In the event the owner or owners above named �i fail to construct said sidewalk as above directed, then the City of ii Jefferson, under the power and authority given it by its charter and ordinances, will construct said sidewalk and will issue a special tax bill against said property for the cost of the construe j tion of said sidewalk, which said special tax bill will be a lien against the property above described. Ellis President of the Council Mayor #6362 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, TO ENTER INTO A CONTRACT, FOR AND ON BEHALF OF THE CITY OF JEFFERSON, WITH THE FIRM OF HASKINS, RIDDLE AND SHARP, CONSULTING ENGINEERS, OF KANSAS CITY, MISSOURI, PERTAINING TO CERTAIN ENGINEERING WORK IN CONNECTION WITH IMPROVE- MENTS AND ADDITIONS TO THE CITY'S SEWAGE SYSTEM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and the City Clerk of the City of Jefferson, Missouri, are hereby authorized and directed, for and on ,I behalf of the City of Jefferson, Missouri, to enter into a contract with the firm of Haskins , Riddle & Sharp, Consulting Engineers of i� Kansas City, Missouri, pertaining to certain engineering work in I� connection with improvements and additions to the City' s sewage system. Section 2. Said contract shall be in words and figures as follows P R O P O S A L for I� PROFESSIONAL ENGINEERING I� SERVICES Haskins, Riddle and Sharp Kansas City, Missouri �I MEMORANDUM OF AGREEMENT I' FOR OR _PROFESSIONAL ENGINEERING SERVICES I� f THIS MEMORANDUM OF AGREEMENT, by and between the CITY OF JEFFERSON CITY, MISSOURI, through its duly constituted authorities, herein- after referred to as the "City". and HASKINS, RIDDLE & SHARP, Con- sulting Engineers, of Kansas City, Missouri hereinafter referred to as the "Engineer", is made and entered into this 2nd day of October 1956, for the purpose of setting forth certain engineering work in connection with improvements and additions to the City' s sewerage system, and to establish the basis of payments to be made by the i 4 2 G. iCity to the Engineer for such work. The Engineer agrees to do as follows : 1 1 I� Preliminary Phase Services i! 1. Perform all requisite surveys and office studies and prepare !� appropriate charts, graphs, tabulations, maps , etc. , incidental to the preparation of a comprehensive engineering report to cover the following: a. Extent and arrangement of existing sewerage system; b. Studies of population concentrations, growth trends and apparent extent and direction of residential and commer- cial expansion; c. Determination of adequacy of existing sewerage system for serving both the existing and probable future populated area of tine City. I d. Recommendations for Luprovemlent plans for the sewerage sysi tem including pipe sewers and appurtenances, pumping sta- tions as may be required, and new sewage treatment facili- ties; and e. Estimates of construction cost for the recommended sewerag improvements . 2. Submit copies of the engineering report to the State Division o Health and obtain approval thereof prior to proceeding with contingii ent activities. 3. Personally present the written report to the City. 4. Assist the City in pre-bond election activities in such manner and to such extent as the City may request and as he may deem appro- priate. Design and SLipervision Services 5 . When so instructed by the City, prepare complete contract and �I bid documents including detailed plans and specifications approved I� by the State Division of Health for the construction of recommended ;l improvements . Assist the City b. eels i. y in obtaining bids from competent contractors, i opening and evaluating bids, and make recommendations for award of construction contracts . 7 . During the construction period render general supervision inclu l- ing periodic visits to the site to check on the progress of the work check all. shop drawings, analyze all tests of materials of construc '. tion, direct the preparation of monthly estimates for payment of the�� contract and generally assist the City in the overseeing and general administration of the construction project. 8. If, during preparation or after completion of complete working drawings, plans, and/or specifications, any changes are required in same, through no fault of the Engineer, then such changes will be made by the Engineer upon a written request from the City to do so. ! 9 . Upon completion of the construction program, make a final inspect tion of the work, prepare a written report recommending the accep- tance of the work by the City, and prepare"as built" plans for the City. I+ 427 10 . During the construction period, at the City' s option, furnish it an experienced, competent, resident engineer to be in immediate supervision of the construction work. ll. For the services enumerated hereinbefore, the City agrees to pay the Engineer as follows : A. For Preliminary Phase Services (Paragraphs 1, 2 and 3) lump sum .; price in the amount of Three Thousand ($3,000 .00) Dollars , due and i payable upon presentation of the report. In the final settlement ii the payment for Preliminary Phase Services will be credited to the City in the proportion which the estimated cost of the work for which plans and specifications have been prepared by the Engineer, ; bears to the cost of the work recommended in the report. i �� B. The balance as required to equal the total fee, less the amount previously paid for the engineering report, upon completion of construction and final inspection of the improvements . No deductions shall be made on account of ' penalties, liquidated damages, or other sums withheld from payments to contractors . I iC. In the event changes in the plans and specifications are direct( d liby the City after previous acceptance by the City and approved by j; the State Division of Health, such changes not being the fault of ! the Engineer, the City is to pay the Engineer for the work incidental 1lto the changes, at the Engineer' s direct cost plus overhead at 60% a! of the direct cost. Such payments shall be due and payable upon !; monthly billings . i 1' D. Subsurface explorations (boring, drilling, and/or test pits) , (I ( property and right-of-way surveys , calculations of special assess- ments, and laboratory analysis are not included herein. If such !; work is required of the Engineer by the City in writing, he shall ibe reiznbursed additionally therefor at the rate of his direct cost I� II Ii 28 - plus 1000 of the direct cost. However, in case of subsurface ex- ploration performed by the City at its expense, the Engineer will perform at no additional expense to the City the requisite engineer - ing work including location and elevation of test holes and record- ing, plotting and interpretation of results. E. For resident supervision of construction (Paragraph 10) the Cit- shall pay the Engineer at the rate of $650 .00 per month for such periods of time as the resident engineer is assigned to the project,, due and payable upon monthly billing. It is understood that the resident engineer's services may be terminated either by the City or by the Engineer. If construction work is unreasonably delayed due to inability of the Contractor to obtain labor or materials the City or the Engineer reserves the right to discontinue the service of the resident engineer for such periods of no work; and the City will be relieved of payment for such service during his absence from the work. Such monthly payments of $650 .00 for resident super- vision of construction shall apply only through 1956. If the work extends beyond 1956 or is not undertaken until a later date, then the monthly payments will be adjusted agreeably upward or downward in accordance with the prevailing salary scale for skilled engineerl at such -time. 12. The City agrees to furnish the Engineer such plans , records, and other data as may be available in the City files to assist the Engineer in his studies .
