Home My Public Portal About2003-22 Approving a bid to Construct a Bus ShelterRESOLUTION NO. 2003-22 A CAPITAL PROJECT AUTHORIZING RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; APPROVING A BID TO CONSTRUCT A BUS SHELTER NEAR THE CURRENT STOP AT CRANDON BOULEVARD NORTH OF OCEAN DRIVE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Council authorized the Village Manager to solicit bids to construct a bus shelter near the current bus stop on Crandon Boulevard and Ocean Lane Drive based on plans prepared by the architect, Eduardo Muhina; and WHEREAS, the project was advertised and three (3) construction companies attended a pre - bid meeting; and WHEREAS, Island Construction Group Inc. submitted a bid to construct the project. NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS: Section 1. That the Village Council approves the attached Proposal submitted by Island Construction Group Inc. and dated April 30, 2003. Section 2. That the Village Manager is directed to enter into an Agreement with Island Construction Group Inc. to construct the bus shelter. Section 3. That the Village Manager and Village Attorney are hereby directed to implement this Resolution. Section 4. Funding for the project will be the Miami -Dade County Peoples Transportation Plan (one half (%2) penny sales tax). Section 5. This resolution shall take effect immediately upon adoption. (hereinafter called "BIDDER"), organized and existing under the Laws of the State of Florida, doing business as 7'i',( ,r7i v c4 -r , / e. (corporation, Partnership, or Individual as applicable) submitted on this 7d day of i , i 6 2003, to the VILLAGE OF KEY BISCAYNE (hereinafter called the "OWNER"). The undersigned, as Bidder (herein used in the masculine singular, irrespective of actual gender and number) hereby declares that he is the only person interested in this Proposal and that it is in every respect fair, and it submitted in good faith and without collusion or fraud. The bidder further declares that he has satisfied himself fully relative to all matters and conditions with respect to the work to which this Proposal pertains. The selected contractor shall submit all permit applications within 10 calendar days after receipt of the Notice to Proceed. Construction work shall commence within 10 days of the issuance of all permits. All work shall be substantially completed within 90 days from the receipt of the Notice to Proceed. The Bidder proposed and agrees, if this Proposal should be accepted, to execute all appropriate Contract Documents (including a contract in a form approved by the Village Attorney) for the purpose of establishing a formal contractual relationship between him and the Village of Key Biscayne, Florida. The Bidder, in compliance with Instructions to Bidders for the Crandon Boulevard Bus Shelter project, and having examined the drawings and specifications with related documents and the site of the proposed work, and being familiar with all of the conditions surrounding the construction of the proposed project including the availability of materials and labor, hereby proposes to fumish all labor, materials, and supplies and to construct the project in accordance with the Contract Documents, within the time set forth herein, and at the prices stated below. These prices are to cover all expenses, including permit fees, incurred in performing the work required under the contract documents, of which this proposal is a part. Permit fee information has been provided by the Project Architect. 1 The Contractor shall commence the work to be performed as described herein on the date to be specified in a written Notice to Proceed and shall fully complete all Work hereunder within 90 calendar days from receipt of the Notice to Proceed. For and after each day in excess thereof until final completion, liquidated damages may be assessed against Contractor at a rate of $200.00 per day. In the event that the progress of the Work is not maintained on schedule by the Contractor in accordance with the Schedule of Work provided by Owner or in the event the work is not completed within the time above specified, the Owner may take actions and enforce the rights granted to it by the General Conditions, Supplementary Conditions and Contract. Contractor shall apply for and accept progress payments in accordance with the Contract for Construction and General Conditions. If this Proposal is accepted, the Contractor agrees to supply Certificates of Workmen's Compensation and Liability Insurance at the time the Contract is signed. This Proposal will remain in effect and will not be withdrawn by the Contractor for a period of sixty (60) days from the scheduled dosing time of receipt of bids The Bidder agrees that Owner shall have the right to retain this bid for a period of sixty (60) days from the date of receiving bids and guarantees the amount or amounts set forth herein to be firm for the same sixty (60) day period. The Bidder acknowledges that price alone is not the sole consideration for the Village's award of the contract. By submission and execution of this Bid Form, the Bidder agrees to indemnify and hold harmless the Owner, Architect, Architect's Consultants, Agents and employees of any of them from and against claims, damages, losses, and expenses, including but not limited to attorneys fees, arising out of the Bidder's submission of his/her bid or Village's action on such bid. The Bidder acknowledges that the Architect shall be free to advise the Owner on the selection of the contractor in any manner and holds said Owner and Architect harmless for any decision arising out of any such advice. The Bidder acknowledges that the Owner, the Architect, Architect's Agents, Architects Consultant, and employees of any of them shall have no liability resulting from this bid process and that the Owner is not obligated in any way to pursue the project.
