AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING FOR PUBLIC USE CERTAIN RIGHTS OF WAY FOR PUBLIC
ALLEYS, RESERVING UNTO THE CITY AN EASEMENT IN THE RIGHTS OF
WAY VACATED FOR THE MAINTENANCE, REPAIR AND RELOCATION OF ALL
PUBLIC UTILITIES AND FOR ALL SANITARY AND STRON SEWERS, AND
AUTHORIZING AND DIRECTING THE MAYOR AND CLERK OF THE CITY TO
EXECUTE ALL INSTRUMENTS REQUIRED TO CONFIRM IN THE ABUTTING
PROPERTY OWNERS THEIR REVERSIONARY RIGHTS IN THE VACATED AREAS
SUBJECT TO THE AFOREMEN'T'IONED EASEMENTS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council of the City of Jefferson,
Missouri, hereby declares that it is necessary and in the
public interest that the following land be discontinued for
public use as a right of way for public alleys, subject to
the easements hereinAfter mentioned:
The easterly 69.71 feet of the public alley
lying between Inlots Nos. 84, 85, 86, 90 and
91 in the City of Jefferson, Missouri, said
easterly 69.71 feet beginning with the southerly
extension of the easterly line of Outlot No. 86
and extending westerly 69.71 feet toward Jefferson
Street.
Section 2. It is hereby declared that the street right
of way herinabove described be, and it is hereby, vacated
and forever discontinued as a right of way for public alley
purposes subject to the provisions of the following section.
Section 3. The right if hereby reserved by the City of
Jefferson, Missouri for the Missouri Power & Light Company,
the Capital City Telephone Company, the Capital City Water
Company and the City of Jefferson, Missouri, to maintain
their existing utility facilities and sewer facilities in the
vacated area, and to repair same as necessary; provided that
the bwner of the vacated area may have said facilities removed
from said $rea upon the written request of said utility com-
panies and the City of Jefferson, Missouri, and by paying the
cost of such removal and relocation of said facilities. Upon
said removal, said companies and the City shall file for record
in the office of the Recorder of Deeds of Cole County, Missouri
a written instrument acknowledging the release of this reserved
easement hereinabove provided for.
Section 4. The statutory right of reversion in the owners
of the abutting property in said vacated right of way, as is
providedby the laws of the State of Missouri, &a hereby fully
confirmed and the Mayor and Clerk of the city are hereby
directed to execute any instrument, for and in behalf of the
city, that may be required by law to confirm in the abutting
' property owners their reversionary rights in t he right of way
hereinabove vacated.

Section 5. This ordinance shall take effect and be in
force from and after its passage and approval.
