N ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND
IRECTING THE APPROPRIATION AND CONDEMNATION BY THE CITY OF
PECIFICALLY DESCRIBED LAND FOR SANITARY SEWER RIGHT OF WAY PURPOSES
DECLARING IT NECESSARY TO TAKE AND APPROPRIATE SAID PROPERTY FOR
PUBLIC USE SO THAT A SANITARY SEWER MIGHT BE LAID IN SEWER DISTRICT {
0. 97A OF THE CITY, DECLARING THAT NO BENEFIT DISTRICT SHALL BE
STABLISHED, AND THAT ANY DAMAGES ASSESSED, IF ASSESSED, WILL BE
AID FROM FUNDS WITHIN THE CITY TREASURY.
ereas on August 4, 1958, the City of Jefferson, Missouri, by its

n August 11, 1958, establishing Sewer District No. 97A, and

1958, ordering the construction of a sanitary sewer through the

ereas all right of way for said sanitary sewer within Sewer Distri t
o. 97A has been given to the City with the exception of a section of
aid right of way hereinafter to be mentioned, and
ereas it has become necessary to acquire by condemnation this
ereinafter described section of right of way through a portion of
he land situated within Sewer District No. 97A so that the
aforementioned sanitary sewer might be constructed for public use,
now therefore:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUR ,
S FOLLOWS:
ection 1. The City of Jefferson, Missouri does hereby authorize
nd direct the appropriation and condemnation by the City of
ertain specifically described land owned by John M. Wilson and
eatrice W. Wilson, his wife, for sanitary sewer right of way
urposes.,
ection 2. The land of the said John W. Wilson and Beatrice W. Wits n
Q be affected is described as follows:
Part of Section 2, Township 44 North, Range 12 West, lying
within ghe City of Jefferson, County of Cole, Missouri, and
more particularly described as: Beginning at a point on the
northerly right of way lane of the Missouri Pacific Rail,r_oad
said point being 2757.0 feet east (if measured at right
angles to the west line of Section 2) ; thence north parallel
to .the west line of said Section 2 a distance of 240.0 feet;
thence in an easterly direction at right angles to the
last mentioned line 75.0 feet; thence North parallel to the
west line of said Section 2 a distance of 460.0 feet to th
wouth line of the County Road; thence South 72 degrees 30 mi utes
East (Magnetic) along the south line of said road 80.66
feet; thence South parallel to the west line of Section 2
a distance of 766.0 feet to the Northerly right of way libe
of the Missouri Pacific Railroad; thence along the northerly
line of said right of way 177.8 to the point of beginning.
Containing 1.75 acres."
ection 3. The land to be appropriated and used for sanitary sewer

"A part of Lot 13 of Busch' s Subdivision as per plat of
record in Plat Book 4 at Page 4, Cole County Recorder' s
Office, being a strip of land four (4.0) feet of even width,
being more particularly described as:
Beginning at the southeasterly corner of said lot, thence
Northerly 572.0 feet, the easterly line of said four (4.0)
