MAJOR AND GLADYS M. MAJOR, HIS Ij WIFE, AND ROBERT J. MAJOR AND EDITH E. MAJOR, HIS WIFE, RELATING TO THE PURCHASE AND PAYMENT OF CERTAIN REAL ESTATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: i Section 1. The Mayor and the Clerk of the City of Jefferson, Missouri, a.re.hereby authorized and directed to execute a contract with Keith W. Major and Gladys M. Major, his wife, and Robert J. Major and Edith E. Major, his I wife, relating to the purchase and payment of certain real estate. iSection 2. Said contract shall read in words and figures as follows: I { f r;. AGREEMENT THIS AGREEMENT, made and entered into this 12th day of,-„Januar,Y , 1966, by and between the City of Jefferson, Missouri, a municipal corpora- tion of the third class, organized and existing in the County of Cole, State of Missouri, hereinafter designated First Party, and Keith W. Major and Gladys M. Major, his wife, and Robert J. Major and Edith E. Major, his wife, of the County of Cole, State of Missouri, hereinafter designated Second Parties: WITNESSETH: WHEREAS, by a Warranty Deed dated July 15, 1965, and recorded in Book 8� 149- at page , Cole County Recorder's Office, Second Parties deeded to First Party the following described land: Part of the Southeast quarter of the Northeast quarter of Section 34, Township 45, Range 12, more particularly described as follows: From the northeast corner of the Southeast quarter of Sec- tion 340 Township 459 Range 12; thence west along the half sec- tion line, 525.27 feet; thence north parallel with the east sec- tion line of said Section 34, 481.7 feet, to a point; thence east at an angle of $$ degrees 25 minutes with the northern ex- tension of said line, 196.55 feet, to a point; thence deflecting 34 degrees 09 minutes left, 354.9$ feet, to the beginning point of this description; thence deflecting left in a northeasterly direction 02 degrees 57 minutes, 25 feet, to a point; thence de- flecting left in a northwesterly direction 90 degrees 0 minutes, 35 feet, to a point; thence deflecting left in a southwesterly direction 90 degrees 0 minutes, 35 feet, to a point; thence de- fleeting left in a southeasterly direction 90 degrees 0 minutes, 35 feet; thence deflecting left in a northeasterly direction 90 degrees 0 minutes, 10 feet, to the beginning point of this de- scription. Together with an easement over a strip of land 30 feet wide for an access road to the sewage pumping station to be situated on. the above described tract, the centerline of said 30-foot ease- ment being described as follows: Beginning at a point 20 feet northeasterly of the most south- erly corner of the above described tract; thence southeasterly at right angle to the aforementioned line, 310 feet, more or less, to a point on the west line of Belair Drive. WHEREAS, The First Party intend: to use the above described land for a sewage pump station in the Gray's Creek Watershed, and WHEREAS, The Second Parties have agreed to deed and convey to First Party by a Warranty Deed the following described land for a sewage over- flow basin incidental to the pump station in the Gray's Creek Watershed: P Part of the Southeast, quarter of the Northeast quarter of Section At Township 45, Range 12, more particularly described as follows: From the northeast corner of the Southeast quarter of Sec- tion 34, Township 45 North, Range 12 West; thence west along the half section line, 525.27 feet; thence north parallel with the east section line of Section 34,0481.7 feet, to a point; thence east at an angle of 8$ degrees 25 minutes with the northern ex- tension of said line, 175.55 feet, to the beginning point of this description; thence deflecting right 55 degrees 51 minutes, a dis- tance of 50 feet, to a point; thence deflecting 90 degrees 0 min- utes left, a distance of 354.70 feet, to a point; thence deflecting left 90 degrees 0 minutes, 50 feet, to a point; thence deflecting 92 degrees 43 minutes left, 10 feet, to a point, which is the southernmost corner of the .28 acre tract prevbusly conveyed to the City of Jefferson; thence deflecting 90 degrees 0 minutes right, a distance of 35 feet, to a point; thence deflecting 54 degrees 56 minutes left, a distance of 249.80 feet, to a point; thence deflecting 70 degrees 21 minutes left, a distance of 167.47 feet, to a point; thence deflecting 52 degrees 0 minutes left, a distance of 65.0 feet, to the beginning point of this description. ® Containing 1.26 acres, more or less. NOW THEREFORE, it is hereby agreed by and between the parties as follows: 1. Upon delivery to First Party of a Warranty Deed duly and properly executed by the Second Parties conveying to First Party the tract of land last described above, First Party shall pay to Second Parties the sum of Three Thousand ($3,000.00) Dollars for allland and easements hereinabove described. 2. Second Parties shall pave at their expense the full width of the thirty (30) lineal feet of Belair Drive lying directly opposite the thirty (30) foot easement conveyed to First Party as an access road to the sewer pump station site. 3. Second Parties shall cause a public water service to be extended to, and available for use by the First Party, the intersection of Belair Drive and the thirty (30) foot access road to the sewer pump station site on or before June 30, 1966. Christy, to me personally known, who, being by me duly sworn, did say that he is the Mayor of the City of Jefferson, Missouri, that the seal affixed to this instrument is the corporate seal of said muni- cipal corporation, that said instrument was signed and sealed on behalf of saidmunicipal corporation by authority of its City Council. The said John G. Christy further acknowledges said instrument to be the free act and deed of said municipal corporation.
