AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE A CONTRACT IN THE NAME OF THE CITY WITH JAMES R. SIGNER AND MARGOT SIGNER, HIS WIFE, RELATING TO AN EXCHANGE OF REAL PROPERTY AND OTHER MATTERS INCIDENTAL TO THE WIDENING OF A SECTION OF McCARTY STREET IN THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1 . The Mayor and the Clerk of the City of Jefferson, Missouri, are hereby directed to execute a contract in the name ® of the City with James R. Signer and Margot Signer, his wife, in connection with the widening of McCarty Street in the city. Section 2. Satd contract shall read in words and figures as follows: • C O N T R A C T THIS CONTRACT, made and enterd into this day of April, 1965, by and between the City of Jefferson, Missouri, a municipal corporation located in Cole County, Missouri, as Party of the First Part, and James R. Signer and Margot Signer, his wife, of Jefferson City, Cole County, Missouri, Parties of the Second Part: WITNESSETH WHEREAS, the Party of the First Part is presently the owner in fee simple absolute of real estate located in Jefferson City, Missouri, more particularly described as follows: "All of that part of Lot No. 7 of the second Replat of Vista Place, as of record in Plat Book 3, Page 37, Cole County Recorder' s Office, that is more particularly described as follows: Beginning at the northeast corner of said Lot No. 7, thence westerly along the north line of said Lot No. 7, 110.15 feet; thence easterly 110.68 feet to a point on the east line of Lot No. 7 that is 16.29 feet south of the northeast corner of said Lot No. 7; thence northerly along and with the east line of Lot No. 7, 16.29 feet, to the point of beginning." AND WHEREAS, the Parties of the Second Part are presently the owners in fee simple absolute of real estate located in Jefferson City, Missouri, more particularly described as follows: "A part of Lot No. 6 on the Second Replat of Vista Place, per plat of record in Pat Book 3, Page 37, Cole County Recorder' s Office, more particularly described as follows: Beginning at the southwest corner of said Lot No. 6, thence easterly along the south line of said Lot No. 6, 69.95 feet; thence westerly 67.29 feet to a point on the west line of said Lot No. 6 that is 10.49 feet north of the southwest corner of the said Lot No. 6; thence southerly, along and with the west line of said Lot No. 6, 10.49 feet to the point of beginning." hL AND WHEREAS, the Party of the First Part desires to widen and improve McCarty Street at a point within the city which will require the use of the above described land of the Parties of the Second Part, AND WHEREAS, the Parties of the Second Part are willing to convey to the Party of the First Part their abovedescribed land upon the terms and conditions hereinafter set out, all of which are agreeable to the Party of the First Part, now therefore: IT IS AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: 1. The Parties of the Second Part shall execute a General Warranty Deed to their abovedescribed land in favor of the City of Jefferson, Missouri. 2. In consideration for the conveyance of the land described in the preceding paragraph, the Party of the First Part shall: (a) Execute a Corporate Deed to their land, as described above, in favor of James R. Signer and Margot Signer, his wife. (b) Cause McCarty Street to be widened and then improved adjacent to the land of the Parties of the Second Part at no cost or expense to the Parties of the Second Part. (c) Pay to the Parties of the Second Part the sum of Sixty ($60.00) Dollars. (d) Replace the existing fence on the land of the Parties of the Second Part if the same cannot be relocated in its present general condition on the new south property line of the Parties of the Second Part (e) Cause the south bank of the lot of the Parties of the Second Part or any unused right of way on the north side of that part of McCarty Street to be widened to be sodded. (f) Bear all expense of the recordation of an and all instruments caused by this exchange of documents 3. The deeds and money to be exchanged between the parties shall be concurrently exchanged no later than April 9, 1965. The Mayor and the Clerk of the city are hereby authorized and directed to execute a deed on behalf of the City in favor of James R. Signer and Margot Signer, his wife, conveying to them the land owned by the City as described in said contract. Section 4. The Mayor is hereby authorized and directed to accept in behalf of the city a deed from James R. Signer and Margot Signer to the City conveying the land owned by the Signers as described in said contract. Section 5. Upon acceptance of the Signer Deed, the Clerk is authorised and directed to record same in the Office of Recorder of Deeds of Cole County, Missouri. Section 6. This ordinance shall take effect and be in force from and after its passage and approval.
