AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , .AUTHORIZING THE
MAYOR AND CLERK TO EXECUTE AN ELECTRIC LINE EASEMENT IN FAVOR OF
THE MISSOURI POWER AND LIGHT COMPANY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk of the City are hereby
authorized, for and in behalf of the City of Jefferson, Missouri,
to execute a written electric line easement in favor of the
..,,.. Missouri Power and Light Company as grantee.
SECTION 2. Said electric line easement shall read in words
and figures as follows:

I Gra ... herein, dn4'.li. hereby grant, convey and warrant unto the MISSOURI POWER & LIGHT COMPANY, Grantee herein, its suc-
ecssors,assigns and lessees, the perpetual right and casement to erect,reconstruct,operate and maintain under varying conditions of operations,
renew and remove, an electric transmission and distribution line, the poles,anchors, stubs, brace poles,guys, crossarms, insulators, conductors,
ground wires,cables and other equipment appurtenant thereto,for the transmission and distribution of electric energy in,on,over,upon,through
and across certain lands owned by Grantor......, situated In........9.919...........................................County,State of Missouri,and described as follows$
Part of fractional Section 2, Township 44, Range 12, Cole County, Missouri, more particularly
described as follows: From the Southwest corner of said Section 2; thence North 86 degrees,
28 minutes East, along the section line, 2626.41 feet to the Southwesterly corner of a tract
of land conveyed to J.M. Wilson and Opal B. Wilson, his wife, by deed of record in Book 108,
page 535 Cole County Recorder's Office, and the point of beginning for this description;
thence North 4 degrees minutes West, along the Westerly line of said Wilson tract, 1352.85
feet; thence South 5i es, 52 minutes East, 712.75 feet; thence South 68 degrees, 53 minutes
East 992.31 feet to a on the West line of a tract of land decreed by the Circuit Court
to be in the name of Louis Brunner by instrument of record in 'Book 113, page 293, Cole County
Recorder's Office; thence South 2 degrees, 58 minutes East, along the West line of said
Brunner tract, 491.60 feet to the North line of U.S. Route 50; thence Westerly on a curve to
the left, having a radius of 3,014.93 feet, a distance of 582.42 feet, to the section line;
thence South 86 degrees, 28 minutes West, along the s e ction line, 876.69 feet to the point
of beginning, containing in all, 28.81 acres, more or less. Bearings are magnetic.

together with the right of ingress to and egress from such lands over lands of Grantor...... for the purpose of patrolling said line,or repairing or
renewing the same,and for doing anything necessary for the enjoyment of the casement herein granted and to trim or fell such trees, branches,
shrul-'-fry, bushes and remove such other obstacles as may interfere with the safe,proper and expeditious erection, operation and maintenance,
unt trying conditions of operation,renewal and removal of said line, or any part thereof,without further payment therefor except as herein-
after ..ed. The center line of the right-of-way casement herein granted shall be established by the longitudinal center of said electric line
upon :tial erection;upon any reconstruction, renewal, replacement or substitution of said electric line, in whole or in part, the locations of
poles may be changed,but as nearly as practicable such poles or structures shall be located over and upon said center line of the electric line as
theretofore constructed or erected.
Any damages to crops and fences of the Grantor...... caused by the erection, reconstruction, operation and maintenance under varying con.
ditions of operation,renewal and removal of said line,if the repair thereof or the amount thereof be mutually agreed upon, such amount shall be
immediately paid by Grantee, but if not mutually agreed upon,shall be ascertained by three disinterested persons,one of whom shall be selected
by Grantor....... one by Grantee, their heirs,successors,administrators. assigns or lessees,anti the third by the two so selected,and the amount
of damages determined by such persons,or a majority of them shall be conclusive and binding upon the parties hereto,their heirs,administrators,
successors,assigns and lessees,and Grantee shall thereupon pay the amount so determined. i
This instrument is executed and accepted with the express understanding that the Grantee herein is not bound to do or perform any act,
or pay any consideration except as herein expressly provided,
Subject to the foregoing this grant shall be binding upon the heye,successors,administrators and assigns of the undersigned.
