AMENDING CHAPTER 13 OF THE MOAB MUNICIPAL CODE, AND MODIFYING THE
SEWER RATE STRUCTURE OF MOAB CITY.
WHEREAS, the City of Moab finds it necessary to make
improvements in the sewer system and wastewater treatment
facilities that serve the City of Moab and other users of the Moab
City sewer system; and
WHEREAS, increased revenues to the sewer fund are needed to
cover the cost of present and future sewer system expansions and
improvements; and
WHEREAS, the City believes it is necessary to have an
equitable sewer rate structure that charges each user according to
the user's approximate impact on the sewer system;
NOW, THEREFORE, BE IT ORDAINED by the Moab City Council as
follows:
Moab City Municipal Code Chapter 13.24 is amended to include
Section 13.24.001 to read as follows:
13.24.001 Definitions
For the purposes of this Chapter:
A. "Single Family Residential Dwelling" is defined as any
single family dwelling unit used for domestic purposes, served
by one water meter.
B. "Multiple Dwelling" or "Multiple Unit Residential
Complex" is defined as any group of residential units used for
domestic purposes, served by one water meter, including, but
not limited to multiple family dwellings, apartment unit
complexes, townhouse and condominium complexes, and trailer
and mobile home parks.
C. "Commercial Establishment" is defined as any retail,
service, or business establishment, including all businesses
that provide overnight accommodations.
D. "Governmental entity" is defined as any legislative,
judicial, administrative or regulatory entity.
E. "Institution" is defined as including schools, churches,
hospitals, nursing homes, and similar institutional
establishments.

F. "Average monthly winter water usage rate" is defined as
the water usage rate in thousands of gallons, calculated
annually by averaging the water usage in the 4 months of
November through February.
Moab Municipal Code Section 13.24.010 is hereby amended to read as
follows:
13.24.020 Sewer Rate Schedule

B. Individual Rate Calculation
In cases in which the City Manager determines that the standard
rate or formulas as defined in this chapter produce an inaccurate or
inappropriate charge, the City Manager may calculate the sewer rate
based on other available information, providing that the rate must
be equitable with respect to rates calculated for other users in the
system, subject to Council approval.
THIS ORDINANCE WILL TAKE EFFECT ON AUGUST 1, 1995.
