HomeMy Public PortalAboutOrdinance 61-291 1 ORDINANCE NO. 61 -29 AN ORDINANCE OF THE CITY OF TEMPLE CITY FIXING TIME PERIOD FOR USE OF APPROVED PLOT PLANS AFTER ADOPTION OF ORDINANCES CHANGING DEVELOPMENT STANDARDS AND LIMIT- ING PERIOD OF VALIDITY OF PLOT PLAN AP- PROVAL THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION. 1. The City of Temple City has heretofore by Sections 9100 and 9101 of the Temple City Municipal Code adopted Ordinance No. 1494 of the County of Los Angeles, as amended. SECTION 2. Such Ordinance No. 1494 of the County of Los Angeles, as amended, provides in Section 728 for approval of a plot plan where more than one single - family residence in zones R -1, R -A, A -1, A -2, A -2 -H, or more than two single family or one two - family residence in Zone R -2 are established, constructed, occupied, structurally altered or used on a lot or parcel of land having twice the required area or more. SECTION 3. Said Ordinance No. 1494 of the County of Los Angeles, as amended, provides in Section'729 that in the event the plans show that the proposed development of the property will violate any provision of said Ordinance 1494, will not maintain the character and integrity of the district in which such use is intended to be established, erected, constructed, occupied, structurally altered or used, or will be detrimental to the general welfare of the community, the Planning Commission may require such revision as may be necessary to correct these conditions. SECTION 4. On December 12, 1960, the City Council of the City of Temple City adopted Ordinance No. 60-23, which Ordinance is now a law of the City of Temple City; that said Ordinance No. 60 -23 changed previous development standards; that prior to said Ordinance No. 60 -23 certain plot plan approvals were given by the Planning Commission; that although said plot plan approvals are automatically voided if not acted upon by the owner prior to the effective date of an ordinance changing development standards it is the intent of this ordinance to grant a period of time in which construction is to be commenced upon plot plan approved development projects. SECTION 5. Upon the change of any development standards of the City of Temple City by a duly adopted ordinance of the City Council of the City of Temple City, any owner who has received approval of a plot plan prior thereto shall have a period of three (3) months commencing as of the effective date of said ordinance, in which to commence the work of improvement or construction as shown on the said approved plot plan. If no work of improvement or construc- tion is commenced within said three months period, or if any work �r improvement is commenced within said three (3) months period and then prior to completion abandoned for a period of one month at any time thereafter, the approved plot plan shall be void and ineffectual for any purpose and no further work or improvement shall be done pursuant thereto. SECTION 6. This ordinance shall be effectual and apply to all plot plan approvals in existence as of the date this Ordinance becomes effective. SECTION 7. Any plot plan approved after the effective date of this Ordinance shall only be effective for a.period of three (3) months, and if no work or improvement is commenced in accordance with approved plot plan within said three (3) months it shall become null and void as if never issued in the first instance. If within the three (3) month period of the granting of the plot plan approval the work of improvement or construction shall be commenced but after the 67 Ordinance No. 61 -29 page 2 aforesaid ninety (90) days abandoned for a period of thirty (30) drys, the plot plan approval shall become null and void and of no effect whatsoever, and no further work or improvement may be done pursuant thereto.
