Ells, City Clerk #6117 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AM THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, TO EXECUTE AND ENTER INTO AN AGREEMENT OF LEASE WITH THE CENTRAL MISSOURI TRUST COMPANY OF JEFFERSON CITY, MISSOURI, FOR A SPECIFICALLY DESCRIBED TRACT OF LAND WITHIN THE CITY OF JEFFERSON, MISSOURI. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, ' MISSOURI, AS FOLLOWS: Section 1. The Mayor and the City Clerk of the City of Jefferson, Missouri, for and on behalf of the City, are hereby authorized and directed to enter into and execute the following ( Agreement of Lease with the Central Missouri Trust Company of Jefferson City, Missouri. AGREEMENT OF LEASE THIS AGREEMENT OF LEASE, made and entered into this 1st day of' July, 1955, by and between the City of Jefferson, Missouri, a municipal corporation, organized and existing under the laws of the State of Missouri that relate to cities of the third class, Party of the First Part, hereinafter referred to as the Lessor, and the Central Missouri Trust Company, a corporation organizea and existing under the laws of the State of Missouri,, of Jefferson City., Cole County, Missouri, Party of the Second Part, hereinafter referred to as the Lessee : WITNESSETH: 1. The Lessor does hereby lease and demise unto the Lessee the following described premises: "Beginning on the easterly line of Fulkerson Street 315.0 feet northerly of the northerly line of Main Street; thence westerly parallel with Main Street, 80.0 feet, to the westerly line of Fulkerson Street; thence northerly along and with the westerly line of Fulkerson Street, 100.0 feet, more or less, to the southerly line of the Missouri Pacific Railroad property; thence easterly along and with the southerly line of the said railroad property, 80.0 feet, to the easterly line of Fulkerson Street; thence southerly 100.0 feet, more or less, to the point of beginning." 181 2 . To Have and To Hold for a term from the 1st day of �j July, 1955, until the 30 day of June, 1956, provided that either of the parties to this lease may give to the other sixty j (60) days notice in writing before the last mentioned date to terminate this lease; otherwise this lease shall continue in force for another term of one year, and in the -same manner from year to year until one of the parties shall terminate this ; lease by notice in writing in some ensuing year in the manner I� , aforementioned, which said notice shall terminate this lease at ; the end of the year for which the premises are then held. Notice hereunder may be given to the Lessor or the Lessee per- sonally or by registered mail at the address of the Lessor (City I Hall of Jefferson City, Missouri ) or of the Lessee (Central { Trust Building, Jefferson,City, Missouri ) . 3 . The rental for said premises shall be Fifty ($50.00) Ilper year, payable in advance, the rental for the first year to e paid upon execution of this lease, and the rental for sub- sequent years to be paid upon the first day of each additional yearly term. �i 4. This lease shall not be assigned nor sub-let without the written consent of the Lessor. i 5. In addition to the provisions of this lease for the termination of the same, the Lessor shall have the right to terminate this lease at any time while said lease is in effect by giving to the Lessee thirty (30) days notice in writing of its intention to do so; provided that in the event the Lessor terminates this lease under this provision it shall refund to the Lessee the unused portion of the yearly rental for the term then in effect. Ellis, to me personally known, who, upon being shorn, upon his oath, did state that he is the Mayor of Jefferson City, that he executed the foregoing instrument by authority of its iCity Council, and that the peal affixed to said instrument was attached thereto by authority of the City Council, and that he executed said instrument as the free act and deed of said City.
