limits and parallel to the Township line to the east line of the
Southwest quarter of the Southwest quarter of Section 350
Township 45 North, Range 12 West; thence North to the Northwest j
corner of the Northeast quarter of the Southwest quarter of
Section 35, Township 45 North, Range 12 West; thence east along
the quarter section line of said Section 35, Township 45 North,
Range 12 West, to the westerly line of the Boonville Road;
thence southerly along and with the westerly line of the
Boonville Road to the point of beginning.
The above described land, with limits or boundaries defined as
above shown, shall be assessed, as the benefit district, for the
cost of acquiring the right of way, oxidation sewage basin, and
access road to said oxidation sewage basin, as described in Section
1. and 2. of this ordinance. f
Section 4. The benefit assessments mentioned in Section 3. of 1
this ordinance shall be apportioned against the lots, tracts or
parcels of ground owned by residents of the City of Jefferson City
within the limits of Sewer District No. 50 "D" as defined in
Section 3, above after the cost of said appropriation of the lands
described in Section 1. of this ordinance for the purposes
mentioned in Section 2. of this ordirance has been determined, and
the City of Jefferson City, Missouri , shall advance the amount of
damages awarded the owners of the land as described in Section 1.
of this ordinance, and after payment of the award of damages as
finally determined by the judgment in said condemnation suit, the
City of Jefferson City, Missouri, shall be entitled to recover the
amounts assessed against the respective lots, tracts or parcels
of land within said benefit district as heretofore defined in
Section 3. of this ordinance, with interest thereon at the rate of
six (6%) per cent per annum from the date of the payment of the
amount of damages as determined by a final judgment in said
condemnation suit, and said assessments to be raid by the owners of
the lots, tracts or parcels of land within said benefit district
shall be made in one installment to be due and payable as soon as
the City of Jefferson City pays the damages awarded by final
judgment in said condemnation proceeding. Failure of the owners ofd
the lots, tracts or parcels of land within the benefit district to
pay their assessments when due shall cause said. assessments for
benefits to be a lien upon the land assessed and benefitedo anA
such lien shall continue until the assessment against such lot,
tract or parcel of .land has been fully paid or a sale made
thereunder, pursuant to a special execution issued at the instance
of the City of Jefferson City, Missouri , and the assessment paid
from the ptoceeds: of such -sale.
Section 5. This ordinance shall be in force and effect from
land after its passage and approval.
