AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY, FOR AND IN BEHALF OF THE CITY, TO EXECUTE AN AGREEMENT WITH WEATHERBY POSTING SERVICE, INC. , RELATING TO THE ERECTION OF ADVERTISING SIGNBOARDS WITHIN THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1 . The Mayor and the Clerk of the City are hereby authorized and directed to execute, for and in behalf of the City, an agreement with Weatherby Posting Service,. Inc. , relating to the erection of advertising signboards within the city. Section 2. The agreement mentioned in Section 1 shall read in words and figures as follows: (Insert agreement) 6 I 1 . • I r A G R E E M E N T ® THIS AGREEMENT made and entered into this �day of October, 19641 by and between the City of Jefferson City, Missouri, a Municipal Corporation, hereinafter referred to as The City, and Weatherby Posting Service, Inc. , hereinafter called Weatherby, WITNESSETH: 1 . The City agrees to grant Weatherby, its successors or assigns, the privilege of erecting and maintaining illuminated or non-illuminated advertising signboards at the following locations in the City: One (1) Non-illuminated signboard at AM McCarty and Harrison Streets One (1) Non-illuminated signboard at 306 East McCarty Street Two (2) Illuminated signboards on the south edge of the alley west of Jefferson Street between Whitton Highway and Miller Street 2. The City also grants Weatherby full right of ingress and egress to and from said signboards on the premises described in Paragraph 1 above. 3. Weatherby agrees that said signboards shall have approximate outside dimensions of 12' x 25 ', and that they shall be mounted on steel or creosoted polls upright, and shall be located in such a manner so as not to interfere with the full and complete use of the premises; and Weatherby further agrees to maintain said advertising signboards in a neat and orderly condition during the full term of this agreement, or/ and any renewal thereof. 4. Said privilege shall be for a period of three years from the date of this agreement and thereafter shall be from year to year until terminated by either the grantor or the grantee giving to the other written notice of thirty days before the end of the current year. 5 . Weatherby, its successors and assigns, further agree to procure and keep in force, at their expense, liability in- surance during the full term of this agreement, or any extension • w thereof, with limits of $ 100, 000 .00 coverage for any one person injured in an accident involving any of said advertising sign- boards, and not exceeding $3000,000.00 coverage for any one accident involving said advertising signboards; and to fully save the City harmless from the claims of any and all persons whomsoever who may seek or claim damages on account of injuries or damages sustained by reason of erection and/or removal of the aforesaid signboards. 6 . Weatherby will pay the City an annual rental of $45 for illuminated and $30 for non-illuminated signboards per year in advance for each signboard. 7 . If Weatherby should default in the payment of rent or violate any of the terms or provisions of this agreement, then at the option of the City, this agreement may be declared forfeited, and thereupon Weatherby shall, upon payment of the accrued rentals, remove all of said signboards and restore the property upon which they were situated to their original condition.
