MCI AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , DISCONTINUING AND VACATING AS A RIGHT OF WAY FOR A PUBLIC THOROUGHFARE THE 30 FOOT DRIVE, EXTENDING BETWEEN FAIR ACRES PARK AND ROGERS STREET, AND THAT PART OF FAIRACRES DRIVE AND ROGERS STREET, AS APPEAR ON A PLAT OF RCORD IN FLAT BOOK 2 AT PAGE 282 COLE COUNTY RECORDER'S OFFICE, LYING SOUTH OF STADIUM BOULEVARD IN THE CITY OF JEFFERSON, MISSOURI, AND AUTHORIZING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE ALL INSTRUMENTS NECESSARY TO CONFIRM IN THE ABUTING PROPERTY OWNERS THEIR REVERSIONARY RIGHTS IN AND TO THE VACATED RIGHTS OF WAY. WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri, that the owner of all of the land abutting on the rights-of-way hereafter described in Section 1 of this ordinance has petitioned the-council to discontinue and vacate as a right of way the rights-of-way so described, and WHEREAS, it has been shown to the City Council that the rights of way petitioned for discontinuance and vacation have never been opened, are not now being used by the public, and are of no benefit to the public and would notinconvenience the public-if-they were vacated and discontinued as public rights- of-way, now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : Section 1. The City Council of the City of Jefferson, Missouri, hereby declares that it is necessary, reasonable and proper to discontinue as right-ofway for public thoroughfares and does hereby vacate the following described property: The 30 foot drive extending between Fair Acres Park and Rogers Street, as said park and street appear on a plat of record in- Book 2 at Page 28 Cole County Recorder' s Office, and all of Fairacres Drive and Rogers Street, as said streets appear on the aforementioned plat, lying south of the south right of way line of Stadium Boulevard in the City of Jefferson, Missouri. Section 2. The statutory right of reversion in the rights of way hereby vacated are hereby confirmed in the abutting property owners on the vacated areas, and the Mayor and the Clerk of the City are hereby authorized and directed to execute all instruments necessary to confirm in them their reversionary rights.
