Ellis ,181�,,,� President of the Council Mayor ORDINANCE NO. b596 - SIDEWALK ORDINANCE ORDINANCE NO. b597 AN ORDINANCE AUTHORIZING PROPERTY OWNERS OUTSIDE OF THE CITY LIMITS OF THE CITY OF JEFFERSON CITY, MISSOURI, TO APPLY FOR PERMISSION TO CONNECT SANITARY TRUNK LINE SEWERS AS EXTENSIONS TO THE CITY SANITARY SEWER SYSTEM IN THE SOUTH WEAR'S CREEK WATERSHED, PROVIDIN FOR THE CONSTRUCTION AND MAINTENANCE. OF SAID SEWER, AND THE COST THEREOF, AND THE PROCEDURE TO BE FOLLOWED IN MAKING CON'NEC'TIONS OF INDIVIDUAL LATERALS OF PROPERTY OWNERS TO SAID TRUNK LINE EXTENSION UNDER CERTAIN TERMS AND CONDITIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON CITY, MISSOURI, AS FOLLOWS: Section 1. From and after the effective date of this ordinance, any property owner or group of property owners living outside of the city limits of Jefferson City, Missouri, whose property is so locat d that it may be served by a sanitary sewer extension of the city sewer system in the South Wear's Creek watershed, may apply in writing, upon a form to be supplied by the City Engineer, to the Ci y Council of said city for permission to make a trunk line sanitary sewer connection as an extension to the city sewer system. The application shall include the following, information: (a) A request to make a connection of a sanitary sewer -to the city sewer system. (b) A complete and accurate legal description of the area! sought to be served by the proposed sewer extension. (c) Three copies of detailed plans and specifications of the proposed sewer extension shall accompany the application. f (d) A statement that the applicant(s) shall pay the entire cost of the construction of said proposed serwe extension. (e) A statement that the sewer shall be constructed under the supervision of the City Engineer and that the completed sewer s al meet with his approval. A statement that no sewer connection between the completed sewer and the city sanitary sewer system, or any extension thereof theretofore made outside the city limits, shall be made until the City Engineer has filed a written approval of the completed sewer in the office of the City Clerk. (f) A statement that the applicant(s) , and any individuals who later make connections of private laterals to the proposed sewer extension, shall bear tine total cost of maintenance and repai of said sewer until such time as the land which is served by said sewer extension is annexed by the city, by extensions of the corporate limits thereof, at which time the city shall bear the cost of repairing and maintaining said sewer extensions. (g) A statement that the applicant(s) aggree(s) to properly maintain and repair said sewer extension upon the occurrence of any unsafe or unsanitary condition such as obstructions, stoppage, introduction of storm water, or other similar occurrences, and in the event of failure to do so that the city may cause said sewer extension to be disconnected from the city sewer system, or proper extensions thereof theretofore made. (h) The application shall be signe "by a_Il 6 hers of recor�'fc title to the property through which the proposed sewer is intended to extend. (i) A statement that all necessary easements in accordance with the terms of this ordinance shall be given to the City of .Jefferson City, Missouri. Section 2. The executed application shall. be accompanied by an executed deed of easement in favor of the City of Jefferson City, ii Missouri, as grantee, over all of the ground to be occupied by said proposed sewer extension. Said easement shall be of a, minimumll width of ten feet (and of a greater width if deemed necessary by the City Engineer) with the center line of said easement coinciding V_- .. with the location of the proposed sewer extensions as designated in the plans and specifications. Said easement(s) shall be tendered to the city on forms prepared by it and they shall, provide that the grantors thereof shall in no manner occupy or use the lands within said easement area in any way so as to infringe upon the i city' s right to inspect, service or maintain said sewer under the conditions of sub-paragraph (f) of the preceding section, and shall; further provide that the city, through its servants and employees, ;� shall have the right to disconnect said sewer extension, or any ! private laterals thereto, under the terms and conditions of sub-paragraph (g) of the precdding section. The easement, shall be located by a correct and accurate legal description. r Section 3. The plans and specifications must be approved by the City Engineer who shall then submit two copy of same to the State Board of Health for their approval. If said approvals are given, one copy of the plans and specifications shall be returned to 'the applicant(s) with the approvals endorsed thereon. If the City ' Engineer or State Board of Health fails to approve said plans and I specifications, all three copies L-hereof shall be returned to the I applicant(s) for correction of any deficiencies. The City Engineer, shall be under no obligation to perform the work of preparing the plans and specifications; and should he do so, way charge such fee for his services as he deems reasonable which may be retained by him. I Section 4. Before any individual property owner shall connect: his f private lateral sewer from his building to the lateral extension of the city' s sewer system, he shall file an application with the City Engineer. The application shall state: (a) that the applicant will not permit any surface water fromI his structure or premises to enter said private lateral sewer; (b) that his building will have a separate and distinct connection to the proposed sewer extension; (c) that the plumbing in his building shall meet the require-;l ments of the plumbing code of the City of Jefferson City, Missouri;�1 (d) that his building and premises may be inspected by the Building Commissioner and the Plumbing Inspector of the city to insure compliance with the preceding subparagraphs ; (e) an agreement by the applicant that failure to comply wit the four preceding sub-paragraphs of this section or the violation Pf the plumbing code or any of the general ordinances of the city pertaining to sewers shall be grounds for the city to order the disconnection of, or cause to be disconnected, said private latera�� to the sewer extension to the city' s sanitary sewer system or approved extensions thereof. Section 5. The Cit y Engineer ineer 1 transmit said application for private lateral connection to the Building Commissioner and the Plumbing Inspector who shall proceed to inspect the premises of the applicant. If the Building Commissioner and the Plumbing �! Inspector are satisfied that no surface water is permitted to cc be introduced into the private sanitary lateral, and that the structure has its own separate and distinct connections to the i i�
