ORDINANCE NO. 6494
An Ordinance granting an easement in favor of the Fleming Co. , Inc,
a Kansas Corporation, in and upon certain described real property
owned by the City of Jefferson, Missouri, for the purpose of con-
structing drainage facilities.
XE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOU I,
AS FOLLOWS:
Section 1. That the City of Jefferson, Missouri, hereby
gives and grants to the Fleming Co. , Incorporated, a Kansas
corporation, an easement in and upon the following described real
property of the City of Jefferson:
A strip of land 50' in width lying along the west boundary
of reai estate owned by the City of Jefferson, Missouri ad-
jacent to and east of the following described bract of land:
A part of the NE'k of Section 12, Township 44,
Range 12, more particularly described as follows:
Beginning at the NE corner of Dulle's addition as
shown in Plat Book 3, page 8, Cole County Recorder's
office, said point being 30' south of the north line
and 600 ' west of the east line of the SEk of the NEk
of said Section 12. Thence north 72 deg. 46 minutes
west along the north line of the Dulle addition 47 '
31!; Thence north 1 deg. 30 minutes west 490' to be-
ginning point of this description. Thence north 29
deg. 23 minutes east 2841 . Thence westerly along the
southern line of Industrial Drive 323.01 . Thence
south 1 deg. 30 minutes east 274.01 . Thence south
!� 56 deg. 30 minutes east 182.5' to the point of be-
ginning of this description.
For the purpose of enabling The Fleming Co. , Incorporated, to dig
and cut into, through and upoin the aforedescribed city property
in the construction of a drainage channel on the property lying
west of and adjacent to said described city property, and to construct
a backslope upon said city property in connection with such drainage
channel.

Secxion 2. The City of Jefferson further gives and grants tD
he Fleming Co. , Incorporated, the right to remove from the afore-
described premises all material necessarily excavated from said
city property in the construction of said drainage channel, and to
utilize such excavated material in filling in the present drainage
channel after diversion thereof.
Section 3. The aforesaid The Fleming Co. , Incorporated,
shall hold The City of Jefferson harmless from any and all liability
ich may arise as a result of the exercise of said easement by
The Fleming Co. , Incorporated.
Section 4. The Mayor and City Clerk of the City of Jeffers
re hereby empowered and authorized to execute a conveyance of the
easement described in Section 1. of this ordinance for and on. behal
