AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CLERK OF THE CITY TO EXECUTE IN BEHALF OF THE CITY AN
AGREEMENT WITH THE CONSULTING ENGINEERING FIRM OF BURGWIN, MARTIN
AND ASSOCIATES, P.A. , KANSAS CITY, MISSOURI, RELATING TO DESCRIBED
PROFESSIONAL SERVICES TO BE FURNISHED BY BURGWIN, MARTIN AND
ASSOCIATES, P.A. , TO THE CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk of the City are hereby
authorized and directed, in behalf of the City of Jefferson,
Missouri, to execute an agreement with the Consulting Engineering
firm of Burgwin, Martin and Associates, P.A. , Kansas City, Missouri,
for an engineering service contract for traffic engineering
services.
SECTION 2. The agreement shall read in words and figures
as follows: (SEE ATTACHED AGREEMENT)
SECTION 3. This ordinance shall take effect and be in force
from and after its passage and approval.

ENGINEERING SERVICE CONTRACT
SPECIAL SERVICES
AGREEMENT made as of 1967 between the City of
Jefferson City, Missouri (herein ter called the "City") and Burgwin, Martin
and Associates, P.A. , Consulting Engineers, 3718 Broadway, Kansas City,
Missouri (hereinafter called the "Engineer").
WHEREAS, the City is in need of engineering assistance on a continuing
basis to aid in solving traffic problems; and
WHEREAS, the Engineer represents that they have sufficient experienced
and qualified personnel to perform, and the City desires the Engineer to perform
the traffic engineering services herein described,
NOW, THEREFORE, in consideration of the mutual undertakings herein
contained, the parties agree as follows:
ARTICLE I
GENERAL
The Engineer shall render diligently and competently the engineering ser-
vices described in the SCHEDULE (hereinafter called the "Schedule"), attached
hereto and by this reference made a part of this Agreement, upon the terms and
conditions herein stated.
ARTICLE II
COMPENSATION
The City shall pay the Engineer for the services performed pursuant to this
Agreement at the times and in the amounts provided in the Schedule. The Engineer
shall submit a statement at the end of each month of all compensation due hereon-
der to the City. Unless otherwise specified, the City shall pay the Engineer within
ten (10) days after approval of such statement and after approval by the City of any
required designs, drawings, and reports.

MISCELLANEOUS
Section 1. LICENSE. The Engineer shall comply with all applicable statutes per-
taining to engineering.

SCHEDULE
® I. SERVICES: The Engineer will prepare engineering plans and reports as
directed by the City. The scope of work will generally be limited to traffic
engineering, highway planning, and transportation-planning problems. The
Engineer may, as directed by the City, represent the City at public hear-
ings and other meetings. The City should provide forty-eight hour notice of
such meetings'.
It is agreed, without limiting the generality of the foregoing, that all draw-
ings, designs, specifications, and other incidental engineering work or
materials, furnished by the Engineer hereunder shall be and remain the
property of the City.
All services to be rendered hereunder shall be subject to the direction and
approval of the City.
The city shall pay the Engineer for on-site inspection in the city and to attend
meetings, such as City Council and P.T.A. , etc. , at the daily rate of One
Hundred Twenty-five ($125.00) Dollars.
For collection of field data, engineering analysis, and preparation of plans,
the following schedule will apply:
TITLE HOURLY RATE
Principal Engineer $ 16.30
Traffic Engineer 10.80
Draftsmen and Cartographers 5.75
Secretarial 6.00
Field and Clerical personnel 4.50
Expenses and materials will be charged at actual cost to the Engineer plus
ten (10) per cent. Mileage will be charged at the rate of'$0.10 per mile.
Equipment charge will be made for use of traffic recording equipment �s follows:
Recording Traffic Counters @ $5.00 per 24-hour period
Junior Traffic Counters @ $1.00 per 24-hour period
(a) The Engineer warrants that he possesses License No. E-2100 issued to him
by the State of Missouri on the 1st day of January, 1944.
Section 2. TERM. This Agreement shall become effective as of the date thereof
and shall rem aui in effect until either party desires to terminate same. Termination
may be effected by either party giving thirty (30) days notice in writing to the other
of its intention to terminate. Upon such termination the City shall pay the Engineer
for such services as may have been performed prior to such termination.
Section 3. RETURN OF DATA. The Engineer shall immediately upon expiration
or termination of the Agreement return to the City all of the engineering studies, maps,
and other data furnished to the Engineer by the City pursuant to this Agreement.
Section 4. INSURANCE. The Engineer shall take out and maintain workmen's com-
pensation insurance covering all employees of the Engineer who shall perform any of
the obliga�ions of the Engineer hereunder, whether or not such insurance is required
by the laws of the State governing the employment of any such employee. If any employee
is not subject to the workmen's compensation laws of such State, such insurance shall
extend to such employee voluntary coverage to the same extent as though such employee
were subject to such laws. The policy of insurance shall be in such form and issued by
such insurer as shall be satisfactory to the City.
Section 5. QUALIFIED PERSONNEL. The obligations and duties to be performed by
the Engineer under this Agreement shall be performed by persons qualified to perform
such duties efficiently. The Engineer, if the City shall so direct, shall replace any
engineer or other person employed by the Engineer in connection with the work.
Section G. ASSIGNMENT. The obligations of the Engineer under this Agreement shall
not be assigned without the approval in writing of the City.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be duly
executed.
