BE IT ORDAINED BY THE CI'T'Y COUNCIL OF THE CITY OF JEFFERSON, MISSOUR , S FOLLOWS: SECTION 1. That the City Council of the City of Jefferson, Missouri [hereby declares that it deems it necessary for the health and comfort of the inhabitants of the City, and for sanitary purposes, that there must be constructed as soon as possible in Sewer District No. 97, "A", as established by Ordinance a sanitary sewer and it is . rdered that the same be made and constructed without unnecessary de ay and that the said district sewer be connected with and into the resent sewer at Station 7 plus 50 in Joint Sewer No. 1/ SECTION -2. Ellis /s/ PRESIDENT OF THE COUNCIL MAYOR ORDINANCE NO. 6639 AN ORDINANCE AUTHORIZING THE MAYOR AND THE CITY CLERK TO SIGN AN AGREEMENT FOR AND ON BEHALF OF THE CITY OF JEFFERSON, MISSOURI, WHEREIN THE CITY OF JEFFERSON AGREES TO PAY TO PHIL GARRISON AND DELPHINE M. GARRISON, HUSBAND AND WIFE, THEIR HEIRS, GRANTEES AND SIGNS THE SUM OF FIVE HUNDRED ( 500.00) DOLLARS TO COVER THE COST OF RIGHT OF WAY FOR BIDEWALK PURPOSES ALONG THE WEST SIDE OF 4 IIJACKSON STREET FOR A DISTANCE OF 170 FEET SOUTH OF THE SOUTH LINE (OF HICKORY STREET UPON A JUDICIAL DETERMINATION THAT THE WEST CURB LINE OF JACKSON STREET BEGINNING AT HICKORY STREET AND EXTENDING 170 FEET SOUTH IS LOCATED ON THE TRUE WEST RIGHT OF WAY LINE OF `JACKSON STREET. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUIIq AS FOLLOWS: SECTION 1. The Mayor and the City clerk of the City of Jefferson, Missouri, are hereby authorized and directed to execute for and on behalf of the City an agreement wherein the City of Jefferson agree to pay to Phil Garrison and Delphine M. Garrison, his wife, their heris, grantees or assigns the sum of Five Hundred ($500.00) Dollar to cover the cost of sidewalk right of way along the west side of Jackson Street for a distance of 170 feet south of the south tin of Hickory Street upon the determination by a court of competent jurisdiction that the present west curb line of Jackson Street, beginning at Hickory Street and extending for a distance of 170 fee south, is located on the actual, true west right of way line of Jackson Street. SECTION 2. Said agreement shall be in words and figures as follows AGREEMENT WHEREAS, Phil Garrison and Delphine M. Garrison, his wife, hereinafter called the owners, are the owners of real estate locate at the southwest corner of the intersection of Hickory and Jackson Streets, in Jefferson City, Cole County, Missouri, and Whereas on April 16, 1958, the City of Jefferson City, Missou i, y ordinance number 6449 did order the owners to construct a concrete sidewalk for a distance of 170 feet along the west side of Jackson Street, beginning at Hickory Street and extending southsaid distance; and Whereas, the owners initiated the construction of said side- walk under the belief that the west right of way line of Jackson Street lay five feet west of the west curb line of Jackson S reet and that said sidewalk was being constructed on said city sheet riEht of way, and Whereas, the uowners caused said property to be surveyed and are of the opinion that the east line of their lot extends to the resent west curb Nine of Jackson Street, and that the City of efferson does not have any right of way west of the west curb line f Jackson Street, and Whereas, the City of Jefferson believes that the true qnd actual west right of way line of Jackson Street as it passes the proper of the owners lies five feet west of the present west curb of Jackson Street and that said sidewalk, where constructed by the owners, lie upon said Jackson Street right of way, and Whereas there is a valid dispute between the owners and the City as to the true location of the westerly right of way line of Jackson Street at the point where the owners' property abuts Jackso Street, now therefore: In consideration of the construction of the sidewalk by the (owners pursuant to the ordinance of the City of Jefferson, the City green and promises that if it is determined by a court of competent jurisdiction that the present westerly curb line of Jackson Street (at the point where the owners' property abuts said street) is located on the westerly right of way line of Jackson Street so that he owners constructed their sidewalk on their own private property
