HomeMy Public PortalAboutORD07509 BILL NO. �(d� i INTRODUCED BY COUNCILMEN : Hogg and Cline i ORDINANCE N0. 24--e-21 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI DISCONTINUING AS A RIGHT OF WAY FOR A PUBLIC THOROUGHFARE AND VACATING i A PART OF BERRY STREET IN THE CITY OF JEFFERSON, MISSOURI , AND AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE IN WRITING ALL INSTRUMENTS NECESSARY OR REQUIRED TO CONFIRM IN THE OWNERS OF THE ADJACENT LAND i THEIR REVERSIONARY RIGHTS IN AND TO THE VACATED AREA. WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri, that the owners of land, abutting on that portion of Berry Street described in Section 1 of this ordinance, have petitioned the City Council i to discontinue as a right of way for a public thoroughfare and vacate the portion so described, and WHEREAS, it has further been shown that the area petitioned to be vacated is not used by the public, and that any prospective use thereof would be of no benefit to the public, and that it would not inconvenience the public or the citizens of this city to discontinue as a right of way for a public thoroughfare and vacate that portion of Berry Street described in Section 1 of this ordinance, now, therefore : BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : ' Section 1 . The City Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a right of way for a public thoroughfare and forever vacate the following-described property: All of that part of Berry Street in the City of Jefferson, Missouri, which is bounded on the east by Lot 6 in Block 13 of Lower Jefferson Addition and on the west by Lot 16 in Block 14 of Lower Jefferson Addition, as said Lower Jefferson Addition to the City of Jefferson, Missouri, appears per plat of record in Plat Book 1 at Page 16, Cole County Recorder's Office. Section 2. The statutory right of reversion in the owners of the property abutting on the area vacated above, as provided by the laws of Missouri, is hereby expressly i confirmed, and the Mayor and the Clerk of the city are hereby authorized and directed to execute in writing all i I instruments necessary or required to confirm in the abutting property owners their reversionary rights in the land described above and hereby vacated.
