INTRODUCED BY COUNCILMAN: ORDINANCE NO.� �i AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AMENDING ORDINANCE NO. 5880 OF THE CITY, KNOWN AS THE 1953 REVISED ZONING ORDINANCE OF THE CITY OF JEFFERSON BY REPEALING ALL OF ARTICLE III, AS CONTAINED IN SECTIONS 301-305 OF SAID ORDINANCE, RELATING TO THE DISTRICTS AND BOUNDARIES OF THE VARIOUS ZONING DISTRICTS WITHIN THE CITY, AND ENACTING NEW PROVISIONS TO BE KNOWN AS SECTIONS 301-305 OF ARTICLE III OF ORDINANCE NO. 5880 RELATING TO THE SAME SUBJECT. Whereas, the District Map of the City of Jefferson, Missouri, in- corporated by reference into Ordinance No. 5880 of the city, cited as the 1953 Revised Zoning Ordinance of the City of Jefferson, has been amended from time to time over the years to reflect the rezoning of various parcels and tracts of land within the city as the limits of the city existed prior to January 1, 1968, and Whereas, the corporate limits of the city were extended on January 1, 1.968 to include two additional areas of land, and Whereas, The Planning and Zoning Commission of the City, after public hearings, has recommended to the City Council that the zoning districts to be established in the two areas annexed into the city on January 1, 1968, be as shown on the maps of said areas attached to said recommendations, and Whereas, the City of Jefferson, Missouri, through its clerk, has caused a notice of a public hearing to be held by the City Council on the afore- mentioned recommendations of the Planning and Zoning Commission to be pub- lished for three consecutive days in the Jefferson City Post Tribune, a news- paper of general circulation published within the city, the last date of publication occurring more than fifteen days prior to the date of the hearing fixed in said notice, wherein all persons interested in the premises were invited to appear at the time and place of said hearing and be heard upon the recommendations of said Commission, and Whereas, the City Council, on this 2nd day of January, 1968, has con- ducted a public hearing at the time and place specified in the notice thereof and has heard all persons who desired to express themselves on the recom- mendations of the Planning and Zoning Commission, and Whereas, the City Council finds and believes that there is a present need for the adoption of a new up-to-date District Map showing all changes in zoning of the various tracts and parcels of land in the city, as the limits b of the city existed prior to January 1, 1968, and further showing and defining the boundaries of the various zoning districts in the two areas annexed into the city as of January 10 1968, now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article Ill. being Sections 301-305, of Ordinance No. 5880 of said city, known as the 1953 Revised Zoning Ordinance of the City of Jefferson, Missouri, establishing various zoning districts within the city and defining the boundaries thereof on a District Map incorporated by refer- ence into Ordinance No. 5880 be, and the same is hereby, repealed. Section 2. There are hereby enacted five new provisions, to be known as Sections 301-'305 of Article III of Ordinance No. 5880, establishing zoning districts within the city and defining the boundaries thereof which shall read in words and figures as follows: " ARTICLE III DISTRICTS AND BOUNDARIES THEREOF Section 301. In order to regulate and restrict the height, number of stories, and size of buildings and other structures, the percentage of lot that may be occupied, the size of the yards, courts, and other open spaces, the density of population, and the location and use of buildings, structures, and land for trade, industry, residence, or other purposes, the City of Jefferson, Missouri, is hereby divided into districts, of which there shall be twelve (12) in number, known as: "AA" Single-Family Dwelling District "A-1" Single-Family Dwelling District "A-2" Single-Family Dwelling District "B" Two-Family Dwelling District "C" Multiple Dwelling District "D" Multiple Dwelling District "E" Local Commercial District "F" Highway Commercial District "G" Commercial District "H" Business District "I" Light Industrial District "J" Heavy Industrial District . Section 302. The boundaries of the districts are shown upon the map which is .attached hereto and made a part of this ordinance, which map is designated as the "District Map". The district map and all the notations, references and other information shown thereon are a part of this ordinance and have the same force and effect as if the district map and all the notations, references and other information shown thereon were all fully set forth or de- described herein. Section 303. Whenever any street,alley, or other public way is vacated by official action of. the City Council of the City of Jefferson, the zoning district adjoining each side of such street, alley, or public way shall be auto- matically extended to the center of such vacation, and all area included in the vacation shall then and henceforth be subject to all appropriate regulations of the extended districts. Section 304. All territory which may hereafter come within the city limits by virtue of annexations to the City of Jefferson shall be immediately placed and continued in the "AA" Single-Family Dwelling District until other- wise changed by ordinance. 2 Section 305. Except as hereinafter provided: 1. No building shall be erected, converted, enlarged, reconstructed or structurally altered, nor shall any building or land be used except for a purpose permitted in the district in which the building or land is located. 2. No building shall be erected, converted, enlarged, reconstructed or structurally altered, to exceed the height limit or the floor area limit herein established for the district in which the building is located. 3. No building shall be erected, converted, enlarged, reconstructed or structurally altered except in conformity with the area and parking regulations of the district in which the building is located. 4. '.Phe minimum yards and other open spaces, including lot area per family, required by this ordinance for each and every building existing at the time of passage of this ordinance or for any building hereafter erected shall not be encroached upon or con- sidered as yard or open space requirements for any other building, nor shall any loft area be reduced beyond the district require- ments of this ordinance. 5. Every building hereafter erected or structurally altered shall be located on a lot as herein defined and in no case shall there be , more than. one (1) main building on one (1) lot except as other- wise provided. herein in Articles XVII and XVIII. No new lot may be created by a subdivision of a previously existing lot in such a manner that -the new lot has its sole frontage on an alley." Section 3.
