This Agreement is entered into this 30th day of June, 2005, and effective July 1,
2005, by and between the City of Richmond, Richmond, Indiana (hereinafter "City") and
Richmond Sanitary District (hereinafter "RSD")
WHEREAS, an outside management study on behalf of the City of Richmond
has recommended the need for a health and safety officer for the City of Richmond,
Indiana, who would be responsible for developing written policies and procedures for
exposures common to the various departments of the City of Richmond, Indiana; and
WHEREAS, previously the health and safety coordinator for RSD has been
employed by the Richmond Sanitary District; and
WHEREAS, there is a need to expand the current position of health and safety
coordinator within RSD to a city-wide health and safety officer position working with the
Richmond Sanitary District, Richmond Street Department and the Richmond Parks
Department; and
WHEREAS, the City and RSD desire to set forth in writing the terms of this
agreement through this Interlocal Agreement regarding the hiring and job duties of a
health and safety officer with the RSD and the City.
NOW, THEREFORE, in consideration of the terms and conditions contained
herein, including the above stated recitals, the parties agree as follows:
1. Health and Safety Officer. There is a need for a health and safety officer
for RSD as well as the City of Richmond, which individual shall be
responsible for developing and maintaining health and safety programs for
the City of Richmond.

2. Duties of Health and Safety Officer. Some of duties of the health and
safety officer are as follows:
a. Develops, maintains and updates a variety of health and safety
programs, including, but not limited to, medical surveillance; hearing
conservation, fire safety; chlorine and sulfur dioxide; welding, cutting
and brazing, confined space entry; lockout/tagout; excavation,
CPR/first aid training; slips, trips, and falls; traffic control; power
industrial truck, snow removal, electrical safety; respirator safety;
hazardous communication/right to know; emergency action plan,
chemical hygiene; and blood borne pathogen.
b. Develops, maintains and updates New Employee Safety Orientation,
including providing employees training on OSHA requirements and
emergency procedures, reporting accidents procedure, obtaining
permission for performing license checks through state agencies,
offering employees medical protection and issuing Personal Protection
Equipment to employees and instructing on use. Answers questions
during orientation concerning safety.
c. Performs Sara Title III reporting, including completing proper
documentation concerning extremely hazardous chemicals and
submitting it to Environmental Protection Agency (EPA), Wayne
County Emergency Management, and City Fire Department.
d. Develops and maintains risk management plan, ensuring updated fire
and emergency plans and forwarding copies of plan to EPA.
e. Oversees contractor safety, verifying contractors are performing tasks
according to OSHA standard and contractors and employees are not
exposed to unsafe conditions.
f. Conducts defensive driving class for employees with driving and/or
license related problems.
g. Drives vehicle to various facilities and performs monthly inspections
of plant, landfill, and other City facilities, reporting to proper
employees any problem concerning codes and regulations, and
submitting work orders to be completed. Checks status of problem
after correction to verify that it meets codes and regulations.
h. Performs a variety of inspections for accuracy, including field/work
crew, boiler, overhead cranes and log.
i. Faxes CDL physicals to Indianapolis. Assists Human Resources
Department with drug testing.

j. Assists with preparation and administration of capital safety budget.
k. Conducts City Safety Committee meetings, including developing
safety policies and recommending changes to improve conditions
throughout the City.
1. Develops, maintains, and updates household hazardous waste program,
including bid quote from contractors for disposal, scheduling pick ups
from contractor, determining waste to be collected, ensuring
contractors carry necessary certifications to collect and haul waste,
providing employee training in-house and out -of -house and visiting
disposal facility yearly to ensure proper certifications to dispose of
waste according to EPA cradle to gravel chemical regulations.
m. Assists with developing, maintaining, and updating vehicle accident
reporting procedure, including preparing final accident report,
maintaining log of vehicle registrations, and ensuring vehicles have
registration and insurance information in case of an accident.
Communicates with insurance providers and affected parties, ensuring
required information is given, ensuring proper expediting of insurance
claims, and answering questions about claims. Maintains records of
accidents, reviewing them quarterly to discover possible trends.
n. Develops, maintains, and updates personal injury accident reporting,
including preparing final accident report and worker's compensation
report, reviewing accidents quarterly to discover possible trends,
assessing each accident and determining cause and making changes in
procedure as needed. Communicates with worker's compensation
provider to ensure required information is given.
o. Maintains accurate and current OSHA log following OSHA rules and
regulations, including entering accidents into log, updating log for
inspections, filing previous five years of logs, submitting logs and
other reports for final processing yearly, and posting summary of
accident during proper time frame.
p. Performs job hazard assessments, including assessing each job to
ensure hazards are recognized and policies and procedures are
established to minimize hazards, and updating assessment when job
duties change or new jobs are created.
q. Recommends purchases of safety equipment for Sanitary District and
City, including assessing needs of departments, researching applicable
codes and regulations, evaluating equipment, completing proper
purchasing requirements, expediting orders, checking equipment for

proper operation, and ensuring employees' working knowledge and
proper maintenance of equipment.
r. Performs related duties as assigned.
3. Salary for 2005. The salary range for the Health and Safety Officer shall
range from $35,582.94 to $40,500.00 for 2005. Of the salary paid to the
Health and Safety Officer, RSD shall be responsible for 75% of the Health
and Safety Officer's salary and benefits, with the Richmond Parks
Department responsible for 12.5% of the salary and benefits of the Health
and Safety Officer and the Richmond Street Department responsible for
12.5% of the salary and benefits of the Health and Safety Officer.
4. Salary for 2006. Beginning with calendar year 2006 and each year
thereafter, RSD shall pay 50% of the salary and benefits of the Health and
Safety Officer with the Richmond Parks Department and Richmond Street
Department each paying 25% of the salary and benefits of the Health and
Safety Officer.
5. Supervision. Supervision of the Health and Safety Officer will be
determined by the Director of RSD. The office of the Health and Safety
Officer will be stationed at RSD. The Health and Safety Officer will work
with the supervisor from RSD, the Richmond Parks Department
Superintendent and the Street Commissioner in establishing training and
safety line items within department budgets for 2006 and each year
thereafter.
6. Priorities. Unless there is an emergency which puts an employee at risk in
a department other than RSD, the RSD responsibilities will be primary in
priority. Priority may be based on urgency.
7. Miscellaneous. This Agreement shall be construed according to the laws
of the State of Indiana.
8. Amendments. No amendment or modification to this Interlocal
Agreement shall be made except in writing and signed by both parties.
9. Authorization. The individuals signing below represent that they have full
authorization to execute this document on behalf of either the City of
Richmond or the Richmond Sanitary District.

IN WITNESS WHEREOF the parties execute this Agreement as of the date first set forth
above although signatures may be fixed on a different time.
