C ee Ah ORDINANCE NO. 2,,/9 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ESTABLISHING A CITY TRANSIT AUTHORITY AND PROVIDING FOR THE MANAGEMENT AND OPERATION OF A CITY TRANSIT SYSTEM WITHIN THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Transit Authoritv. (A) Establishment. There is hereby created and established the Jefferson City Transit Authority. (B) Composition and Qualifications. The transit authority shall be composed of five resident-citizens of the city, and the Mayor of the city shall be an e�c_officio member of the authority. Of the five public members, four shall have had previous experience in the field of finance or the public transportation business. (C) Appointment and Term. The five public members of the transit authority shall be appointed by the Mayor with the approval of a majority of the elected members of the council. Initially, three members shall be appointed for a term of one year and two members for a term of two years. . Thereafter, each year, members to be appointed shall be appointed for two year terms. (D) Organization and Meeting. The Mayor shall designate one member of the transit authority as its Chairman who shall hold that position at the pleasure of the Mayor. The transit authority shall meet at least once every six months, and more often at such times and places as may be determined upon the call of the Chairman, any two of the other members of the authority, or the Mayor. %, (E) Compensation. Members of the transit authority shall serve without compensation but shall be reimbursed for any extraordinary expenses, such as those incurred by tripe from the city on transit authority business. (F) Duties. The transit authority shall act in a managerial capacity in all matters pertaining to the operation, maintenance, equipment, control and improvement of the city transit system. It shall study the needs of the city in the field of mass transportation, keeping abreast with all advancements in the field of urban transit, and utilize all available facilities and resources to develop and improve the city transit system. The authority shall establish andeulate, and change as it finds necessary or desireable, a114 outer, fares, transfer charges and practices, schedules and operating hours of the city transit system. The transit authority shall study and recommend to the Mayor and the city council the ntnnber of employees, their duties and compensation, necessary to be employed in the operation of the city transit system. The transit authority shall study and recommend to the Mayor and the city council the number and types of motor bus equipment, and the equipment thereof, to be operated in the city transit system. The transit authority shall be charge with establishing a system of savings for the replacement of all equipment and capital improvements of the city transit system. (G) Powers. The transit authority shall have power to hold publichearings to obtain the views of the public concerning all aspects of the city transit system, and to investigate and study public transit system operations of other municipalities, and to do such other things as may be incidental or reasonably necessary in the performance of its duties. Section 2. Transit Fund. There is hereby established a fund in the city treasury to be known as the Transit Fund into which shall be deposited all monies of the city that may be received from bond issues, donations, advertising payments, fares and all operations of the city transit system. Monies from said fund shall be expended only for the purpose of obtaining equipment and defraying the cost of operating, maintaining and improving the services and facilities of the city transit system. Section 3. Transit Authority Manager. (A) Establishment. The position of Transit Authority Manage is hereby created and established. 40 (B) Appointment and Term. The transit authority manager shall be 'appointed by the Mayor with the approval of a majority of the elected members of the city council. He shall continue in his position at the pleasure of a majority of the members of the Transit Authority. (C) Qualifications. The transit authority manager shall possess knowledge and have a record of practical experience in the field of urban mass transportation. He shall not have any financial interest in any commercial operation or activity connected with the city transit system other than that as Transit Authority Manager. (D) Bond. Within ten days from his appointment, the city transit manager shall give bond to the city in the amount of $5,000.00 with good and sufficient security to be approved by the Mayor conditioned that he will faithfully perform all duties of his office, and will keep account of and pay over to the city all monies belonging to the city that may come into his hands, in the manner provided by law, and that he will safely keep and preserve all books, papers, documents, records, materials and equipment belonging to the city that may come into his hands and deliver the same in good order and condition to his successor. (E) Monies Collected. The transit authority manager shall audit all monies received each day from the operation of the city transit system and enter the amount thereof in a ledger to be kept for that purpose. On each day of the week, except Saturdays, Sundays and Holidays, the transit authority manager shall deposit all monies in his hands received from the operation of the city transit system in the city depositary, and submit a duplicate deposit slip and receipt of such deposit to the city collector. (F) Du ties. The transit authority manager shall operate the city transit system, and all facilities thereof, under the direction of the transit authority. He shall have general control and supervision over all of the equipment, facilities, grounds, supplies, materials and employees of the city transit system. He shall constantly seek to improve the services, facilities and operations of the city transit system. He shall perform all duties that may be specified by the Transit Authority. o Section 4. Insurance. The Transit Authority shall obtain and maintain in effect liability insurance on all motor vehicles used in the city transit system insuring for public liability and property damage in the minimum amounts of $100,000.00 $400,000.00 -- $10,000.00 and specifying the City of Jefferson, Missouri, as the insured. Section 5. EmRloveem and EM loyment Preferences. This ordinance shall take effect and be in force from and after its passage and approval as of the 4th. day of AUaulpt , 1966.
