N ORDINANCE, REGULATING THE SUBDIVISION OR RESUBDIVISION OF LANDS
INTO LOTS, PLOTS OR BUILDING SITES: PROVIDING FOR SUBMISSION AND
APPROVAL OF MAPS OR PLATS FOR SUCH SUBDIVISION OR RESUBDIVISION:
PROVIDING FOR CERTAIN MINIMUM IMPROVEMENTS: PROVIDING FOR THE
ENFORCEMENT OF THE REGULATIONS HEREIN SET UP: PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON IN
LEGAL AND REGULAR SESSION CONVENED: The following Regulations for
the subdivision or the resubdivision of lands into lots, plots or
building sites; the provisions for submission and approval of maps
or plats for such subdivision or resubdivisions; The provisions
for minimum improvements; The provisions for the enforcement of
Regulations and Provisions of this Ordinance, and the provisions
for penalties for the violations of any of the Regulations or
Provisions of this Ordinance, be and the same are hereby adopted.
Section I. "DEFINITIONS."
For the purpose of this Ordinance, certain terms and words as
used herein are defined as follows:
(a) "CITY COUNCIL'" means the current City Council of the City
of Jefferson, Missouri, composed of the Mayor and the ten Council-
en.
(b) "COMMISSION" or "PLANNING COMMISSION" means the current
City Planning and Zoning Commission appointed by the Mayor. .
(c) "SUBDIVISION" means the division of a lot, tract or parcel
of land into two or more lots, plots, parcels or building sites,
for the purpose of sale or of building development, either
immediate or future.
It, also includes the resubdivision or rearrangement of one or
more lots, plots, parcel or building sites.
(d) "STREETS - AVENUE - ROAD" or any other similar designation
11 mean the same for the general purpose of this Ordinance.
(e) "ALLEY - SERVICE WAY" or any other similar designation all
can the same for the general purpose of this Ordinance.
(f) "LOT - TRACT - PLOT" or any area with similar designation
all mean the same for the general purpose of this Ordinance.
(g) "PLAT" means an accurate drawing or, map of the land
proposed to be subdivided.
SECTION II. "PROCEDURE FOR SUBMISSION OF PLATS."
In seeking to subdivide land into lots or building sites, or Lcl�
dedicate streets, alleys, or land for other public use, the owner s 1
submit to the City Council a preliminary plat of the land which has
een made by a Registered Surveyor and which contains all of the
information hereinafter required. The City Council shall. refer saM
to the City Planning and Zoning Commission for its study and LIM
recommendations and that Commission shall mare its recotmae:ndat:ioans
to the City Council within thirty days after the owner has submitted
the final plat or shall request additional time if necessary to
carry out the provisions of this ordinance. One copy of thh
preliminary plat shall be furnished to the City Engineer who shall
make any investigations requested by the Planning Commission. Upon
acceptance and approval of the final plat by the City Council, the
plat shall be recorded in the office of the Recorder of Deeds of
Cole County.
SECTION III. "PRELIMINARY PLAT"
The plat submitted to the City Council for its approval shall
be referred to as the "preliminary plat" . Three (3) copies or print s
shall be submitted. It shall be drawn to scale, (not more than 100
feet to the inch) and shall show: ,
(a) The location of all existing property lines, North points,
scale, streets, alleys, adjoining streets and alleys, buildings,
water courses, sewer mains, water mains, gas mains, culverts and
other underground structures, easements and other existing features
within the area to be subdivided and in the adjoining streets or
alleys .
(b) The names of all adjoining subdivisions .
(c) The proposed location and width of all streets, alleys,
and lots and the zoning district or districts in which the land
to be subdivided is located according to the current Zoning
Ordinance.
(d) The title under which the proposed subdivision is to be
recorded, the name of the owner with sufficient data to show
ownership and the name of the Surveyor platting the tract. .
(e) The Commission may require a contour map, or certain
elevation data based upon the official City Datum.

The preliminary plat shall be accompanied by a map of the city �
upon which shall be sketched, to the same scale as the city map, the
correct location of the proposed subdivision, its boundaries and
the streets and alleys.
The Commission shall either approve, conditionally approve,
or disapprove such preliminary plat within thirty (30) days after
its submission.
If the plat is conditionally approved, the conditions of a.pprol 1
shall contain the following requirements . I
(1) That any changes the Commission deem necessary, (in order
that the subdivision conform to these regulations and the City Plan
of the City of Jefferson) , be made.
(2) That a proper final plat be submitted- complying with the
provisions herein set forth for final plats.
SECTION IV. "FINAL PLAT" .

If the preliminary plat is approved by the Commission, or if
the conditions of conditional approval by the Conunission have been
complied with by the owner, a final plat, on tracing cloth, shall �
be submitted to the Commission, accompanied by six (6) prints.
One print shall be retained by the Commission, one print shall be
filed with the City Engineer, two prints shall be filed twith the
Build
ing Commissioner, and two prints shall be returned the City
ff
Council together with the recommendations of the Commission.

The final plat shall be drawn to a scale of not more than. one (�
hundred (100) feet to the inch and shall show:
(a) The title under which the subdivision is to be recorded,
the name of the owner, and the name of the Surveyor responsible
for the plat, North point and scale, also the classification of
the property under the current Zoning Ordinances.

(b) The boundaries of the property, the lines of all streets
and alleys with their widths and names, and any other portions
intended to be dedicated to the public use, and the location of
any existing buildings . In case of branching streets or alleys,
the angle of departure from one street; or alley to another shall
be indicated, angles of ninety or one hundred eighty degrees need
not be shown, but all other angles must be indicated in the proper
location.
(c) The lines of the adjoining streets and alleys with their
widths and names.
(d) All lot lines, lot numbers or letters in resubdivisions,
and utility easements shall be shown and determined by dimensions.
Where there is no alley dedication, a utility easement having
a minimum width of five (5) feet shall be granted and shorom across
the rear of all lots and at such other locations as the Commission
deems necessary.
(e) All dimensions, both linear and angular, necessary for
locating the boundaries of the subdivision in relation to some
section, quarter section or other established corner and line must
be shown in order to show the relation of the subdivision boundarie
to the section lines. All dimensions, both linear and angular of
the streets, alleys, lots, utility easements or other tracts or
areas shall be shown. The linear dimensions shall be expressed
in feet and decimals of a foot.
(f) Radii, acrs and chord, points of tangency and central
angles for all curves and rounded corners .
(g) Location and description of all monuments. A suitable
permanent monument of stone, iron or concrete shall be located at
all corners and at all angle points on the subdivision boundaries.
All street, alley, lot or other tract corners, intersections and
angle points shall be marked with iron pipe or other suitable
monuments.
(h) Any restrictive covenants to apply to lots in the subdivi-
sion that are printed on the final map or plan shall be signed by
the owner or owners and any trustee, mortgagee or mortgagees.
(i) That the Surveyor preparing the map or plat is licensed
and. registered in the State of Missouri..
(j) A dedication form to be signed by the owner or owners, and
any trustee, mortgagee or mortgagees, in the presence of a Notary
Public.
(k) A form for the approval of the City Engineer.
(1) A form for the approval of the Planning Commission, and a
form for the acceptance by the City Council of the City of Jefferso .
(m) The map or plat shall not show any tract, area, strip or
any other portion of land as "Reserve" or !'.Reserved"; all areas
shall be designated by number or letter and no blank area shall be
shown on the map or plat.

(n) When the area subdivided into lots, plots or building
sites lies at such a low elevation that it has been, within the
past twenty years, inundated or overflowed by rain or storm waters,
a statement shall be printed on the subdivision map or plat setting
forth these facts, and should the elevations of the land be (!
variable the portions that have been overflowed shall be indicated
on said map or plat.
SECTION V. "ACRE OR LARGE TRACT SUBDIVISIONS"
Where the area is divided into larger tracts than for normal
building sites, and in the opinion of the Commission any or all of
the tracts are susceptible of being resubdivided, the street and
lot arrangement of the original subdivision shall be such that the JI
alignment of future street dedications may conform to the general. �
street layout in the surrounding area. i
SECTION VI. "RELATION TO ADJOINING STREETS"
I
The arrangement of streets in new subdivisions shall provide
for the continuation of existing streets in adjoining subdivisions +
(or other proper projections where adjoining property is riot
subdivided) insofar as they may be necessary for public r equirementil.
Whenever there exists a dedicated or platted half street or
alley adjacent to the tract to be subdivided the other half of the
street or alley shall be dedicated. All streets approximately in
alignment with existing streets shall bear the names of the
existing streets. All other streets shall be assigned names which
do not conflict with names of existing streets.
SECTION VII. "STREET AND ALLEY WIDTHS"

The minimum width for major streets shall be eighty (80) feet. �
The minimum width for subdivision streets shall be sixty (60) feet.
Where the topography or special conditions prevail the
Commission may approve or require streets of greater or less width
if deemed necessary.
The minimum width of an alley shall be twenty (20) feet. Alle s
shall be provided at the rear of all business lots, but are not
required at the rear of residential lots except under unusual
conditions. At all intersections of alley with alley, where the
angle is a right angle or more acute, a five (5) foot cut back shall
be provided.
SECTION VIII. "BLOCKS"
(a) No block shall be longer than one thousand (1000) feet
between street lines; in any block over 600 feet- long a cross walk
not less than ten (10) feet wide may be required.
(b) Whenever a new subdivision is located a considerable
distance from any other subdivided property, the width of blocks,
except for a special reason, shall not be less than 330 feet �I
between center of street lines .

( ) When e a dead end street or alley is necessary to serve a
certain irregular area, due to size, shape or topography of said
area, the closed end shall provide a turning loop having a
minimum radius of thirty-five (35) feet for the inner curb for a II
street, and of twenty (20) feet for an alley.
SECTION IX. "LOTS" r ��

All lots, plots or building sites in any original subdivision
hall be numbered consecutively from one to the total number of lots
I n the subdivision. The elimination of block numbers of letters is I
esired. All lots, plots or building sites in any resubdivision
hall be lettered a - b - c etc.
In any subdivision that is laid out and developed in units or ,
irst and Second filing etc. , the lots shall again be numbered �
onsecutively, not duplicating any lot number in previous units or
ilings.
SECTION X. "RESTRICTIVE COVENANTS"
I
Restrictive covenants to apply to lots in the subdivision,
tinted on the subdivision map or plat, that do not conform to or
that are in conflict with the Ordinances or codes of the City of
Jefferson, shall not burden the City, or the City Council, with
ny obligation or responsibility to enforce compliance with said
ovenants beyond the requirements set forth in the City Ordinances
r Codes.
SECTION XI. "APPROVAL" (CONDITIONS)
Before approval and acceptance of the plat by the City Council
contract shall be entered into by and between the. City and the
wner or subdivider which shall require, subject to- such additional
erms, conditions and modifications as the City Council shall reques ,
eem necessary or approve, the following:
(a) A plan, submitted by the owner or subdivider, that shows
11 public utility installations as needed at present or in the
uture.
(b) A plan, submitted by the owner or subdivider, that shows
he location, direction, depth, grade and profile of all necessary
anitary sewers, manholes and other necessary appurtenances to
ervice the lots within said subdivision.
(c) The plans for all underground construction for the public
tility,:lines :and the sanitary sewer lines shall show and provide
or the individual service connections to each lot adjacent thereto.
(d) In the event any portion of any sanitary sewer or any
ortion of any public utility line falls within the right of way of
ny street or alley, all service connections from said sanitary
ewer or from said public utility line shall be brought- out to the
fight of way line for each lot adjacent thereto.
(e) All underground construction of sanitary sewers and
ublic utility lines, lying within the limits of street or alley rig t
of way, shall be constructed in accordance with the grade as
stablished by the City Council. The construction work of the above
ewer and utility lines shall be commenced and completed before any
rading, gravelling, paving, macadamizing, curbing, guttering or
idewalk improvements shall be started.
(f) No grading, gravelling, paving, macadamizing, curbing,
uttering or sidewalk improvements, whether, temporary or permanent
n nature shall be commenced within a period of one year from the
ermination of construction of sanitary sewer or public utility
Ines and service connections therefrom to insure adequate and
omplete settling of excavations caused thereby; provided that,
n the event the sanitary sewer and public utility excavations have
een mechanically tamped to the satisfaction of the City Engineer th n
he aforementioned street and sidewalk improvements may be initiated

(g) The City Council shall require a cash deposit or a surety �
ond, or a bond with two freeholders who are residents of the City
f Jefferson, Missouri, as may be approved by the City Council, to
uarantee the faithful performance of all things and matters called y
or by said contract. !�
(h) In order to facilitate the preparation and execution of
he contract, profiles and alignment of all new streets and alleys
within the subdivisions shall be furnished; they shall be drawn to
scale of one inch equaling forty (40) feet horizontal and one inch
equaling four feet vertical on standard profile cloth. Profiles
hall show accurately the profile of the street or alley along each
roperty line and along the center line, all -elevations to be on
City datum.
SECTION XII. "VARIATIONS AND EXCEPTIONS."
The Planning Commission and or the City Council herein reserve)
he right to consider modivications of the requirements of this
Ordinance, when it is clearly evident that an extraordinary condition
exists that would make it impractical and not feasible to comply
with all the requirements of this Ordinance.
SECTION XIII. "ENFORCEMENT"
.(a) No plat of any subdivision of land within the corporate
[Limits of the City of Jefferson shall be filed and recorded in the
ffice of the Recorder of Deeds of Cole County, Missouri, until i
such plat has been accepted by the City Council, and the endorsement!
f such action by the City Council shown on the final plat, signed
y the Mayor of the City of Jefferson.
(b) No sewer, water or gas main or pipe or other public
tility improvement shall be made, nor shall any public money be
xpended within the lands laid out in building lots, streets or
alleys, where the improvements are for the benefit of such Lands,
ntil "the plat of such lan;'; shall have been accepted by the City
ounci.l and recorded in the office of the Recordet of Deeds of
ole County, Missouri.
(c). The •approved andr-accepted plat of any subdivision shall
e recorded in the office of the Recorder of Deeds of Cole County, II
issouri, within thirty (30) days from the date of the approval and I�
acceptance by the City Council of the City of Jefferson, or said
approval and acceptance shall be void.
SECTION XIV. "VIOLATION AND PENALTY"
Any person, partnership or corporation who violates any of the
rovisions of this Ordinance or aids or abets in the violation of
ny of the provisions of this Ordinance shall be guilty of a
isdemeanor, and shall be punishable by a fine of not exceeding
ifty (50) dollars, each day that a violation is permitted to exist
hall constitute a separate offense.
SECTION XV. "CONFLICTING PROVISIONS REPEALED"
All Ordinances or part of Ordinances in conflict with any of
he provisions of this Ordinance are hereby repealed.
SECTION XVI. "VALIDITY"
If any section, clause, paragraph, provision or portion of
his Ordinance shall be held invalid or unconstitutional by any Cour
f competent jurisdiction, such holding shall not affect any other
section, clauses, paragraph, provisions or portion of this Ordinance
