IRECTING THE MAYOR AND THE CITY CLERK OF THE CITY TO EXECUTE FOR

ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND
IRECTING THE MAYOR AND THE CITY CLERK OF THE CITY TO EXECUTE FOR AN

URPOSE OF A PUBLIC ROAD IN, OVER AND UPON CERTAIN SPECIFICALLY
ESCRIBED PREMISES IN FAVOR OF THE COUNTY OF COLE, MISSOURI, IN
34ONSIDERATION FOR THE SUM OF ONE ($1.00) DOLLAR AND OTHER GOOD AND
ALUABLE CONSIDERATION.
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
ISSOURI, AS FOLLOWS:
Section 1. The Mayor and the City Clerk of the City of Jefferson,
Missouri, are hereby authorized and directed to execute, for and
on behalf of the City, a Warranty Deed conveying an easement for
the purpose of a public road in, over and upon certain specifically
described premises to the County of Cole, State of Missouri, in
consideration of the sum of One ($1.00) Dollar and other good
and valuable consideration.
Section 2. Said Corporate Warranty Deed conveying said easement
in over and upon said premises shall read in the following form,
to-wit:
CORPORATE DEED
Whereas the City Council of the City of Jefferson, Missouri did
pass ordinance number— of the City of Jefferson, Missouri,
on the _ day of February, 1959, which said ordinance was
approved by the Mayor of said city on the day of February,
1959, and
Whereas, under the terms of said ordinance, the Mayor and the City
Clerk were authorized and directed to execute, for and on behalf
of the City of Jefferson, Missouri, a warranty deed conveying an
easement for public road purposes over and upon certain
specifically described lands to the County of Cole, Missouri, now
therefore:
THIS INDENTURE, made this day of February, 1959, by and
between the City of Jefferson, Missouri, a municipal corporation,
located within the County of Cole, Missouri, and existing under
the laws of the State of Missouri, Party of the First Part, and
the County of Cole, Missouri, Party of the Second Part:
WITNESSETH: That the Party of the First Part in consideration of
the sum of One ($1.00) Dollar and other good and valuable
consideration to it paid by the Party of the Second Part, the
receipt of which is hereby acknowledged, does by these presents
lGrant, Bargain and Sell, Convey and Confirm, unto the said Party
of the Second Part, its Successors and Assigns an easement for
public road purposes, subject to the rights and obligations
hereinafter mentioned, in, over and upon the following described
premises situated in the County of Cole, State of Missouri, to-wit:
"The Westerly part of Section 2, Township 44 North, .
Range 12 West, and more particularly described as:
Beginning at the intersection of the corporate limits
of the City of Jefferson, Missouri on the east line
of the Northwest Quarter of the Southwest Quarter of
said Section 2, and the southerly right of way line
of the Missouri Pacific Railroad Company right of
way, said point of beginning being 50.0 feet southerly
from and at right angles to the center line of the
Missouri Pacific Railroad Company track; thence in
a westerly direction and parallel with the center
line of said track, 2300"0 feet, more or less, to the
easterly line of the Ten Mile Drive; thence in a
northeasterly direction along and with the easterly
line of the Ten Mile Drive to a point 10.0 feet
southerly of, if measured at right angles to, the
center line of the Missouri Pacific Railroad Track;
thence in a generally easterly direction and parrallel
to the center line of said track 2300.0 feet, more or
less, to the east line of the Northwest Quarter of the
Southwest Quarter of said Section 2, Township 44 North,
Range 12 West; thence South 10.0 feet to the point of
beginning."
Subject to all rights, privileges and reservations in
favor of the Missouri Pacific Railroad Company as same

appear in a deed of easement dated July 9, 1947
and recorded in Book 160 at Page 273, Cole County
Recorder' s Office.
Subject to the further condition that the Party
of the Second Part, being the County of Cole,
Missouri, assume and perform all obligations and
abide by all covenants assumed and agreed to be
performed by the Party of the First Part, the City
of Jefferson, M.i.ssouri, as appear in said deed of
easement dated July 9, 1947, and recorded in Book
1.60 at Page 273, Cole County Recorder' s Office.
Provided further that in the event the Party of the
Second Part shall fail to assume and perform all
obligations and abide by all covenants assumed and
agreed to be performed by the Party of the First
Part; as stated in said deed of easement dated July
9, 1947, and recorded in Book 160 at Page 273, Cole
County Recorder' s Office, this easement shall then
immediately terminate and revert back to the Party
of the First Part"
CO HAVE AND TO HOLD THE SAME, with all rights, privileges, appur-
enances and immunities thereto belonging or in anywise appertaining
into the Party of the Second Part to the extent of an easement for
ublic Road purposes, and subject to the rights, privileges,
eservati.ons and conditions above mentioned, provided further, that
hould the grantee use the easement conveyed hereby for any other
urpose than a county road, said easement interest .of the Second
Party shall immediately terminate and revert back to the Party of
he First Part. The Party of the First Part covenants that it
as a good right to convey the easement interest described herein;
hat the said premises are free and clear of any encumbrance done
r suffered by it or those under whom it claims, and that it will
arrant and Defend its title to said premises to the extent bf an
asement interest for public road purposes unto the Party of the
econd Part, and unto its Successors and Assigns as long as said
asement is said premises is used for the purpose of a public road,

laims and demands of all persons whomsoever, excepting any rights
reserved to the Missouri Pacific Railroad Company and other parties

IN WITNESS WHEREOF, the City of Jefferson, Missouri, as the
Party of the First Part, has caused these presents to be signed
