T&a AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR OF SAID CITY TO EKECUTE ON •BEHALF OF THE CITY AN ELECTRIC SERVICE CONTRACT WITH THE MISSOURI POWER AND LIGHT .COMPANY. BE IT ORDAINED BY THE CITY -COUNCIL OF -THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and the Clerk of the city of Jefferson, Missouri, are hereby authorized and directed to execute for and on behalf of said city an electric service contract with the Missouri Power and Light Company. Section 2.. Said electric service contract shall read in words and figures as follows: IMP • Form 151-3 ELECTRIC SERVICE CONTRACT This contract, made and entered into this _..�day of 1967 , by and between Missouri Power & Light Company, a Missouri corporation, "Utility", and City of Jefferson City; Miugpurl Q ,. "Customer". 40 WITNESSETH: 1. Utility shall supply and Customer shall accept and pay for all electrical energy required for the operation of Customer's various municipal operations at the rate of two cents ( 2s,% ) per kilowatt hour. 2. Utility shall supply to Customer, during the term of this contract, approxi- mately 1479 kya of electrical ( A` gac3 r;,._c l-gl a and rhrec, .- s at 480 and 120/240 volts. 3. Utility shall use reasonable diligence in furnishing a regular and uninter- rupted service; and in case such service should be interrupted and fail by an act of God or public enemy, fire, explosion, strike, insurrection, mob violence, governmental interference, breakdown or injury to machinery or distributing lines, extraordinary repairs or other accident or causes not reasonably within its control, Utility shall not be liable in damages for any such interruption of service; and such interruption shall not constitute a breach of this contract on the part of the Utility. 4. Should Customer be prevented from taking service herein agreed upon by reason of fire, explosion, flood, mob violence, insurrection, governmental interference, 4 1— rike or accident, rendering necessary complete cessation of Customer's operation for period in excess of thirty (30) days, this agreement shall. be suspended temporarily until such time as operation can be resumed. In the event of such temporary discon- tinuance of service, this contract shall be extended for a period equal to the term of suspension. 5. The term of this contract shall be one (1) year from the date service begins hereunder and thereafter for periods of one (Q—Year unless terminated by the giving of ninety (90) days written notice by either party prior to the expiration__ of the original term or succeeding period. 6. The benefits of this contract shall inure to the successors and assigns of the parties hereto for the term of the contract.
