SUBJECT: DISCUSSION OF ORDINANCE NO. 17-1024, TITLE 2
(ADMINISTRATION), CHAPTER 6 (CITY COMMISSIONS), ARTICLE C
(ART IN PUBLIC PLACES PROGRAM) SECTION 5 (DONATIONS AND
OTHER CHARITABLE GIFTS) OF THE TEMPLE CITY MUNICIPAL
CODE FOR THE ART IN PUBLIC PLACES PROGRAM
RECOMMENDATION:
The City Council is requested to discuss Ordinance No. 17-1024 amending Title 2,
Chapter 6, Article C, Section 5 of the Temple City Municipal Code regarding the Art in
Public Place Program (Attachment “A”).
BACKGROUND:
On May 17, 2017, the City Council adopted Ordinance No. 17-1024 amending Title 2,
Chapter 6, Article C, Section 5 of the Temple City Municipal Code, Art in Public Places.
ANALYSIS:
The proposed municipal code amendment would give first review of donations and other
charitable gifts under the Art in Public Places Program to the Parks and Recreation
Commission. The role of the Parks and Recreation Commission would include review and
recommendation to the City Council of donations, gifts, bequests, grants and art from any
governmental agencies or private donors, with the City Council maintaining oversight of
the Art in Public Places Program and final review for appeals.
If desired by the City Council, staff will bring back for introduction and first reading an
amendment to Ordinance No. 17-1024 at a future City Council meeting for approval.

CITY STRATEGIC GOALS:
The proposed amendments to the Art in Public Places Program will further the City’s
Strategic Goal of Good Governance.
FISCAL IMPACT:
There is no fiscal impact with the proposed amendments to Ordinance No. 17-1024.

2-6C-5: DONATIONS AND OTHER CHARITABLE GIFTS:
The City may receive offers of donations, gifts, bequests, grants, and art from any government
agencies or private donors. All donations, gifts, and bequests are subject to approval by the City
CouncilParks and Recreation Commission. Potential donors will be referred to the City Manager
or his or her designee to discuss the nature of the gift and the review process. After a
preliminary review is conducted, the City Manager shall refer the matter to the Advisory
CommitteeParks and Recreation Commission. The Advisory CommitteeParks and Recreation
Commission shall analyze the offer and the City's ability to incorporate the offer into the
program, and shall make a recommendation to the City Council regarding acceptance or
rejection of the offer and, where the offer is of physical public art, a public space for placement
of the donation. The City Council shall review the Advisory CommitteeParks and Recreation
Commission recommendation and may take such further action as it deems appropriate prior to
accepting or rejecting the offer. Donated funds will be accounted for individually and may be
administered by the City Administrative Services Director or designee, consistent with the
donor's restrictions and direction from the City Council. Donations and other charitable monies
will be transferred to the Public Art Fund. (Ord. 17-1024)
