AN ORDINANCE AMENDING MOAB MUNICIPAL CODE
SECTION 17. 72. 100.
WHEREAS, the Governing Body, on the recommendation of the Moab City
Planning Commission deems that it is necessary to amend the Moab Municipal Code
with respect to minimum attendance requirements for board of adjustment members.
NOW THEREFORE, IT IS HEREBY ORDAINED AS FOLLOWS:
17.72. 100 Board of Adjustment -Establishment, membership, minimum
attendance and terms. There is created a board of adjustments which shall consist of five
members, each to be appointed by the governing body for a term of five years, provided
that the terms of the members of the first board so appointed shall be such that the term
of one member shall expire each year. One member, but not more than one member of
the planning commission shall be a member of the board of adjustments. Members must
attend a minimum of seventy-five percent of all board of adjustments meetings held during the
course of a calendar year in order to remain a member of the board of adjustments. This annual
determination of attendance shall be conducted by planning department staff and forwarded to
the chairperson of the board of adjustments, the planning commission, the city manager and
mayor and city council. Any member may be removed for cause by the governing body
upon written charges and after a public hearing, if such public hearing is requested.
Vacancies shall be filled for the unexpired term of any member whose term has not
been completed (Prior code Section 27-25-10)
PASSED, ADOPTED AND APPROVED by the Governing Body of the City of Moab in
open session this lzithday of N1995, This Ordinance shall take effect
immediately upon passage.
