INTRODUCED BY COUNCILMAN . , t ORDINANCE NO. 1 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DISCONTINUING AS A RIGHT-OF-WAY FOR PUBLIC THOROUGHFARES AND VACATING ELM STREET FROM JACKSON STREET TO MARSHALL STREET AND A PORTION OF THE 20-FOOT ALLEY IN THE BLOCK BETWEEN DUNKLIN STREET AND ELM STREET AND JACKSO STREET AND MARSHALL STREET AND AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE IN WRITING ALL INSTRUD1ENTS INECESSARY OR REQUIRED TO CONFIRM IN THE OWNERS OF THE ADJACENT LAND THEIR REVERSIONARY RIGHTS IN AND TO THE VACATED AREA. WHEREAS, it has been shown to the City Council of the City ofl Jefferson, Missouri, that the owners of land abutting on Elm Street from Jackson to Marshall and a portion of the 20-foot alley in the block between Dunklin Street and Elm Street and Jackson Street and Marshall Street have petitioned the City Council to discontinue as a right-of-way for public thoroughfares and vacate the street and alley described, and WHEREAS, it has further been shown that the areas to be ' vacated are not used by the public, and that any prospective use thereof would be of no benefit to the public, and that it would not ,inconvenience the public or the citizens of this City to dis- continue as a right-of-way for public thoroughfares and vacate Elm Street and that portion of a 20-foot alley described in Section 1 of this Ordinance, NOW THEREFORE: i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: I I SECTION 1. The City Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a right-of-way for public thoroughfares and forever vacate the following-described property: Elm Street from Jackson Street to Marshall Street, and, All that part of a twenty-foot alley that is bounded on the north by Inlot 843 and on the south by Inlot 847. SECTION 2. The statutory right of reversion in the owners of the property abutting on the area vacated above, as provided. by the Taws of Missouri, is hereby expressly confirmed, and the Mayor and the Clerk of the City are hereby authorized and directed to execute in writing all instruments necessary or required to confirm in the -2- abutting property owners their reversionary rights in the land described above and hereby vacated.
