Ordinances Numbered 3260 and 3864 of the City of Jefferson, Missouri, regulating the area in which junk yards may be established, then defining the term "junk dealer", prohibiting the issuance of a license for a junk yard within a designated area, . and providing a penalty, be and the same are hereby repealed. Section 2. Junk yardso Prohibited within cit After the passage and approva o this ordinance, it s ereby declared un- lawful for any person, firm, copartnership, association or corpora- tion to establish and maintain a junk yard as herein defined within the city limits of the City of Jefferson. Section 3 . Junk vard defined. A junk yard as herein defined shall be construed to mean as ppiace of business where scrap iron, rags, papers, scrap metal, automobiles or automobile bodies are gathered, purchased or stored for the purpose of resale to persons or firms dealing in the purchasing what is commonly known as junk. Section 4. License not to issue. No license shall be issued by the city clerk of t e city col or which shall authorize the operation and maintenance of a junk yard within the city limits; provided that, any person, firm copartnership, association or corporation presently maintaining and operating a junk yard within the city may be relicensed during such time as they ,hall continue to conduct their business at their present location; provided further that no license issue to any person, firm, copartnership, association or co,pporation presently maintaining and operating a junk yard within this city shall be assigned or transferred. Section 5 . Penalty. Any person, firm copartnership, associa- tion or corporation vi lacing the terms of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine of not less than one ($1.00) dollar nor more than one hundred ($100.00) dollars, or by imprisonment in the count jail for not more than three months, or by both such fine and im- prisonment, and each separate day that such junk yard shall be maintained and operated within this city shall constitute a separat offense.
