof and a copy of this ordinance shall be mailed to the firm of Horner and Shifrin, Consulting Engineers, St. Louis, Missouri , by the City Clerk.
