HomeMy Public PortalAboutORD07645 BILL NO. / 0 INTRODUCED BY COUNCILMAN: SKAIN ORDINANCE NO. 7 t AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELATING TO NUISANCES, PROVIDING FOR INSPECTION OF PREMISES AND NOTICE TO ABATE, PROVIDING A PRESUMPTION OF RESPONSIBILITY AND FOR THE ABATEMENT OF NUISANCES, AND FIXING A PENALTY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Nuisance defined. The accumulation or existence upon any lot, parcel of ground, or land within the city, of any putrid or uncured meat, pork, fish, fowel, decayed vegetable matter or food of any kind, offal, manure or rubbish 6 which, by decay or putrefication is, or may become, offensive or detrimental to the health, safety or welfare of human beings or animals shall constitute, and is hereby declared to be, a nuisance. Section 2. Nuisance defined. The accumulation or existence upon any lot, parcel of ground, or land within this city, of any wood, metal or other building materials, household or business furnishings or equipment, abandoned motor vehicles, , clothing or other materials, cans, bottles, tires, rubbish or trash, in such a manner as to constitute a harbour or breeding ground for mosquitoes, flies, insects, rats, snakes or other rodents shall constitute, and is hereby declared to be, a nuisance. Section 3. Inspection of Premises. The city marshall, policemen, and health officer of this city, or his representa- tive, are hereby authorized to enter upon any premises within this city to determine if any nuisance described above exists on the premises and to identify the parties reponsible therefor. Section 4. Notice to Abate. The health officer of the city, or his representative, upon learning of the existence of any nuisance described above, shall give written notice to the parties causing or maintaining same to abate the nuisance within a reasonable time to be specified in the notice. t Such notice shall be served by the city marshal or any police- man of the city. The person serving the notice shall make a written return on a copy thereof, subscribe his name thereto and return the same to the health officer. The return shall state how, when, where and on whom the notice was served. Such notice may be served by delivering same to the parties to be notified, or by leaving a copy thereof, at the usual place of abode of the person notified, with a member of the family over the age of fifteen years, or by leaving a copy thereof with the person in charge of the office of any partner- ship, firm or corporation. Section 5. Presumption to Apply. In any prosecution for a violation of any of the provisions of Sections 1 or 2 of this ordinance, proof that the defendant or defendants named in the information was or were at the time of the alleged violation the owner(s) or occupant(s) of the premises described in the information where the nuisance was alleged to exist, shall constitute in evidence a prima facie presumption that the defendant (s) named in the information caused the nuisance specified therein. Section 6. Penalty. Any person or persons, including {Adolk every officer, agent of employee of any corporation, who shall cause, maintain, or allow to exist any nuisance defined in Sections 1 or 2 of this ordinance on any lot, parcel of ground, or land owned or occupied by him or them within this city, and who shall fail to abate or remove same within the time specified in a notice to abate, shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine of not more than one hundred dollars, and every day such nuisance is maintained or allowed to exist shall constitute a separate and distinct offense, punishable by a like fine . Section 7 . Effective Date. This ordinance shall take effect d be in force from and after its td assage and approval . Failure to correct the conditions noted above within days from the service of this notice will subject you to prosecution under Ordinance Number and a penalty of not to exceed $100 .00 per day for each day that the conditions of nuisance continue to exist.
