AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK
OF JEFFERSON CITY, MISSOURI, FOR AND ON BEHALF OF THE CITY, TO ELATE
INTO AND EXECUTE A CONTRACT, WITH THE STATE HIGHWAY COMMISSION OF
MISSOURI, WHEREIN THE CITY SHALL AGREE TO PAY THE COST OF RELOCATIN
THE FACILITIES OF THE CAPITAL CITY WATER COMPANY, THE CAPITAL CITY
TELEPHONE COMPANY AND THE MISSOURI POWER & LIGHT COMPANY AS NECES-
SARY BY THE REMOVAL AND RELOCATION OF THE GREENBERRY ROAD BRIDGE
OVER THE MOREAU RIVER. _
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISS-
OURI, AS FOLLOWS:
Section 1. The Mayor and the City Clerk of the City of
Jefferson City, Missouri, for and on behalf of the City, are hereby
authorized and directed to enter into and execute a• contract with
I the State 'Highway Commission of Missouri wherein the City shall agr e
to pay the cost of relocating the facilities of the Capital City
Water Company, the Capital City 'Telephone Company and the Missouri
Power & Light Company, as necessary by the removal and relocation
1 of the Greenberry Road Bridge over the Moreau River by the State
Highway Commission and Department.

Section 2. Said contract shall be in words and figures as �I

RIGHT-OF-WAY GUARANTEE,
Route B, Cole County, Missouri
WHEREAS , the State Highway Commission of Missouri and the
County Highway Commission of Cole County have, pursuant to law,
agreed upon the construction and maintenance of a supplementary
state highway, Route B in Cole County, Missouri, which involves a
relocation of a bridge across the Moreau River on Green Berry Road.
WHEREAS , the undersigned believe that said highway improve-
ment would confer relatively large local benefits upon the lands
located along such highway and to Jefferson City, generally.
NOW, THEREFORE, in consideration of the cost of right-of-wayl
being paid by other local organizations and in order to induce the
State Highway Commission of Missouri to construct, improve and main
tain said state highway and bridge relocation, the City of Jefferso
City hereby agrees that it, its successors and assigns will, when
requested by the State Highway Commission of Missouri, its agents o�
employees, pay to the State Highway Commission of Missouri or to
parties at its direction such amount or amounts as may be necessary.
to remove or relocate poles, lines and other facilities of the
Capital City Telephone Company, poles, lines and other facilities
of the Missouri Power and Lights Company and water lines , meters and
other facilities of the Capital City Water Company insofar as said
companies are entitled to compensation for the removal of such fac-
ilities.
The above promises, agreements and covenants are made in
consideration of and to induce similar promises, agreements and
covenants of other local bodies for the payment of right-of-way for
said highway and to induce and secure the construction and improve-
ment of said state highway, and secure therefrom the benefits which
will accrue to the City and its citizens .
The promises, agreements and covenants contained herein shal
be final and irrevocable at such time as the State Highway Commis-
sion, its agents and employees, incur any obligation to any or all
of the utility companies above enumerated for the removal of their
facilities .
The persons signing this agreement as officers or agents of
Jefferson City shall not be personally bound except that they hereb
represent and guarantee that Jefferson City now has and will keep
the sum of Two Thousand Four Hundred Eighteen Dollars ($2,418.00)
budgeted, obligated and available to pay out under this guarantee
at the direction of the State Highway Commission until all the cost
