HomeMy Public PortalAboutORD07508 • y i BILL NO. 160 INTRODUCED BY COUNCILMEN : HOGG and CLINE ORDINANCE NO. 7.'D g I AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DISCONTINUING AS A RIGHT OF WAY FOR A PUBLIC ALLEY AND VACATING A PORTION OF A PUBLIC ALLEY, AND RESERVING TO THE CITY AN EASEMENT IN THE VACATED RIGHT OF WAY FOR SANITARY SEWER, STORM SEWER, SURFACE WATER DRAINAGE AND PUBLIC UTILITY PURPOSES, AND AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE ALL INSTRUMENTS REQUIRED OR NECESSARY TO CONFIRM IN THE ABUTTING PROPERTY OWNERS THEIR REVERSIONARY RIGHTS IN I THE VACATED RIGHT OF WAY. WHEREAS, the City of Jefferson, Missouri, has been petitioned -b vacate a portion of a public alley, as described in Section 1 of this ordinance, so that the right of way for said alley will be discontinued for the purpose of a public thoroughfare, and WHEREAS, the City Council finds that the portion of the alley described in Section 1. of this ordinance has never been improved but has been utilized for sewer and public utility purposes, and WHEREAS, the Council finds that it is necessary, expedient and in the public interest to discontinue as a public thorough- fare and vacate as a public alley, subject to a reservation in the city of an easement for sanitary sewer, storm sewer, surface water drainage and public utility purposes, that portion of the right of way for a public alley described in Section 1 of this ordinance, now therefore : BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : Section 1. The City Council, having considered a petition for the vacation of the portion of a public alley hereinafter described, does hereby find and declare that it is necessary, expedient and in the public interest to vacate that portion of a public alley hereinafter described, and, by this ordinance, does hereby discontinue as a public thoroughfare and forever vacate as a public alley, subject to the provisions of Section 2 of this ordinance, the following-described property: All of that part of a public alley in the City of Jefferson, Missouri, bounded on the north by Inlot No. 428 and on the south by Inlot No. 4321 that lies west of a line that is parallel to and 32 .0 feet westerly of the east line of Inlots Nos. 428 and 432 in the City of Jefferson, Missouri . Section 2. The City does hereby reserve for its use and for the use of any public utility in the city an easement in, under, over and upon the area described in Section 1 above for purposes of constructing, repairing,maintaining, servicing, locating and relocating sanitary sewers, storm sewers, surface water drainage and all public utility facilities . Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, subject i to the easement expressly reserved in Section 2 of this ordinance, as is provided by the laws of the State of Missouri, i and the Mayor and the City Clerk of the city are hereby authorized and directed to execute all instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the right of way vacated.
