RESOLUTION DECLARING AN EMERGENT CONDITION AND
AUTHORIZING EMERGENCY CONTRACTS WITHOUT PUBLIC BIDDING
PURSUANT TO THE PROVISIONS OT N.J.S.A. 40A:11 -6
WHEREAS, an emergent condition developed from Tropical Storm Ida, in the State of
New Jersey; and
WHEREAS, on September 1, 2021 Governor Phil Murphy issued Executive Order No.
260 imposing mmrierous restrictions throughout the State pursuant to the prior declaration
of a state of emergency; and
WHEREAS, N.J.S.A. 40A:11 -6 permits the Borough to award contracts without public
bidding or quotes when an emergency affecting the health, welfare and safety of the
public requires the irmnediate performance of services.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of
Carteret that authorization is hereby given to the Appropriate Borough Officials to
proceed with emergency contracts without public bidding pursuant to the provisions of
N,J.S.A. 40A:11 -6 and in compliance with N.J.S.A. 19:44A- 20.12, until such time that
the slate of emergency is resolved.
