ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REGULATING THE
REMOVAL AND DISPOSITION OF DISABLED OR ABANDONED MOTOR VEHICLES
LEFT UNATTENDED ON THE ROADWAYS OF THE CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUR
AS FOLLOWS:
Section 1. Definitions. As used in this ordinance, the following
terms shall have the meanings stated herein:
(a) Disabled Motor Vehicle - Any motor vehicle in a non-operative

condition left unattended at the same place on any roadway in this city for
a period of time in excess of 48 consecutive hours.
(b) Abandoned Motor Vehicle - Any motor vehicle left unattended at
the same place on any roadway in this city for a period of time in excess of
72 consecutive hours.
Section 2. Removal of Vehicles. Any member of the city police
department is hereby authorized to have any disabled or abandoned motor
vehicle found on the roadways of this city towed away and stored by any
service station or garage licensed to do business in this city. A report
showing the Storage location of the vehicle shall be filed by the policeman
who authorized its removal with the City Marshal who shall notify the owner,
and any holder of a security interest appearing on the title of said vehicle,
of the location of the vehicle by certified mail.
Section 3. Redemption of Vehicle. The owner of any vehicle remove
from any roadway of this city under the provisions of Section 2 of this
ordinance, or the holder of a security interest in said vehicle, which interest
Is in default, may reclaim it from the service station or garage upon proof of
ownership, or valid security interest which is in default, and full payment
�. of all charges for the towing and storage of the vehicle.

Section 4. Towing and Storage Costs. No service station or garage

towing and storing a motor vehicle under the provisions of Section 2 of this
ordinance shall charge a fee in excess of Ten ($10. 00) Dollars for towing
said vehicle and One ($1. 00) Dollar for each day the vehicle shall be stored.
Section S. Disposition of Unclaimed Vehicles. The owner of the
service station or garage towing and storing a vehicle under the provisions
of Section 2 of this ordinance may sell the vehicle at public auction if it is
unclaimed for at least ninety days after coming into his possession, after
posting public notices for at least ten days prior to said sale at his place of
business, the City Hall Building and the Cole County Courthouse. The notice
shall include a description of the vehicle, including any identifying marks
or numbers, the date and place where it was found and the time and place of
the public auction, and the accrued charges against the vehicle.
Section 6. Proceeds of Sale. The proceeds of the sale shall first
be used to pay the service station or garage all accrued towing and storage
on the vehicle, and the balance, if any, shall be paid into the general
revenue fund of the city.
Section 7. Certificate of Title. Neither the City of Jefferson,
Missouri, nor any city officer or employee, nor any member of the police
department, nor the owner of any service station or garage towing and
storing a motor vehicle under the provisions of Section 2 of this ordinance,
shall be responsible for the issuance of a Certificate of Title for any vehicle
sold under the provisions of Section 5 of this ordinance.
Section 8. Effective Date. This ordinance shall take effect and be
in force from and after its passage and approval.
