AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROVIDING FOR AN ELECTION IN SAID CITY TO SUBMIT TO THE QUALIFIED VOTERS OF THE CITY A PROPOSITION TO EXTEND THE PRESENT CORPORATE LIMITS OF THE CITY TO INCLUDE AN UNINCORPORATED AREA OF LAND CONTIGUOUS TO A PART OF THE PRESENT CORPORATE LIMITS OF THE CITY. WHEREAS, the City Council of the City of Jefferson, Missouri, did adopt a resolution on October 4, 1965 to annex an unincorporated area of land contig- uous to a part of the present corporate limits of the city, said unincorporated area of land being describ-.ed as follows: "Beginning at a point in Section 27, Township 45, Range 12, at the intersection of the northerly right-of-way line of the Missouri ' Pacific Railroad and the extension northerly of a line that is 525.27 feet westerly of and parallel to the easterly line of Section 34, Township 45, Range 12;:thence southerly along a line that is 525.27 feet west of and parallel to the easterly line of Section 34, Township 45, Range 12, to a point that is 365 feet northerly of the southerly line of the northeast quarter of Section 34, Township 45, Range 12; thence westerly 365 feet north of and parallel to the southerly line of the north half of Section 34, Township 45, Range 12, to the westerly line of said Section 34, Township 45, Range 12; thence southerly along the westerly line of said Section 34, to the southwest corner thereof on the Township line; thence westerly along the Township line to the northeast corner of Fractional Sec- tion 4, Township 44, Range 12; thence southerly along the easterly line of said Fractional Section 4 to the northeast corner of Section _ . 9, Township 44, Range 12; thence westerly to the northwest corner of the east half of the north,.-,rest quarter of the northeast quarter of Section 9, Township 44, Range 12; thence southerly along the east line of the west half of the west half of the northeast quarter of Section 9, Township 44, Range 12, to the southerly line of the northeast quarter of Section 9, Township 44, Range 12; thence easterly along the quarter section line of Sections 9, 10 and 11, Township 44, Range 12, to the southeast corner of the southwest quarter of the northwest quarter of Section 11, Township 44,'Range 12; thence north along the quarter quarter section lines of Section 11 and Fractional Section 2 to the Township line dividing Townships 44 and 45; thence westerly to the southwest corner of the southeast quarter of the southeast quarter of Section 34, Township 45, Range 12; thence north along said quarter quarter section line, 990 feet; thence east parallel to the Township line to the east line of the southwest quarter of the southwest quarter of Section 35, Township 45, Range 12; thence north to the northwest corner of the northeast quarter of the southwest quarter of Section 35, Township 45, Range 12; thence east along the said quarter section line to the northerly right-of-way line of the Missouri Pacific Railroad; thence north- westerly along the northerly right-of-way line of the Missouri Pacific Railroad to the point of beginning, all in Cole County, Missouri. " and WHEREAS, the City of Jefferson, Missouri did cause to be filed in the Circuit Court of Cole County, Missouri, in Docket Number 22,078, a suit for a declaratory judgment authorizing the annexation by the City of the unincorpor- ated area of land described above, and WHEREAS, on the 15th day of October, 1966, the Circuit Court of Cole County, Missouri, did Enter its judgment in said suit authorizing the annexation Into the City of the unincorporated area of land described above upon the consent of a majority of the qualified voters of the City voting at an election to be held for such purpose in said city, the aforementioned judgment having heretofore become final, and WHEREAS, the Mayor and City Council of the City of Jefferson, Missouri, with the consent of a majority of the legal voters of said city voting at an election to be held for such purpose in said City, by the passage and approval of a city ordinance, have power to extend the limits of the City over territory contiguous thereto, and WHEREAS, the Mayor and the City Council of said City of Jefferson, Missouri, believe that an election of the people of said city should be held to determine if a majority of the qualified voters thereof are in favor of extending the limits of the City to include the unincorporated area of land hereinabove described, now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. That at the general city election to be held in the City of Jefferson, County of Cole, Missouri, on Tuesday, the 4th day of April, 1967, the following proposition shall be submitted to the qualified voters of said city, ,:to-wit: -2- PROPOSITION That the present city limits of the City of Jefferson, Cole County, Missouri, shall be extended to include the following described unincorporated area of land now contiguous to a part of the present corporate limits of the City: "Beginning at a point in Section 27, Township 45, Range 12, at the intersection of the northerly right-of-way line of the Missouri Pacific Railroad and the extension northerly of a line that is 525. 27 feet westerly of and parallel to the easterly line of Sec- tion 34, Township 45, Range 12; thence southerly along a line that is 525. 27 feet west of and parallel to the easterly line of Section 34, Township 45, Range 12, to a point that is 365 feet northerly of the southerly line of the northeast quarter of Section 34, Township 45, Range 12; thence westerly 365 feet north of and parallel to the southerly line of the north half of Section 34, Township 45, Range 12, to the westerly line of said Section 34, Township 45, Range 12; thence southerly along the westerly line of said Section 34, to the southwest corner thereof on the Town- ship line; thence westerly along the Township line to the northeast corner of Fractional Section 4, Township 44, Range 12; thence southerly along the easterly line of said Fractional Section 4 to the northeast corner of Section 9, Township 44, Range 12; thence westerly to the northwest corner of the east half of the northwest quarter of the northeast quarter of Section 9, Township 44, Range 12; thence southerly along the east line of the west half of the west half of the northeast quarter of Section 9, Township 44, Range 12, to the southerly line of the northeast quarter of Section 9, Township 44, Range 12; thence easterly along the quarter section line of Sections 9, 10 and 11, Township 44, Range 12, to the southeast corner of the southwest quarter of the northwest quarter of Section 11, Township 44, Range 12; thence north along the quarter quarter section lines of Section 11 and Fractional Sec- tion 2 to the Township line dividing Townships 44 and 45; thence westerly to the southwest corner of the southeast quarter of the southeast quarter of Section 34, Township 45, Range 12; thence north along said quarter quarter section line, 990 feet; thence east parallel to the Township line to the east line of the southwest Aft quarter of the southwest quarter of Section 35, Township 45, Range 12; thence north to the northwest corner of the northeast quarter of the southwest quarter of Section 35, Township 45, Range 12; thence east along the said quarter section line to the northerly right-of-way line of the Missouri Pacific Railroad; thence north- westerly along the northerly right-of-way line of the Missouri Pacific Railroad to the point of beginning, all in Cole County, Missouri. " Section 2. That the said election shall be held in all the wards and pre- cincts of said city and at the same poling places designated for the election of city officials. Polls of said election shall be open at the hour of six A.M. , and continue open until the hour of seven P.M. , on said date. Said election shall be held and conducted and the results thereof shall be certified, canvassed, and % declared in all respects in conformity with the Constitution and Laws of the State -3- s i= t r: r of Missouri governing elections in said City of Jefferson and in accordance with the ordinances of said city. Section 3. That the City Clerk be and she is hereby authorized and directed to give notice of said election by publication in the Jefferson City Post- Tribune, a daily newspaper printed and published in the City of Jefferson and of general circulation therein. Said notice shall be published in said newspaper once a week for four consecutive weeks, and on the same day in each week. The first publication of said notice shall be made at least twenty-one (21) days before the date of said election and the last publication shall be made within ten days of the date of said election. " The election will be held at the same voting places in each ward of the city as for the election of city officials. The polls at said election shall be open at the hour of six o'clock A. M. and will continue open until the hour of seven o'clock P. M. on said date. All persons who are legal voters in said city will be entitled to vote at said election. Given under my hand and corporate seal of the City of Jefferson, Missouri, this day of March, 1967. City Clerk Section 4. The City Clerk is hereby authorized and directed to furnish the judges and clerks of said election with all poll books, tally sheets, ballots, ballot boxes and all other materials and supplies necessary and required for the conduct of said elections, and the ballot to be so provided shall be printed in substantially the following form: -5- OFFICIAL BALLOT EXTENSION OF CITY LIMITS CITY OF JEFFERSON COLE COUNTY, MISSOURI TUESDAY, APRIL 4, 1967 PROPOSITION That the present city limits of the City of Jefferson, Cole County, Missouri shall be extended to include the following described unincorporated area of land now contiguous to a part of the present corporate limits of the city.
