FOR THE OPERATION AND INTER- ! CHANGE OF COMMON SERVICE OF THE RESPECTIVE FIRE DEPARTMENTS OF SAID CITIES IN I CASE OF MAJOR CONFLAGRATION OR MAJOR DISASTER. �. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON CITY, MISSOURI AS q FOLLOWS: I Section 1. That the City of Jefferson City, Missouri be and is hereby authorized and empowered to contract, and does hereby contract with the re- spective cities of Centertown, Russellville, California, Taos, Westphalia, and Linn, Missouri, to create a pool of fire fighting equipment and personnel from the fire departments of the respective contracting cities and to set up a plan of mutual assistance in case of a major conflagration or disaster occurring in any of the respective cities; said contract to be under and by virtue of the !; provisions of Section 169 Article VI, of the Constitution of Missouri, and i of Sections 70.210, 70.220, 70.2309 71.3709 71.380, 71.390, 71.4009 71.410 and 71.420 of the Revised Statutes of Missouri for 19499 and which contract is in words and figures as follows: i "THIS AGREEMENT, made and entered into by and between the Cities of Center town, Russellville, California, Taos, Westphalia, and Linn, Missouri witnesseth: E �j WiEREAS, the said cities are empowered by ordinance duly enacted in each of i said cities to enter into this contract. NOW, THEREFORE, in consideration of the mutual agreements hereinafter I mentioned, to be performed by the said respective cities, it is agreed between said cities as follows: A joint fire department committee, consisting of one member from each of the contracting parties who shall be the fire chief of the fire department of the respective city shall be created and directed to make a survey of the fire departments of each of the contracting cities and to arrange a pool of such I fire fighting equipment and personnel that could be safely spared from each or any of the contracting cities to respond to the call for assistance from ii any of the cities in case of a major conflagration or disaster occurring therein. l The joint fire department committee shall set up a plan of mutual assist- ance among the contracting cities and shall correlate the fire fighting facilit i ies of each city for the purpose of mutual safety. In the event of a call for jf assistance from any of the cities# all the fire departments from the contracting i cities shall be on the alett to come to the assistance of the city or cities, i responding to the call in case of need, and shall remain on the alebt until j the emergency is ended. i All the fire equipment and personnel pooled for mutual assistance shall be stationed in the City owning and operating same and the chief of the fire department of each City shall be the judge of whether any part of his equipment ; and personnel can be safely spared from his city at the time and under the circumstances in the event of a call for assistance. The joint fire department committee shall prescribe such rules and regulat= ions as are necessary and incidental to the efficient operation of the plan of mutual assistance and shall set up minimum requirements and standards of main- tenance of fire equipment and personnel of each of the contracting cities, and in event any City or Cities shall fail to maintain their respective fire equip- ment and personnel up to the minimum requirements and standards fixed by the joint fire department committee the committee shall give notice in writing of such failure to such City or Cities so failing to maintain such requirements and standards, and if such City or Cities shall not bring up such equipment or personnel to the requirements and standards within six months from the date of �' i . I -2- such notice, the joint fire department committee may eliminate such City or Cities from the pool and plan of mutual assistance until such requirements and standards are met. In case of loss or damage to the fire equipment of arW of the contracting cities while responding to the call for assistance to any other city pursuant to this agreement, such loss or damage shall be borne by the city owning and operating such equipment. The tern of this contract shall be for a period of five years from the date it becomes in force and effect." Section 26 The chief of the fire department of the City of Jefferson, Missouri, is hereby appointed as a member of the joint fire department committee and is authorized and directed to carry out the terms of the foregoing contract and is further authorized to send such fire fighting equipment and personnel owned and operated by the City of Jefferson City to the assistance of the Cities Centertown, Russellville, California, Taos, Westphalia, and Linn, Missouri, in case of a major conflagration or disaster, in the event of a call for assist- ance from any of said cities, whenever in his judgement same can be safely spared from the City of Jefferson at the time and under the circumstances. Section 3. This ordinance and contract shall take effect and be in force from and afte its passage and approval, and as soon as a similar ordinance embodying the agreements set forth herein has been passed and approved by each of the Cities of Centertown, Russellville, California, Taos, Westphalia, and Linn, Missouri. Section 4. Upon passage of this ordinance the Clerk of the City of Jeffer- son City, Missouri, shall certify copies of same and shall mail a copy the the City Clerks of each of the Cities of Centertown, Russellville, California, Taos, Westphalia, and Linn, Missouri.
