OF THE CITY OF JEFFERSON MISSOURI WHICH RELATED TO THE CUTTING OF WEEDS BY THE OWNERS OF PROPERTY WITHIN THIS CITY, AND PROVIDED A PENALTY, AND ENACTING AN ORDINANCE PERTAINING TO THE SAME SUBJECT MATTER, DEFINING THE TERM "WEEDS" AND "THE OWNER OF REAL PROPERTY" , PROVIDING FOR NOTICE TO THE OWNERS OF PROPERTY TO CUT WEEDS, DECLARING IT UNLAWFUL AND A MISDEMEANOR FOR THE OWNERS OF REAL PROPERTY TO PERMIT SAID WEEDS TO EXIST AT A HEIGHT IN EXCESS OF ONE FOOT, AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Ordinance Number 4364 of the City of Jefferson, Missouri, relating to the cutting of weeds by the owners of real i estate within this city, and providing a penalty for the i violation thereof, be and the same is hereby repealed. Section 2. Definitions. When used in this ordinance the following terms or phrases shall have the following meanings: (a) "Weeds" . The word "weeds" shall be construed to mean all rank vegetable growth and which exhale unp;easant and noxious odors or all high and rank vegetable growth that may conceal deposits of filth, trash or junk. (b) "Owners of Property". The phrase "owners of property" shall include any person, firm, co- partnership, association, corporation, having j legal title to any real estate within this city, I or in the case of joint tenancy, tenancy in common9 r or tenancy by the entirety, all persons having title thereby to real estate within this city, and any lessee of any real property within this city. Section 3 . Notice. Upon complaint of any person within this city that any owner of property has allowed or permitted to exist any weeds of a height in excess of one foot on any real estate within this city, the said owner of property upon which said I weeds are maintained or permitted to exist shall be given notice l in writing to cut said weeds within five days from receipt of said I notice. Said notice shall be served by the city marshall, or any f policeman that he shall designate, by personal service on said owner of property or by leaving a copy of said notice at the i residence of the said owner of property with any member of the household exceeding the age of fifteen years. �I Section 4. Weeds to be cut. It shall be unlawful for any I owner of property within this city, or the agent of any such owner, to permit weeds to exist in excess of a height of one foot after a period of ( 5) days has elapsed from the time of i service of the notice provided for in the preceding section, and any owner of property who shall violate tiie provisions of this section shall be deemed guilty of a misdemeanor, and each day that said violation shall continue shall constitute and be deemed a separate offense. Section 5 • Police Power. This ordinance is enacted pursuant to the general police power of this city and is deemed expedient for maintaining the peace, safety, health and welfare of the citizens of this city. 1 I II
