HomeMy Public PortalAboutORD07970 AMENDED BILL NO. ao INTRODUCED BY COUNCILMAN Cal. r AM I ORDINANCE NO. 2177a AN ORDINANCE REPEALING ORDINANCE NO. 7014 OF THE CITY OF JEFFERSON, MISSOURI, CREATING THE OFFICE OF ELECTRICAL INSPECTOR, PROVIDING FOR THE APPOINTMENT, TERM OF OFFICE, QUALIFICATIONS, BOND, POWERS AND DUTIES THEREOF, THE ISSUANCE OF LICENSES TO ELECTRICIANS, EXAMINATIONS THEREOF, CREATING A BOARD OF ELECTRICAL EXAMINERS, REGULATING ALL ELECTRICAL WORK AND THE INSPECTION OF THE INSTALLATION AND MAINTENANCE IN BUILDINGS OF ELECTRICAL DEVICES, PROVIDING FEES TO BE CHARGED, AND PROVIDING A PENALTY FOR VIOLATIONS, AND ENACTING A NEW ORDINANCE PERTAINING TO THE SAME SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. Ordinance No. 7014 of the City of Jefferson, Missouri, creating the office of Electrical Inspector, providing for the appointment, term of office, qualifications, bond, powers and duties thereof, the issuance of license to electricians, examinations thereof, creating a Board of Electrical Examiners, regulating all electrical work and the inspection of the installa- tion and maintenance in buildings of electrical devices, providing fees to be charged, and providing a penalty for violations be, and the same is hereby repealed. SECTION 2. Definitions. Whenever any of the following words or phrases are used in 'this ordinance, they shall have the following mean- ing: 2. 1 Electrical Contractor. An Electrical Contractor is one who has been issued a license of competence by the Board of Electrical Examiners as provided under this ordinance, and who makes.an agreement with another to do any kind of electrical work, retaining in,himself control of the means, method and manner of producing the results to be accomplished. 2. 2 journeyman Electrician. A Journeyman Electrician is one S who has qualifications as set out under this ordinance and who 1 -2- has been issued a license of competence by the Board of Electrical Examiners as provided under this ordinance. j 2.3 Helper. A Helper is any person who holds a certificate issued by the Electrical Inspector to help, assist and aid an Electrical Contractor or a Journeyman Electrician in doing electrical work as defined in this ordinance. 2.4 Electrical Work. Any work connected with the construc- tion, installation, alteration, operation, removal or repair of electric wires, cables, fixtures, switchboards or other article or apparatus used to transmit electrical current. 2. 5 Commercial Building Any structure of any kind where any commodity is traded, exchanged, sold, purchased, stored or dealt with in connection with the operation of any retail, wholesale, jobber or distributing business or any building within which members of the public generally are invited for professional, commercial, industrial or business purposes. SECTION 3. Electrical Inspector. The Office of Electrical Inspector is created. SECTION 4. Appointment. The electrical inspector shall be appointed by the Mayor with the consent of a majority of the members of the City Council. He shall be appointed for a term of two (2) years or until his successor is duly appointed and qualified. He shall be appointed on or before the second regular meeting of the City Council after the general city elections in the year 19 61 and every two (2) years thereafter. In the event of his death, resignation or removal from office, the Mayor, with the consent of a majority of the members of the Council, may make an interim appoint- ment of a qualified person to serve the balance of the two (2) year term. SECTION 5. Qualifications and Bond. The electrical. inspector shall be over the age of twenty-one years, and he shall be a competent electrician of good moral character. He shall have had at least six (6) years experience as a journeyman in his trade, or, have two (2) years -S- training in a recognized college of electrical engineering, and in addition thereto, shall have had at least four (4) years of practical experience in electrical construction. He shall be well versed in approved methods of electrical construction for safety to life and property and the latest yearly addition of the National Electric Code. He shall give a bond in the sum of On :thousand ($1, 000. 00) Dollars conditioned upon the faithful per- formance of his duties. SECTION 6. Board of Electrical Examiners. A Board of Electrical Examiners is hereby created. The Board shall consist of the Electrical Inspector, the Chairman of the Public Utilities Committee of the City Council, a representative of the local Power and Light Company, and an electrical contractor and a journeyman electrician. The last three men- tioned members of the Board shall be appointed by the Mayor with the consent of a majority of the members of the City Council, for a term of two (2) years and they shall serve until their successors are duly appointed and shall have qualified. The appointments to the Board of Electrical Examiners shall be made on or before the second regular meeting of the City Council after the general city elections in the year 1961 and every two years thereafter. SECTION 7. Powers and Duties of Board. The Board of Electrical Examiners shall have the power to give examinations to applicants for a Journeyman Electrician's li c en s e. They shall have the power to suspend or revoke the license of a Journeyman Electrician. The Board shall review any, action or decision of the Electrical Inspector when a petition for review is filed with the Board by an aggrieved party within five (5) days from the time said action is taken or decision is made. The Board of Electrical Examiners may suspend or revoke the license of any Journeyman Electrician when charges are preferred against them by the Electrical Inspector, and the Board finds that the person charged is incompetent or has willfully violated the provisions of this ordinance. Before any action is taken by the Board, the person charged shall be given at least ten (10) days notice of the time and place of a 9 -4- formal hearing on said charges and the person charged shall be apprised of the nature of the charges preferred against him. The person charged shall be given the opportunity to appear, in person or with an attorney of his choice, in order that he may be heard, and he shall have the bur- den of showing cause why his said license should not be suspended or. revoked. The Board shall render its decision within five (S) days. The decision shall be final. No appeal shall be allowed therefrom. The de- cision of the Board may permit the person charged to continue his trade and act as a dismissal of said charges, or the Board may suspend the license of the person charged for such period as to the Board seems proper under all of the facts and circumstances, or the Board may permanently revoke the license of the person charged. SECTION 8. Examinations for Journeyman Electricians. Applica- tions for examinations for a journeyman Electrician's license shall be made in writing to the electrical inspector and by him be referred to the Board of Electrical Examiners. The application shall state the name of the applicant, his business residence and telephone number, the number of years of experience, and the type of license desired. Each application for an examination or re-examination shall be accompanied by a fee of $5. 00. Upon receipt of the written application requesting an examination for a journeyman Electrician's license, the Board shall, within twenty (20) days, give to the applicant an examination at a place and time to be desig- nated by the Board of which the applicant shall be notified. The examination shall be in two parts: 1. A test of the knowledge of the theory of the trade. 2. A test of skill in the practice of the trade. The examination shall be of a basic and elementary character but sufficiently strict to test the qualifications of the applicant. The Board shall grade said examinations and notify each applicant of the grade he made within ten (10) days of the taking of the same and issue the appropriate license concurrently therewith. The grade shall be -5- computed as follows: Each part of the examination shall have a maximum grade of one hundred (100%) per cent. The grades on both parts of the examination shall be added and then divided by two. A minimum grade of severity (70%) per cent shall be necessary to pass said examination. Any person failing to pass said examination may apply for and be given a re-examination after the expiration of one hundred and eighty (180) days, under the conditions and requirements applying to an original examination. SECTION 9. Qualifications of Examinees. Any person seeking to take an examination to secure a journeyman Electrician's license shall have worked at the electrical trade for at least four (4) years or have two (2) years of schooling from a recognized college of electrical engineer- ing and in addition thereto, two (2) years of experience working at the electrical trade and he shall also be at least twenty (20) years of age. SECTION 10. Electrical Inspector, Powers, and Duties. The Electrical Inspector shall have the powers and duties hereinafter stated: 10. 1 Permits. He shall issue permits for the per formance of electrical work. Applications for such permits, describing the work to be done, shall be made by the person, firm or corporation to perform said on such .forms as may be prescribed or approved by the Electrical Inspector. 10. 2 Inspections. The inspector shall have the right, during all reasonable hours, to enter any building in the discharge of his official duties, or, for the purpose of, making an inspection, or to test new installations of electrical wiring, devices or materials contained therein. 10. 3 Disconnection. The Electrical Inspector shall have the authority to cause the turning off of all electrical current, and he may cut or disconnect, in cases of emergency, any wires where such electrical current is dangerous to life or property or where said wires may interfere with the work of the fire department. A • e -6- 10. 4 Certificates of Inspection and Approval. Upon the completion of the installation of the wiring and/or electrical equipment, for which a permit is required, it shall be the duty of the person, firm or corporation installing the same to notify the electrical inspector who shall inspect the installation within twenty-.four (24) hours of the time such notice is given; and if it is found to be fully in compliance with this ordinance and does not constitute a hazard to life and property, then upon the payment of the proper fees as hereinafter designated, the electrical In- spector shall issue to such person, firm or corporation for delivery to the owner of the premises a Certificate of Inspection and Approval that authorizes connection to the electrical service and turning on the current. All wires which are to be hidden from view shall be inspected before concealment, and any person, firm or corporation installing such wires will notify the electrical inspector, allowing him twenty-four (24) hours in which to make the required inspection, before such wires are concealed. 10. 5 Commercial Buildings, Chance of Occupancy, Procedure. The Electrical Inspector shall make a thorough in- spection or re-inspection of the installation in any commercial building, where a change of occupancy takes place, of all the electrical wiring, devices, and/or materials and issue a Certi- ficate of Inspection and Approval to the new occupant(s) author- izing connection to the electrical service and turning on of the current. When the installation of any such wiring, devices, and/or materials is found to be in an unsafe or dangerous condi- tion, the person, firm or corporation, using or operating the same shall be notified and shall make the necessary repairs or changes required to place such wiring, devices and/or materials In a safe condition and they shall have such work completed within fifteen (15) days or any longer period that may be prescribed in the notice of the Electrical Inspector. The inspector is hereby MMM -7- empowered to disconnect or order the discontinuance of electrical service to such wiring, devices and/or materials until the in- stallation of such wiring, devices and/or materials has been made safe as directed by the electrical inspector. 10. 6 Records. The Electrical Inspector shall keep complete records of all permits issued and inspections made and other official work performed under the terms of this ordinance. 10.7 Helper's Certificates. The Electrical Inspector shall issue a helper's certificate to each person making written application therefor upon payment of a fee of $1.00. 10.8 Fees. The Electrical Inspector shall collect such .�. fees for licenses, certificates and inspections as may be pre- scribed by this ordinance. SECTION 11. Electrical Work, .Performance of. It shall be un- lawful for any person, firm or corporation to perform any electrical work to light, heat, or supply power to any building, artifice, structure or premise within the corporate limits of this city without first having secured a journeyman Electrician's license in effect at the time performance of said work is undertaken, except as follows: (1) one helper may be permitted to aid and assist a journeyman Electrician while working on any single job when said helper is working under the supervision of a journeyman Electrician in the performance of electrical work, and any electrical contractor per- sonally performing elp-ctrical work shall be a Licensed journeyman Electrician and shall not work a helper unless employing a journeyman Electrician, (2) any non-residential electrical contractor may be authorized to perform electrical work in this city, without first securing an Electrical Contractor's license from the Board of Electrical Examiners, for such temporary period of time as may be necessary to perform and complete the electrical work on any single and particular job by paying the electrical inspector a fee in J the amount of not less than twenty-five ($25 .00) dollars nor more than seventy-five ($75. 00) dollars as shall be determined by the Electrical Inspector after considering the work to be done and the time necessary to do such work if said non-residential electrical contractor has a cur- rently effective Electrical Contractor's license issued by the City, County or State licensing board or agency of his residence. SECTION 12. Electrical Sign Contractor's License. An Electrical Sign Contractor's License shall authorize the grantee to engage in the business of contracting for the fabrication, installation, repair, alteration and/or making additions to electrical signs, and to make electrical con- nections or disconnections thereto within five 5 feet of the work authorized to -be installed. Any electrical sign contractor personally performing elec- trical sign work shall be a licensed sign wireman. An Electrical Sign Contractor shall be subject to the same pro- visions and regulations as required for the Electricai Contractor as estab- lished in this ordinance. SECTION 13. Permits. No alterations or additions shall be made in the existing wiring of any building, nor shall any building be wired for the placing of electric lights, motors, heating devices, or any apparatus requiring the use of electrical current nor shall any alterations be made q g , in the wiring of any building after inspection, without first notifying the electrical inspector and securing a permit therefor from said inspector, except minor repair work such as repairing flush and snap switches, re- placing fuses, changing lamp sockets and receptacles, taping bare joints and repairing drop cords. SECTION 14. Standards of Work. No Certificate of Inspection and Approval shall be issued unless the electric light, power and heating installations are in strict conformity with the provisions of this ordinance, and unless they are in conformity with the most approved,methods of con- struction for safety to life and property and upon the payment of the proper fees as hereinafter designated. The regulations as 161d down in the t,__ latest annual edition of the National Electrical Code shall apply to in- stallations made under the provisions of this ordinance. SECTION 15. Disapproval of Work, Procedure. When the Elec- trical Inspector shall condemn all or part of any electrical installation, the owner thereof may, within five (5) days after receipt of written notice thereof, from the inspector, file a petition in writing for a review of said action with the Board of Electrical Examiners of Jefferson City, upon re- ceipt of which and after giving notice to all of the interested parties, the Board shall proceed to determine at a hearing, at which all interested parties may be present in person and with an attorney, if the said electrical installation does comply with the provisions of this ordinance. The Board shall render its decision in writing within three (3) days. Said decision shall be final and unappealable. When the action or decision of the Electrical Inspector is being reviewed, the Inspector shall have no vote on the Board, and in the event the remaining four members of the Board are evenly divided on the issue before them, the decision of the Inspector shall be deemed affirmed. SECTION 16. Licenses and Certificates, Cost and Renewal_. 16. 1 Upon the original issuance of a license to an electrical contractor by the Board of Electrical Examiners, the licensee shall pay a license fee of seventy-five ($75.00) dollars and said license shall be renewed during January of the follow- ing year, and in each succeeding yuear, upon payment of a fee of seventy-five ($75.00) dollars to the Electrical Inspector without any further examination, except as hereinafter provided. 16.2 The Board of Electrical Examiners may grant reciprocal certificates to a duly licensed electrician of another city of the State of Missouri on the same terms and under the same conditions as such other city will grant re- ciprocal licenses 'to a duly certificated electrician of the ,z -10- City of Jefferson, Missouri; provided the applicant has been licensed by a city having adopted an electrical code and electrical examination equivalent to the electrical code and electrical examination of the City of Jefferson, Missouri. 16.3 The Board of Electrical Examiners shall issue a Journeyman Electrician's license to the applicant after he suc- cessfully passes the examination as required in Section 6 and the necessary payment of five ($5.00) dollars is paid to the Electrical Inspector. Said license shall be a permanent license subject only to the provisions of Section 7. SECTION 17. Fees for Inspections . The City of Jefferson shall receive the following fees for inspections made by the Electrical Inspector: Service Connectors: ,r . Service connectors of any size $5.00 Circuits: One Circuit $1.00 Each additional circuit .50 Electric Fixtures: One to Ten Fixtures $1.00 ea. Each Unit of ten fixtures or less, per Unit .50 Motor Generator: All size Generators $1. 00 Motors All horse power $1. 00 Furnaces 1.00 Air Conditioner, 2 tons and over 5. 00 Electric Signs 1. 00 Each Transformer in Sign 1. 00 A. -11- All fees required by this ordinance shall be made payable to the City Collector and assigned to the General Revenue fund of the City. SECTION 18. Penalty Clause. Any person, firm or corporation who shall violate any of the terms of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed one hundred ($100.00) dollars or ninety days imprisonment in jail, or both such fine and imprisonment.
