AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CLERK OF THE CITY TO EXECUTE A QUITCLAIM DEED CONVEYING TO RAYMOND M. VELTROP AND BERNADINE J. VELTROP, HIS WIFE, ALL THE RIGHTS, TITLE AND INTEREST OF THE CITY IN CERTAIN DESCRIBED LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: ® Section I. The Mayor and Clerk of the City are hereby authorized ' and directed to execute a corporate quitclaim deed dated January 3, 1966, in favor of Raymond M. Veltrop and Bernadine J. Veltrop, his wife, as grantees. Section 2. Said corporate quitclaim deed shall read in words and figures as follows: ® CORPORATE (QUITCLAIM DEED WHEREAS, Raymond M. Veltrop and Bernadine J. Veltrop, his wife, as grantors, did on July 29, 1964, execute an instrument entitled "Sani- tary Sewer E Bement" appearing of record in Book ,187, page 627, Cole County Recor er's Office, to the City of Jefferson, Missouri, as grantee, whereby the grantors did convey a sanitary sewer easement to the grantee in land specifically described in the aforementioned instrument, and WHEREAS, the description contained in said "Sanitary Sewer Easement" of record in Book 187, page 627, Cole County Recorder's Office, is erroneous; and WHEREAS, the City of Jefferson, Missouri, desires to divest itself of any interest in said erroneous "Sanitary Sewer Easement" f record in Book 187,' page 627, Cole County Recorder's Office; NOW, THEREFORE, THIS INDENTURE made on this JAI _day of 196C , by and between the City of Jefferson, Missouri, a municipal corpor - tion located within the County of Cole, Missouri, Party of the First Pa , and Raymond M. Veltrop and Bernadine J. Veltrop, his wife, of Cole County, Missouri, Parties of the Second Part: WITNESSETH: That the Party of the First Part, in consideration 90of the sum of One ($1.00) Dollar and otter good and valuable consideration to it paid, receipt of which is hereby acknotiledged, does by these presents, Remise, Release and Forever Quitclaim unto the Parties of the Second Part, all of its right, title and interest in and to the land hereinafter de- scribed, being the same tract described in the aforementioned "Sanitary Sewer Easement" of record in Book 187, page 627, Cole County Recorder's Office, lying, being and situate in the City of Jefferson, Missouri, County of Cole, to-wit: A strip of land 10 feet of even width, across Lots Nos. 309, 310, and 311, of Wulfert's Re-subdivision, in the City of Jefferson, Missouri; the centerline of said 10 foot strip of land being more particularly described as follows: Beginning. at a point on the southwesterly line of Lot No. 309, which is 99.1 feet, more or less, northwesterly from the most south- erly corner of said Lot; thence northeasterly at an angle of 107 degrees 15 minutes with the southwesterly line of said Lot No. 309, 69.7 feet, more or less, crossing Lots Nos. 309 and 310, to a point; thence deflecting 47 degrees 36 minutes to the left, 16 feet, more or less, to a point on the northwesterly line of Lot No. 311, which is 6 feet, more or less, northeasterly from the most westerlycorner of Lot No. 311. Also a temporary easement of an even width of 15 feet upon the land located immediately adjacent to each side of the 15 foot strip of land described above for the initial construction of said sani- tary sewer facilities; said easement to terminate upon the comple- tion of the construction thereof. TO HAVE AND TO HOLD the aforesaid premises, with all the rights, immunities, privileges and appurtenances thereto belonging unto thesaid Parties of the Second Part, and unto their heirs and assigns forever, so that neither the said Party of the First Part, nor its successors or as- signs, nor any other person or persons for it or in its name or behalf, shall or will hereafter claim or demand any right or title to the afore- said premises or any other party thereof, but they and everyone of them, shall, by these presents, be excluded and barred forever. IN WITNESS WHEREOF, the said Party of the First Part has caused these presents to be signed by its Mayor and attested by its City Clerk and its corporate seal to be hereto affixed the day and year first above written. Christy, to me personally known, who, being by me duly sworn, did say. that he is- the Mayor of the City of Jefferson, Mis- souri, that the' seal affixed to this instrument is the corporate seal of said municipal corporation, 'and that said instrument was signed and sealed on behalf of said municipal corporation by authority of its City Council. And the said John G. Christy acknowledges said instrument to be the free act and deed of said municipal corporation.
