The City of Jefferson, Missouri, by and through its Project Coordinator of the Community Shelter Program in the city, is hereby authorized to execute a. written agreement with the Corps of Engineers of the .United States of America relating to the development of a community shelter plan in the city as a part of the national civil defense program. DACA43-67-C-0002 ARTICLE VIII - ENTIRE AGREEMENT It is expressly understood and agreed by the parties hereto that this contract represents their entire agreement, wholly superseding any and all prior offers, negotiations and agreements made by them, their agents and employees. ARTICLE LX IDISIPUTES A. , Except as otherwise provided in this contract, any dispute concerning a question of fact arising under this contract which is not disposed of by agreement shall be decided by the Contracting Officer, who shall reduce his decision to writing and mail or otherwise furnish a copy thereof to the Contractor. The decision of the Contracting Officer shall be final and conclusive unlese, ,within 30 days from the date of receipt of such copy, the Contractor mails or otherwise ' furnishes to the Contracting Officer a written appeal addressed to the Secretary. The decision of the Secretary or his duly authorised representative for the determination of such appeals shall be final and conclusive unless determined by a court of competent jurisdiction to have been fraudulent; or capricious, or arbitrary, or so grossly erroneous as necessarily to imply bad faith, or not supported by substantial.evidence. In connection with any appeal proceeding under this clause the Contractor shall be afforded an opportunity to be heard and to offer evidence in support of his appeal. Pending final decision of a dispute hereunder, the Contractor shall proceed diligently with the performance of the contract and in accordance with the Contracting 'Officer's decision. The objectives of the C3P include: I. Preparation of a woikable*plan, for allocating the population to the best available space providing protection against fallout in the event of nuclear attack, so that available shelter is used with maximum effectiveness. This includes a realistic movement plan that will adequately support the specific shelter allocations developed in the CSP. �. Ensuring that all of the people in the CSP area know where tc go and what to do in event of nuclear attack. 3. Defining shelter deficits, both present and future, in the CSP area, with respect to both geographical location and extent, so that efforts to develop new shelter can be applied in the deficit areas. 4. Preparation of practical plans to encourage the incorporation of shelter in new public and private buildings in shelter deficit areas, and to otherwise provide for the development of additional shelter needed. 5. Providing for periodic updating of shelter allocation plans as the population and the shelter inventory change.. 6. Providing a basis for updating local Civil Defense emergency • plans to relate them. to CSP shelter allocation plans and thereby ensure local emergency readiness based upon the most effective use of space providing protection against fallout. 1 EXHIBIT A Contract No. DACA43-67-C-0002 Article II--Scope of Services and Methods The Contractor shall adhere to the CSP process outlined in the diagram entitled "Community Shelter Planning Process, " Exhibit A-1 attached hereto and incorporated herein, in affecting . the requirements of this contract with the Government. Where necessary, the Contractor shall utilize the services of a professional traffic engineer. The Contractor will utilize fallout shelter data and other data and guidance furnished by the U. S. Army Corps of Engineers and U.S. Navy Sureau of Yards and Docks. Guidance and information shall be solicited from the Office of Civil De:fensq, the State Civil Defense agency, and the local Civil Defense agency and shall be used in the preparation of the CSP. The Contractor shall coordinate all CSP policy matters with the local. Civil Defense agency. The Contractor shall make every effort to use the guidance and information provided by the local Civil-Defense agency, Corps of kagine ers, Bureau of Yards and Docks, State Civil Defense agency, State Planning Agency, Regional Office of Civil Defense, and local officials in meeting planning requirements during the course of this Contract. The Contractor shall prepare a CSP to include those items specified in this contract under the section entitled "Reports" and generally following the methods described in the "Community Shelter Planning Process" diagram, Exhibit A-1 hereto, except as hereafter modified by amendment to this contract. Article III--General Requirements Records Detailed records shall be kept by the Contractor, insofar as possible, of all assumptions, work sheets, charts, and maps used to complete each Step. The records shall be made available to the 2 EXHIBIT A Contract No. DACA43-67-C-0002 Corps of Engineers or Bureau of Yards and Docks' Contracting Officer, or his representative, upon request. Reports of time and cost to Complete each Step shall also be provided to the Contractor. Minutes shall be kept of the meetings of CSP Policy, Technical Advisory or other Committees, and provided to the Contracting Offices. Committees The Contractor shall establish a CSP Technical Advisory Committee and a CSP Policy Advisory Committee, or a combined Advisory Committee, t6 provide cooperation between participating civil defense and planning entities; serve as an educational device for local officials and Citizens; acid provide advice and guidance for CSP policy decisions. Such Committee or Committees shalt include, in all cases possible, legislative and executive officers of local governments in the CSP area. They may also include representatives of the State Civil Defense agency wind the State planning agency; as well as local Civil Defense directors from jurisdictions within the CSP area, city planning directors from the CSP area, architects and engineers, news media representatives, military officers from installations within the CSP area, representatives of universities or colleges in the CSP area, church officials, represen- tatives, from school boards and local building departments, representatives AM of business and industry, and other members as deemed appropriate. R The Contractor- shall submit progress reports to the Corps of Engineers or Bureau of Yards and Docks (CE/BuDocks) Contracting Officer, who will accept them on behalf of the Government, upon completion of CSP Steps as specified below: Report I - Ste ' IA, Preliminary Anal sis, and Step IB Basis for CSP -(Planning Factors and Policies) The report on Steps IA and IB shall be prepared by the Contractor based on work in accordance with Exhibit A-1 and, after coordination with the local Civil Defense director and concurrence by appropriate local government officials, shall be submitted in three (3) copies to the CE/BuDocks' Contracting Officer; in addition, one (1) copy each shall be furnished to. the State Civil Defense agency and to the OCD Region (attention Regional Field Officer). 9 EXHIBIT A Contract No. DACA43-67-C-0002 The Step IA preliminary analysis shall comprise a general estimate of the total available shelters and their distribution in relation to relevant day and .night population distributions (or a combination thereof), by Standard Location, using the National Faliout Shelter Survey as a basic source. The Step IB planning factors and policies recommended for use as the basis. for further CSP work shall provide for the use, if and as necessary, of all protected space identified by shelter surveys completed in time for use in CSP Step ID, to wit, space identified by the National Fallout Shelter Survey, including updating thereof and the Expanded Survey; and by the Smaller Structures Survey. This shall include the use, if and as necessary, of space in facilities where the owner thereof has not executed a Fallout Shelter License or privi- lege form (with the exception of facilities where essential emergency .activities must be carried out in the event .of attack or where there are sensitive, classified or security areas), as well as space with a fallout protection factor (PF) 20 to 39 and space in facilities with capacity of less than 50 persons. They may also include, at local : option, use of space-per-person criteria of less than ten (10) square feet in aboveground portions of facilities identified by the National Fallout Shelter Survey or Smaller Structures Survey, pursuant to 0CD guidance on such criteria. The planning factors and policies shall also provide for the use of protected space which may be identified in single-family homes through the Evaluation of Fallout Protection in MW Homes survey, by the residents of such homes, to the extent feasible. They shall further provide that in the absence of better protection, persons who cannot be allocated to community shelter or who cannot be accommodated in shelter of known PF identified in homes, will be advised to seek shelter in the best-protected parts of their homes, and that they will be provided instructions, based on CSP Step II work, on how to improve the protection.afforded by their homes. Movement times shall be thirty (30) minutes in urban or suburban areas and sixty (60) minutes in rural areas. These movement times may be extended, at local pytion, by a reasonable amount, but such that the total movement time shall not exceed one (1) hour in Standard Metropolitan Statistical Areas (SMSAs) of over 100,000 population, two (2) hours in SMSAs of less than 1009000 population, and three (3) hours in other areas. The movement time for. populations entering larger communities from rural or smaller-town areas shall be limited to the movement time applicable to the larger community. The report on Steps IA and IB shall be in the form specified In Exhibit A-2p 1vCSP Report Form fop Report 1, Steps IA and IB.11 4 EXHIBIT A Contract No. DACA43-67-C-0002 Report__2 Step IC, General Shelter Allocation The Step IC report shall be' prepared by the Contractor based on work in accordance with Exhibit A-1 and, after coordination with the local Civil Defense director, shall be submitted in three (3) copies to the CE/BuDocksl Contracting Officer.; in addition, one (1) copy each shall be furnished to the State Civil Defense agency and to the OCD Region. This report shall include map(s) and tabulations comprising'a general allocation of population, by small areas, to creas of shelter concentration, as well as a discussion of street and *parking capacity considerations where vehicular movement is contemplated. 5 EXHIBIT A i Contract No. DACA43-67-C-0002 Report 3 - Step ID, Specific Shelter Allocation ;The Step ID report shall be prepared by the Contractor based on work in accordance with Exhibit A-1 and after coordination with the local Civil Defense director, shall be submitted in three (3) copies' to*the CE/Bu Ducks Contracting Officer; in addition, one '(1) copy each shall be :furnished to the State Civil'Defense agency and to the OCD Region. The result of Step ID work shall be a Shelter Capability Allocation Plan, based on use of the space currently available affording the best protection against fallout. This plan shall comprise an allocation of population by s.rnall area (building, block, enumeration district or other small geographical area) to specific shelters or clusters of shelters. The report shall include: 1. Maps of the specific allocation, as well as of travel routes and parking areas, which are suitable for adaptation for Informing the public. AM 2. Tabulations of the allocation, summarized by Standard Location as indicated by Exhibit A-3, "Shelter Allocation Accounting Form, " and that part of the Exhibit A-4 form which relates to Step ID data, as well as a summary for the entire CSP area, indicating sho.ltered and unsheltered populations. 3. A detailed description of the method of determining small area population and the method of allocating the population to shelter. 4. Descriptive text on the preparation of the shelter allocation plan, including the rationale for the planning factors and policies used. 5. A detailed traffic volume analysis of movement routes, with specific comments on traffic control required along the travel routes and at the terminal areas. 0 6. Discussion of operational factors considered in developing the specific allocation (e; g. , designation of shelter areas for police, fire- ands other local government forces), as.'well as designation of a protected Ar.da to Serve as a local Emergency Operating Center (EOC) where no bthetr EOC exists: 6 EXHIBIT A Contract No. DACA43-67-C-0002 Report 4 - Std II, Emergency Information Readiness The Step II report shall be prepared by the Contractor based on work in accordance with Exhibit A-1 and, after coordination with the local. CD director, shall be submitted in three (3) copies to the Cg/BuDocks' Contracting Officer,; in addition, one (1) copy each shall ba furnished to the State CD agency and to the OCD Region. This report shall include: 1. A model or facsimile of the CSP individual information package, composed of the OCD-furnished general emergency information material plus local CSP maps and information, including shelter allocations,. travel routes and parking areas as applicable. 2. A detailed plan for providing the public with general information about the CSP and its relation to the over- all civil defense program of. the community, with these activities to be carried out at the time of initial distribution of the CSP individual information package. This plan shall include but not be limited to a chrono- logical statement of the public information events (e.g., newspaper releases, television programs, radio spot announcements, etc.) planned by the local Civil Defense agency. 3. A detailed plan for the distribution of the CSP indi- vidual information package after OCD approval. This shall include a statement of the distribution method(s) to be used, including the specific measures to be taken to ensure that all new-residents receive copies of the package. W 4. A detailed plan for communicating CSP information to the public in a period of increased international tension. This shall include a description of the methods to be used in disseminating CSP maps and associated instructional materials, including detailed plans for use of local news media. The plan shall also describe how OCD-furnished emergency information materials will be used. 5. A detailed plan for marking previously unmarked shelters AOL In a period of increased international tension, using adhesive signs furnished by OCD. The plan shall detail the system for prepositioning the signs with police, fire, or other local government agencies, so that they may be posted rapidly should the need to do so arise. 7 EXHIBIT A Contract No. DACA43-67-C-0002 Report-3 - Step III, Identification of Shelter Deficits, and Step IV, Procedures for Development of Shelter The report on Steps III and IV shall be prepared by the Contractor based on work in accordance with Exhibit A-1 and, after coordination with the local Civil Defense director, shall be submitted in three (3) copies to the CE/BuDocks' Contracting Officer; in addi- tion, one (1) copy each shall be furnished to the State Civil Defense agarcy and to the ©CD Region. The report on Step III work shall include a tabulation identifying, by both number of spaces and Standard Location, present and predicted future (1970 and 1975) deficits of shelter meeting minimum criteria and within established movement times of the popu- lation. The deficit figures shall be based on the condition of maxi- mum population for each Standard, Location, whether this be resident, day, or night population. Minimum shelter criteria shall include 10 square feet of ventilated space (3 cubic feet per minute or more) or 500 cubic feet of unventilated space in facilities with capacity either over or under 50 persons and affording fallout protection factors of 40 or better. Established movement times shall be 30 minutes in urban or suburban areas and 60 minutes in rural areas. Where space of fallout protection factor of 40 or better has been Identified in single-family homes by the Evaluation of Fallout Pro- tection in Homes (EFPH) survey, such space shall be assumed to reduce the shelter deficit in the locality to the extent to which such space can be used by the occupants of homes in which it has been identified. The tabulation by Standard Location shall be reported on that part of the Exhibit A-4 11CSP Standard Information Form," which relates to Step III data; the Contractor shall also provide a summary for the CSP area. The report shall also include appropriate narrative, maps, graphs and tables to depict both the current and predicted future (1970 znd. 1975) deficit of shelter using minimum shelter criteria and movement times. The report on Step IV shall include: 1. A Packaged Ventilation Kit (PVK) plan, based on the use of PVKs, when available, to make use of ventilable space where both available and needed in the CSP area. This plan shall include tabu- lations, by Standard Location and by facility, of ventilable spaces for which PVKs are required, the tabulation by Standard Location to be reported on that part of Exhibit A-4, 1+CSP Standard Information Form," which relates to PVK data, and the tabulation by facility to be pre- pared separately. These data on PVK spaces shall also be summarized for the entire CSP area. The PVK plan shall also include the appropri- ate narrative, maps, graphs and tables which will facilitate the up- dating of the Step I Shelter Capability Allocation Plan when PVKs become available and are Installed. The standard shelter criteria include 10 square feet of ventilated or 500 cubic feet of unventilated space in facilities (capacity over or under 50) affording fallout protection factors of 40 or better. The established movement times are 30 minutes in urban or suburban areas and 60 minutes in rural areas. We will also. prepare a summary containing appropriate narrative, maps, graphs, and tables, to depict both the current and future (1970 and 1975) deficit of shelter using standard shelter criteria and established movement times. STEP IV -- Procedures for Development of Shelter Five (5) copies of a report on Steps III and IV will be prepared and, after coordination with the local civil defense agency, three (3) copies will be submitted to the Corps of Engineers, as well as one (1) copy each to the state civil defense agency and to OCD Region VI, for review and approval, The Step IV report will include a "PVK plan" based, on the use of packaged ventilation kits to make use of ventilable space both available and needed, including a listing of the facilities and the number of spaces, by facility, for which PVK's are needed. It will also include detailed local responsibilities to encourage incorporation of fallout shelter in new public and private construction, together with a proposed local ordinance on incorporation of shelter in new public buildings. The Step IV report will include a detailed assessment of deficit areas where it is not deemed feasible to make up shelter deficits by. incorporation of shelter in new con- struction, together with a detailed description of local action pro- posed to solve or attempt to solve such deficits. it 'will include detailed plans and procedures for periodically up-dating the Step I shelter capability allocation plan, utilizing appropriate local agencies. STEP V -- Directive(a) for Updating Local CD Emergency Plans Five (5) copies of a report on Step V will be prepared and, after coordination with the local civil defense agency, three (3) copies will be submitted to the Corps of Engineers, as well as one (1) copy each to the state civil defense agency and to OCD Region VI, for review and EXHIBIT A-6 Contract No. DACA43-67-C-0002 August 29, 1966 Page -4- approval. This report will include copies of planning directives for updating the local civil defense emergency plans of all jurisdictions in the CSP area which maintain or are required to maintain such plans, to base them on the Step I shelter capability allocation plan. STEP VI -- Official Adoption or Approval of CSP All necessary action required to insure local consideration of Steps I through V will be taken, with the aim of securing local action required by state statute or local ordinance officially to adopt or approve all preceding steps of the CSP. This action will include pre- paration of a draft final report. After coordination with the local civil defense agency, three (3) copies will be submitted to the Corps of Engineers, as well as one (1) copy each to the state civil defense agency and to OCD Region VI, for review and approval. We will edit and revise the final report in accordance with comments and recommenda- tions made by the Corps of Engineers contracting officer. Twenty (20) copies of the final report will be prepared and, after coordination with the local civil. defense agency, ten (10) copies will be submitted to the Corps of Engineers, as well as five (5) copies each to the state civil defense agency and to OCD Region VI. Throughout the CSP work, detailed records will be kept, insofar as possible, of all assumptions, worksheets, charts, and maps used to complete each phase. These records will be made available to the Corps of Engineers, and to state civil defense and OCD Region VI representa- tives, upon request. CSC? reporting forms as. prescribed in Federal CD Guide, Part D, Chapter 3, Appendix 1, will be used for all reports. Late delivery of NFSS/SSS data will result in later completion of work on Steps 1D through VI, by an equal amount of time, but not in any in- crease in cost.
