ORDINANCE NO. 6623
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE, ACKNOWLEDGE AND
DELIVER TO MISSOURI POWER & LIGHT COMPANY AN ELECTRIC LINE EASEMENT
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Missouri Power & Light Company desires to extend a
13,800 volt electric line along and on the extension of Industrial
Drive outside the corporate limits of the City of Jefferson, Missou i,
and such line will cross certain lands owned by the City of Jefferson,
Missouri, in anticipation of the extension of said Industrial Drive
and
WHEREAS, an electric line easement across said lands will be in the
public interest and consistent with the plans for development of
the extension of Industrial Drive;
NOW THEREFORE, be it ordained by the Council of the .City of Jeffers n,
Missouri, as follows:
Section 1. The Mayor of the City of Jefferson, Missouri, is hereby
authorized and directed to execute, acknowledge and deliver to
Missouri Power & Light Company the following electric line easement
across the described lands owned by the City of Jefferson, Missouri
ELECTRIC LINE EASEMENT
For and inconsideration of the sum of One and no/100 Dollars ($1.00 ,
receipt of which is hereby acknowledged, the undersigned City of
Jefferson, a municipal. corporation organized and existing under the
laws of the State of Missouri, Grantor herein, does hereby grant,
convey and warrant unto the MISSOURI POWER & LIGHT COMPANY, Grantee
lherein, its successors, assigns and lessees, the perpetual right
and easement to erect, reconstruct, operate and maintain under
varying conditions of operations, renew and remove, an electric
transmission and distribution line, the poles, anchors, stubs,
brace poles, guys, crossarms, insulators, conductors, ground wires,
cables and other equipment ,appurtenant thereto, for the transmissio
and .distribution of electric energy in, on, over, upon, through and
across certain lands owned by Grantor, situated in Cole County, State
of Missouri, and described as follows:
Part of the West fractional Half of Section 2, Township 44,
Range 12, containing 1. 1 acres, more or less, and particularly
described as follows:
From the Northwest corner of Section 2, Township 44, Range 12,
thence South along the section .Line 464 feet to the Northwest
corner of the Missouri Power& Light Company property at a
point on the South line of the Missouri Pacific Railroad right
of way; thence in a Southeasterly direction along the South li e
of said right of way, 612 feet, to the Northeast corner of
the Missouri power & Light Company property for the point of
beginning; thence continuing in a Southeasterly direction alo
the South line of said right of way 815 feet to the quarter
quarter section line and the West line of the Arthur H. Beck
property; thence South along the quarter quarter section line
40 feet; thence in a Northwesterly direction parallel to the
South line of the said right of way, 815 feet to a point on
the East line of the Missouri Power & L.,ght Company property;
thence North 5 degrees 40 minutes West, along the East line
of said property, 40 feet to the point of beginning.
said electric line to be located upon said premises as follows:
along the south side thereof; togethter with the right of ingress t
and egress from such lands over lands of Grantor for purpose of
patrolling said line, or repairing or renewing the same, and for
doing anything necessary for the enjoyment of the easement herein
granted and to trim or fell such trees, branches, shrubbery, bushes
and remove such other obstacles as may interfere with the safe, '
proper and expeditious erection, operation and maintenance, under
varying conditions of operation, renewal and removal of said line,
or any part thereof, without further payment therefor except as
hereinafter provided. The center line of the right of way easement
herein granted shall be established by the longitudinal center of
said electric line upon its initial erection; upon any reconstructions
renewal, replacement or.' substitution of said electric line, in
whole or in part, the locations of poles may be changed, but as
nearly as practicable such poles or structures shall be located over
and upon said center line of the electric line as theretofore
constructed or erected.
Subject to the foregoing this grant shall be Binding upon the
successors and assigns of the undersigned.
WITNESS the hand and seal of the Grantor this 16th day of
