AN ORDINANCE TO APPROPRIATE MONEY FOR THE MONTH OF OCTOBER* 1955
BE IT .ORDAINED BY THE COUNCIL OF THE CITY OF' JEFFERSON, AS FOLLOWS:
SECTION 1. There is hereby appropriated out of any money in the

AN ORDINANCE REPEALING ORDINANCE N'MBER 6011 OF THE CITY OF JEFFER- I
SON, MISSOURI, CREATING THE OFFICE OF HEALTH OFFICER, PRESCRIBING
HIS APPOINTMENT, QUALIFICATIONS, DUTIES, PWOERS AND PROVIDING FOR
THE ISSUANCE OF PERMITS, INSPECTION, GRADING, PLACARDING, AND SUS-
PENSION AND REVOCATION OF 2ERMITS, TO THE OP'-RATORS OF RESTAURANTS
AND ITINERANT RESTAURANTS, AND ESTABLISHING ITEMS OF SANITATION TO I

Section 1. Ordinanne Number 6011 of the City of Jefferson,

viding for the issuance of permits to and the Inspection, grading,
placarding oftr and the suspension and revocatijn of the permits
issued to the operators of restaurants or itinerant restaurants,
1 and establishing items of sanitation to be complied with, and
I Providing a penalty, be and the same is hereby repealed.
Section 2. Health Officer. The Office of Health Officer is
created.
Section 3. Appointment. the Health Officer shall be appoin 4
ed by the Mayor with a consent of a Trajority of the members of the
city counrlil. He shall serve for a period of two years or until
his successor is duly appointed and shall have qualified. He shall
be appointed on or before the second regular meeting of the City
council after the general election in the year 1955 and every two
years thereafter. In the event of his death,, resignation or re.-
movla from office, the Mayor, with the consent of a majority of thell
members of the city council, may make an interim appointment of a
qualified person to serve the balance of said two year term. i�
Section 4. Qualifications. The Health Officer shall be at
least twenty one years of age. He shall have such other qualll'18a-ll
tions as may be established be the Board of Health. He shall, give
a bond in the amount of One Thousand ($1,000.00) Dollars conditione
upon the faithful performance of his duties.
Section 5* Duties. The Health Officer shall enforce the
provisions of this ordinance. He shall perform such other duties a6
delegated to him by ordinance, the Mayor, the City Council or the
Board of Health.
Section 6. Powers. He shall have the right during all
reasonable hours to enter any restaurant or itinerant restaurant asl�
4ereinafter defined, in the discharge of his official duties,, or,
for the purpose of making an inspection. He shall have all powers
Inecessary to enable him to carry out the orders of the Mayor, City
Council or Board of Health and to enforce the provisions of any
ordinance delegating duties to him. He shall have the aid, if
necessary, of the City Marshall, the police department and the Cityj
Attorney In the enforcement of the provisions of this ordinanca.
Section 7. Definitions. The following definitions shall app
to the interpretation and enforcement of this ordinance.
A. Restaurants-, The term restaurants shall mean restaurantg'
coffee shop, cafeteria, short order cafe, luncheonette,
tavern, sandwich stand, soda fountain, bakeries, and all
other eating or drinking establishments, as well as kitchens
or other places, where foor or drink is Prepared for
sale elsewhere,
B. Itinerant Rebtuarants. The term itinerant restuarant
shall mean one operating for a temporary jeriod in
connection with a fair, carnival, circus, picnic,
public exhibition, or other similar gathering.
C. employee. The term employee shall mean any person who
handles food or drink during preparation or serving,, or i
who comes in contact with any cooking or eating utinsels
or who is employed in a room in which food or drink is
prepared or served.
D. Utinselse Theterm utinsels shall include any kitchen-
ware, glassware, cutlery, , utensils,, c .-ntainers or other
equipment with* which food or drink comes in contact
during storage, preparation or serving.
E. Health Officer. The term Health Officer shall mean thd
Health Officer of the Cit y of Jefferson or his aut;-orizadji
representative.
F. Person. Theterm person shall mean any person, firm,,
association or corporation.

II Section 8. Permits. It shall be unlawful for any person to
operate a restaurant in this city shl does not possess a oermit jars
from the Health Officer. Such permit shall be issued for a term ' of
twelve months and shell be posted in a conspicious place in the
restuurant. Permits shall be i !suable on the lst of January of
each year and shall not be transferable.
A person conducting an itinerant restaurant shall be re-
quired to secure a permit. Such permit shall be issued by the
Health Officer for a temporary period of time. i
Section 8. Permit to be displayed. Every restaurant and
itinerant restaurants shall dispaly at all times a permit approviod
by the Health Officer containing thereon the grade of the estab-i
lishment.
Section 10. Food Sampling; condemnation, removal, or des-1
truction unwholesome food. Samples of food, drink and other
substances may be taken and examined by the Health Officer as
often as may be necessary for the detection of unwholesomness or
adulteration. The Health Officer may condemn and forbid the sal
of, or cause to be removed or destroyed, any food or drink which is
unwholesome or adulterated.
Section 11. Inspection of restaurants. At least once ilry
six months, and more frequently if the Health Officer deems nee-,j
essary, the Health Officer shall insect very restaurant within
this citq. In the event the 11ealth fficer discovers the viclat on
of any item of sanitation required for the grade then held, be j
shall make a second inspection after the lapse of such time as h
deems necessary for the defect to be rerr.ied, but not later than
ten days after the first inspection. The second inspection shall be
used in determining compliance with the grade requirements of t' is
ordinance. "ny violation of the same items of sanitation of this
ordinance on such sec-nd inspection shall call for immediate de- �
grading or susl)ension of permit.

Onee:copy of the inspection report shall be posted by the j
Health Officer upon an inside wall of the restaurant and said
inspection report shall not be defaced or removed by any person
except the Health Officer. Anoth$r copy of the inspection report
shall be filed with the Health D partment.

The person operating the restaurant shall upon the request
of the Health Officer permit access to all parts of the esteblis -
ment and shall permit copying any or all records of food purchased.
Section 12. Itinerant restaurants which may operate.
Itinerant restaurants shall meet and conform to the Fiar Regula-'
tions of the Livision of Health of the State of Missouri with
respect to items of sanitation. A copy of the Fair Regulations h s
been examined and approved by the Council and shall be on file
in the"office of the city clerk. The Health Officer shall deb-e-r
mine compliance with the Fair Regulations of the Division of
Health before issuing a permit to operate an itinerant restaurant.
After said permit is issued, the failure of the itinerant restau
rant to comply with the Fair Regulations shall. require the Hellth
Officer to suspend said permit for such time as he deems necessary
for the establishment to correct defective items of sanitation.
Section 13. Sanitation$ standards and requirements. The lIll
grading of all restaurants shall be based upon the following I'
standards:
Sanitation requirements for Grade "A" restaurants: All 11
l Grade A restaurants shall comply with the following items of �)
sanitation:
Item 1. Floors. The floors of all rooms in which food )
or drink is stored, prepared or served, or in which i
utensils are washed shall be of such construction as shall
be easily cleaned, shall be kept smooth and in good repaid.
Item 2. Walls and 6eilings. Wells and ceilings of all roor' a

of rooms in which food or drink is stored or prepared I'
! shall be finished in light color. The walls of all
rooms in which food or drink is prepared or utensils
are w6ehed shall have a smooth washable surface up to
the level reached by splash or spray.

Item 3. Doors and Windows. When flies are prevailent,
all openings into the outer air shall be effectively !i
screened, and doors shall be self-closing, unless othe i
ji effective means are provided to prevent the entrance of
II flies. 1
i Item 4. Lighting. All rooms in which food or drink is
{ stored or prepared or served or in which utensils are
l washed shall be well lighted.
Item 5. Ventilation. All rooms in which food or drink
li is stores, prepared or served or in which utensils are j
�i washed shall be well ventilated.
i Item. 6. Toilet facilities. Every restaurant shall be j
provided with adequate and conveniently located toilet
facilities for its employees that conform to the i
i ordinances of the City of Jefferson. In restaurants
hereafter constructed toilet rooms shall not open dir-
ectly into any room in which food, drink or utensils
are handled or stored. The doors of all toilets rooms
shall be self-closing. Toilet rooms shall be kept in a
clean condition, in good repair and well lighted and
ventilated. handwashing signs shall be posted in each
toilet room used by employees. In case privies or
earth closets are permitted or used, they shall be
separate from the restaurant building and shall be of
a sanitary type, constructed and operated in conformity

with the standards of the Board of health. ;
Item.7. Water Supply. Running water under pressure
shall be easily acessable to all rooms in which food
is prepared or utensils are washed, and the water sup-
! ply shall be adequate, and of a safe, sanitary quality.

Item B. Lavatory facilities. Adequate and convenient
handwashing facilities shall be provided,including hot
and cold running water, soap, and approved sanitary tow-
els. The use of a common towel is prohibited. No em-
i ployeeLshall resume work after using the toilet without
first washing his hands.
Item 9. Construxtion of utensils and equipment. All multi-
use utensils and all show- and dispaay cases or windows,
counters, shelves, ta')les, refrigerating equipment, sinks
and other equipment or utensils used in connection with i
the operation of a restaurant shall be so constructed as to
be easily cleaned and shall be kept in good order and re-
pair. Utensils containing or plated with cadium or lead
shall not be used, provided that, solder containing lead
may be used for joining.
iIItem 10. Cleaning and bactericidal treatment of utensils
i and equipment. All equipment, including display or win-
dows, counters, shelves, tables, refrigerators, stoves,
hoods and sinks shall be kept clean and free fro dust,
dirt, insects and other contaminating material. Ingle
service containers shall be used only once.
All multi-use eating and drinking utensils shall be thor-
oughly cleaned and effectively subjected to an approved bacter-
icidal process after each usage. All multi-use utensils used in I.
the preparation or serving of food or drink shall be thourogh-
lu cleaned and effectively subjected �o an approved bbactericidal
process immedialtey following the day s operation. Lr.ying cloths, i
I� if used, shall be clean and shall be used for no ptherspurpose.
�! No article or polish or other substanne containing any j
cyanide preparation or other yvisbning matarii&#---shall be used ��

for the cleaning or polishing of utensils.
Item 11. Storage and handling of utensils and equipment.
After bactericidal treatment, utensils shall be stored in a clean, )
i dry place protected from flies, dust and other contamination, and shall
be handled in Stich a manner so as to prevent contamination as for is
practicable. Single service utensils shall be purchseed only in s4n-
itary eontal.nersI shall be stored in a clean and dry place until uiedg
and shall be handled in a sanitary manner.
Item 12. "isposal of wastes. All wastes shall be properly
disposed of and all garbago and trash shall be kept in suitable
receptacles, in such a manner as not to become a nuisance.
Item 13. Refrigeration$ all readily perishable food or
drink shall be kept at oti below 501F. except when- being prepared
or served. Waste water from refrigeration equipment shall be prop rly
disposed of.
Item 14. Wholesomeness of food and drink. All food and dri k
shall be clean, wholesome, and free from spoilage, and so prepared__II
as to be clean and safe for human consumption. All milk, fluid Me
milk products, ice cream and other frozen desserts served shall b
from approved sources.. Milk and fluid milk products shall be sery d
in the individual original containers in which they were received
from the distributor or from a bulk containers equipped with an
approved dispensing device, provided that this requirement shall
not apply to cream, which may be served from the original bottle
or a dispenser approved for such service. All oysters, clams and
mussels shall be from approved sources and if shucked shall be kep
until used in the containers in which they were placed at the shuck-
ing plant.
Item 15. Storage, display and serving of food and drink. A 1
food and drink shall be stored, displayed and served so as to be
protected from dust, ' flies, vermin, depredation, pollution of rode-0
unnecessary handling, droplet infection, overhead leakage and othe
contamination. No animals or fowls shall be kept or allowed in an
room in which food or drink is prepared, stored .or served. All me ne
necessary for the elimination of flies, roaches and rodents shall e
used.
Item 16. Storage, display and serving of food and drink.
All food and drink shall be stored, displayed and served so as to ire
protected from dust, - flies, vermin, depradation, pollution of rode is
unnecessary handling, droplet infection, overhead leakage and othe
contaminations No animals or fowls shall be kept or allowed in any ,
room in which food or drink is prepared, stored or served. All me ,,ns
necessary for the elimination of flies, roaches and rodents shall
be used.
Item 16. Cleanliness of employees. All employees shall wea
clean outer garments and shall keep their hands clean at all times l
while engaged in ahndling food, drinks, unensils and equipment.
Employees shall not expectorate or use tobacco in any form in room
in which food is prepared. Hairmets and suitable caps shall be
worn.
Item. 17. Miscellaneous. The premises of all restaurants shall
be kept clean and free from rubish. None of the operations con-
nected with a restaurant shall be conducted in any room used as li ing
or. sleeping quarters. Adequate lockers or dressing rooms shall be
provided for employees clothing and shall be kept clean. Soiled
linens, coats and aprons shall be kept in containers provided for this
purpose.

Sanntation requirements for Grade B. Restaurants: Grade B
restaurants are those which fail t— o comply with items 19 20 4, 5,
or 17 but which conform with all other items of sanitation re-
quired fro Grade A restaurants.
Sanitation requirements for Grade C restaurants. Grade C
restaurants are those which ail to comply with either the Grade
A or the Grade B sanitation requirements.

Section 14. trades of r-staiirants which may operate.
Hereafter no restaurant shall 'he operated within this city or
its police Jurisdiction unless it conforms to the Grade A or
Grade B requirements of this ordinance; providing that when any
restaurant fails to conform with the Grade A or Grade B require-
ments of this ordinance ,, the Health officer shall suspend the
permit of said restaurant for a period of time not to exceed
fifteen (15) days, or in lieu thereof, may degrade the restaur-
ants and permit its operation during a temporary period not to
exceed fifteen (15) days.
When any restaurant within tl-)is city has had its permit
suspended for a period of time not to exceed fifteen days, or
has been degraded and has been operating with a C Grade for a
period of time not to exceed fifteen days, the Health Officer
shall make a subsequent inspection of said restaurant, said in-
spection to take place on the last day of the period of suspen-
sion or period of temporary operation of said restaurant to de-
,' termine if the operator of said restaurant has corrected and
rerried the defective items of sanitation fin order to be eligible
for a Grade A or Grade B rating.
The Health Officer shall revoke the permit of any restau-
rant within this city that is ineligible for a Grade A or Grade
B rating when nnspected on the final day of its temporary opera-
ij as a Grade C restaurant or on the final day of the period
ii of temporary suspensionr.
Any restaurant within this city that has been inspected
and has received a Grade C rating from the Health Officer three
times during any year of operation while a permit is in -effect
shall have said permit revoked by the Health Officer.
Section 15. Appeal of revocation of permit. Any person
operating a restaurant shall have the right to a review of the
1iaction of the Health Officer in revoking said permit by filing a
notice of appeal from the action of the Health Officer with the
Chairman of the Board of "'ealth of this city. The Board of
ii Health shall hold a hearing in ten days from the time that said
appeal is filed and the person operating said restaurant may be
present in person, and/or with an attorney. The City Attorney
shall represent the Health Officer at said hearing, 'he Board
Of Health shall advise the restaurant operator and the Health
Officer of the time and place of said hearing. the Board of
Health shall hear evidence on the matter of revocation and reach
a decisi6n within a reasonable time. The decision of the Board
of health shall be final.
Section 16. Reinstatement of permit; supplementary regrad-
ing. Any restaurant the grade of which has been �-owered and the
i grqde displays having been changed accordingly, or, the permit
I of which has been suspended, may at any time make an application
II to the Health Officer for the regrading or reinstatement of the
suspended permits
Within one week from the receipt of said application which
shall be accompanied by a statement signed by the applicant that
the violated provision or provisions of this ordinance have
it been complied with and corrected and that the restaurant conforms
to the provisions of this ordinnace,, the Health officer shall make
a reinspection toassure himself that the applicant is again com-
plying with the higher grade requirements, and in case , the find-
ings indicate compliance, he shall award the higher grade or re-
!.I instate the permit; provided that this section of this ordinance
ii shall be subject to the provisions of Section 14 hereinabove.,
Section 179 isease control. No person who is affected ski
with any disease in the communiceble- form or is a carrier of such
disease shall work in any restaurant, and no restaurant shall em
ploy any such person suspected of being affected with any disease
in a communicable form or being a carrier of such disease. If the
restaurant manager suspects that any employee has contracted any
I! disease in a communicable form or has become a carrier of such �,
disease,, he shall notify the Health 'Jfficer immediately, A pla-
card containing this section shall be posted in all toilet rooms. 1;
