INTRODUCED BY COUNCILMEN: ���������� ��.�� ° I"} �,•' /,�e e I I�n�sbr-�re1+erar°- `R ,fir , �� ;Vsv+lso v ORDINANCE NO. j`10 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI REPEALING ORDINANCE NUMBER 7352 OF THE CITY DEFINING THE BOUNDARIES OF THE CITY AND ENACTING A NEW ORDINANCE PERTAINING TO THE SAME SUBJECT WHEREAS, the City Council of the City of Jefferson, Missouri did adopt a resolution on October 4, 1965, to annex an unincorporated area of land contig- uous to a part of the present corporate limits of the city, said unincorporated area of land being described as follows: "Beginning at a point in Section 27, Township 45, Range 12, .at .the intersection of the northerly right-of-way line of the Missouri Pacific Railroad and the extension northerly of a line that is 525.27 feet westerly of and parallel to the easterly line of Section 34, Township 45, Range 12; thence southerly along a line that is 525.27 feet west of and parallel to the easterly line of Section 34, Township 45, Mange 12, to a point that is 365 feet northerly of the southerly line of the north- east quarter of Section 34, Township 45, Range 12, thence westerly 365 feet north of and parallel to the southerly line of the north half of Section 34, Township 45, Range 12,. to the westerly line of said Section 34, Township 45, Range 12;. thence southerly along the westerly line of said Section 34, to the southwest corner thereof on the Township line; thence westerly along the Township line to the northeast corner of Fractional Section 4, Township 44, Range 12; thence southerly along the easterly line of said Fractional Section 4 to the northeast corner of Section 9, Township 44, Range 12; thence westerly to the northwest corner of the east half of the northwest quarter of the northeast quarter of Section 9, Township 44,.Range 12; thence southerly along the east line of the west half of the west half of the northeast quarter of Section 9, Township 44, Range 12,. to the southerly line of the northeast quarter of Section 9, Township 44, Range 12; thence easterly along the quarter section line of Sections 9, 10 and 11, Township 44, Range 12,. to the southeast corner of .the Southwest quarter of the northwest quarter of Section.11, Township 44, Range 12;. thence north along .the quarter quarter section lines of Section 11 and Fractional Section 2 to the Township line dividing Town- ships 44 and 45; thence westerly- to the southwest corner of the southeast quarter of the southeast quarter of Section 34, Town- ship 45, Range 12; thence north along said quarter quarter sec- tion line, 990 feet; thence east parallel to the Township line to the east line of the southwest quarter of the southwest quarter .of Section 35, Township 45, Range 12; thence north to the northwest corner of the northeast quarter of the southwest quarter of Section 35, Township 45, Range 12; thence east along the said quarter section line to the northerly right-of-way line of the Missouri Pacific Railroad; thence northwesterly along the northerly right-of-way line of the Missouri Pacific Railroad to the point of beginning, all in Cole County, Missouri." and WHEREAS, the City of Jefferson, Missouri did cause to be filed in the Circuit Court of Cole County, Missouri, in Docked: Nimiber 22,078, a suit for a declaratory judgment authorizing the annexation by the City of the unincorporated area of land described above, and ` fr WHEREAS, on the 15th day of October, 1966, the Circuit Court of Cole County, Missouri, did enter its judgment in said suit authorizing the annexation into the City of the unincorporated area of land described above upon the consent of a majority of the qualified voters of the City voting at an election to be held for such purpose in said city, the aforementioned judgment having heretofore be- come final, and WHEREAS,the Mayor and City Council of the City of Jefferson, Missouri, with the consent of a majority of th!y legal voters of said city voting at an elec- tion to be held for such purpose in said City, by the passage and approval of a city ordinance, have power to extend the limits of the City over territory con- tiguous thereto, and WHEREAS, thereafter by Ordinance Number 7887 of the City of Jefferson, Missouri, passed by. the Council on March 6, 1967 and approved by the Mayor of owl said City on March 7, 1967, it was provided that at the general municipal elec- tion of city officers to be held on Tuesday, April 4, 1967, there would be sub- mitted to the qualified voters of the city the following proposition: P R O P O S I T I O N That the present city limits of the City of Jefferson, Cole County, Missouri, shall be extended to include the following described unincorporated area of land now contiguous to a part of the prevent corporate limits of the City: "Beginning at a point in Section 27, Township 45, Range 12, at the intersection of the northerly right-of-way line of the Missouri Pacific Railroad and the extension northerly of a line that is 525.27 .feet westerly of and parallel to the easterly line of Section 34, Township 45, Range 12; thence southerly along a line that is 525.27 feet west of and parallel to the easterly line of Section 34, Township 45, Range 12, to a point that is 365 .feet northerly of the southerly line of the north- east quarter of Section 34, Township 45, Range 12; thence westerly 365 feet north of and parallel to the southerly line of the north half of Section 34, Township 45, Range 12, to the westerly line .of said Section 34, Township 45, Range 12; thence southerly along the westerly line of said Section 34, to the southwest corner thereof on the Township line; thence westerly along the Township line to the northeast corner of Fractional Section 4, Township 44, Range 12; thence southerly along the easterly line of said Fractional Section 4 to the northeast corner of Section 9, Township 44, Range 12; thence westerly to the northwest corner of the east half of the northwest quarter of the northeast quarter of Section 9, Township 44, Range 12;. thence southerly along the east line of the west half of the west half of the northeast quarter of Section 9, Township 44, Range 12, to the southerly line of the northeast quarter of Section 9, Township 44, Range 12; thence easterly along the quarter section line of Sections 9, 10 and 11, Township 44, Range 12, to the southeast corner of the southwest quarter of the northwest quarter of Section 11, Township 44, Range 12; - thence north along the quarter quarter section lines of Section 11 and Fractional Section 2 to the Township line dividing Town- ships 44 and 45; thence westerly to the southwest corner of the -2- southeast quarter of the southeast quarter of Section 34, Township 45, Range 12; thence north along said quarter quarter section line, 990 feet; thence east parallel to the Township line to the east line of the southwest quarter of the south- west quarter of Section 35, Township 45, Range 12; thence north to the northwest corner of the northeast quarter of the southwest quarter of Section 35, Township 45, Range 12; thence east along the said quarter section line to the northerly right-of-way line of the Missouri Pacific Railroad; thence northwesterly along the northerly right-of-way line of the Missouri Pacific Railroad to the point of beginning, all in Cole County, Missouri." WHEREAS, at said general municipal election for city officers held in the City of Jefferson, Missouri, on Tuesday, April 4, 1967, said proposition was submitted to the legal qualified voters of the city, and WHEREAS, due and legal notice was given, as required by law, for the holding of an election on Tuesday, April 4, 1967, for the purpose of submitting said proposition, stating that all legal and qualified voters of the City of Jefferson, Missouri would .be entitled and have an opportunity to vote on said proposition, and WHEREAS, under the provisions of Section 77.020. R.S.Mo. , the Mayor and the City Council of the City of Jefferson, Missouri, with the consent of a majority of the legal voters of such city voting at an election thereof, have power to extend the limits of the city over territory adjacent thereto, and .WHEREAS, a special committee of the City Council of the City of Jefferson, Missouri, after canvassing the votes cast at said election of April 4, 1967, did .report on April 18, 1967 to the Mayor and City Council of said City that of the votes cast.by .the qualified voters of the City on the proposition hereinabove written that 4,113 .votes were cast for and 763 votes were cast against said pro- position, and WHEREAS, said proposition received more than a majority of the votes cast on said proposition at the aforementioned election. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Ordinance Number 7352 of the City of Jefferson, Missouri, defining and declaring the boundaries of the city be, and the same is hereby, repealed. Section 2. That the limits and boundaries of the City of Jefferson, j Missouri, are extended, defined and declared to be as follows in the County of Cole, State of Missouri, to-wit: -3- a. • "Beginning on the northerly extension of the north and south quarter section line of Section 16, Township 44, Range ll, .in the center of the Missouri River; thence south along said northerly extension of said quarter section line and the quarter section line of Section 16, Township 44, Range 11, to a point that is 300 feet south of the southerly right-of-way line of Highway No. 50 Business Route (formerly, U. S. Highways Nos. 50 and 63); thence in a westerly direction 300 ,feet from and parallel to the southerly right-of-way line of said highway to the east line of the northwest quarter of the southwest quarter of Section 16, Township 44, Range 11; thence south to the southeast corner of the northwest quarter of the northwest quarter of Fractional Sec- tion-21, Township 44, Range 11; thence east to the northeast corner of the southeast quarter of the northwest quarter of Frac- tional Section 21, Township 44, Range 11; thence south to the southeast corner of the southeast .quarter of the northwest quarter, Fractional Section 21, Township 44, Range 11, thence west to the southwest corner of the southwest quarter of the northwest quarter of Fractional Section 21, Township 44, Range 11; thence south 660 feet, more or less, along the section line to the south line of Outlot 112 and the north line of Fractional Section 20, Township 44, Range 11; thence west along the north line of Fractional. Section 20 to the east line of the northwest quarter .of the southwest quarter of Fractional Section 20, Town- ship 44, Range 11; thence south to the northeast corner of the northwest .quarter of the northwest quarter of Section 29, Town- ship 44, Range 11; thence continuing south along the east line of the northwest quarter of the northwest quarter of said sec- tion, 660 feet; thence -west parallel to the north line of said Section 29. to the west line thereof; thence north along the east line of Section 30 and Fractional Section 19 to the north line of Fractional Section 19, Township 44, Mange 11, and the south line of .Outlot 109; thence west along the north line of Fractional Section 19 and Outlot lines to a point that is 1557.6 feet east of the Range Line dividing Ranges 11 and 12; thence south 4 degrees and 24 minutes east, 1007 feet to the southeast corner of Hough Park;thence south 85 degrees and 21 minutes .west; .1580.O feet to the southwest corner of Hough Park on the Range Line; thence north along the Range Line 1250 feet, more or less, to the southeast corner of the northeast quarter of Section 24, Township 44, Range 12; thence west to the south- west corner of the northeast quarter of Section 24, Township 44, Range 12; thence north along the easterly line of the northwest quarter of said Section 24 to the point of intersec- tion with the southerly right-of-way line of Ellis Boulevard at Station 18+86, per plat of record in Plat Book 6, Pages 50, 51, 52 and 53, Cole County Recorder's Office; thence westerly along the southerly right-of-day line of said Ellis Boulevard, to Station 15+46, per said plat; thence southerly 350 feet from and parallel.to .the westerly line of a tract of land deeded to the Holiday Inns Corp. as per deeds of record in Book 165, page 3O5.and Book 148, Page 620, to the south line of the north half of the northwest quarter of Section 24, Township 44, Range 12; thence west along t;aid quarter quarter section line, 69.06 feet; thence south 39 degrees and 7 minutes. west, 688.95 feet; thence north 50 degrees and 53 minutes west, 300 feet to the westerly line of a tract of land conveyed to F. Joe UeLong and Elmer Goldammer, partners, as per deed of record in Book 174, Page 73, Cole County Recorder's Office., said line also being the easterly right- of-way line of U. S. Highway No. 54 (Project No. FAT-349-H(1), dated June 14, 1941); thence northerly along said easterly right- of-way of U. S. Highway No. 54 (Project No. FAT-349-H(l), dated June 14, 1941) to the point of intersection with the west line of the southeast quarter of Section 13, Township 44, Range 12; thence north to the center of Section 13, Township 44, Range 12; thence west to a point on the northerly line of the southwest quarter of Section 13, Township 44, Range 12, said point being 652.74 feet easterly of the northwest corner of the northeast quarter, of the southwest quarter of Section 13, Township 44, Range 12; thence south 15 degrees and 45 minutes east, 492.36;'feet; -4- thence south 46 degrees east, 179.52 feet; thence south 39 degrees east, 722.04 feet; thence north 49 degrees 30 minutes east, 5.28 feet to the westerly line of County Road C (formerly, U. S.
