Ells /s/ City Clerk ORDINANCE NO. 6736 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, TO EXECUTE FOR AND ON BEHALF OF THE CITY A CONTRACT WITH THE STATE HIGHWAY COMMISSION OF MISSOURI PERTAINING TO THE INSTALLATION, MAINTENANCE AND CONTROL OF THE LIGHTING SYSTEM, TRAFFIC CONTROL DEVICES AND REGULATORY AND DIRECTIONAL SIGNS AND LIGHTS ON THE NEW URBRN HIGHWAY EXTENDING FROM PRESENT ROUTE 50 NEAR HARRISON STREET TO CLARK AVENUE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and the City Clerk of the City of Jefferson, Missouri, are hereby authorized and directed for and on behalf of the City to execute a contract with the Missouri State Highway Commission relating to the installation, maintenance and control of the lighting system, traffic control devices and regulatory and directional signs and lights on the new urban highway extending from present Highway 50 and Harrison Street through to Clark Avenue Section 2. The said contract shall read in words and figures as follows: AGREEMENT This agreement made and entered into on this day of. , 1959, by and between the State Highway Commission of Missouri, hereinafter referred to as "Commission," and the City of Jefferson City, Missouri, hereinafter referred to as "City," Witnesseth: i, In consideration of the mutual covenants contained herein to be faithfully kept and performed by the parties hereto, it is agreed as follows: 1. That the Commission shall install and erect a system of lights along the urban highway inside the limits of City which highway is that part of the urban highway constructed under contrac ,between City and Commission dated the 7th day of January, 1958, which extends from present Route 50 near Harrison Street eastwardly through the interchange of said highway with Clark Avenue. 2. Said lighting system shall be erected and installed in such manner that the thruway of said urban highway shall be lighted and that the ramps at the interchange of said highway with Clark Avenue shall be lighted but--shall not include the lighting of cross streets. 3. Said lighting system shall consist of mercury vapor type luminairs mounted on poles and brackets with all the necessary wiring connected therewith. 4. That upon completion of said lighting system by Commission and upon said urban highway being opened to public travel, City shqLll at. its cost provide or cause to be provided, electrical current for said lighting system and shall operate and maintain same. Maintenance shall not be restricted to but shall include painting of metal parts of said lighting system and wAshing of lamps and luminairs and the group replacement of lamps at' the end of the rated life of said lamps. 5. The installation, maintenance and operation of all traffic control devices such as traffic signals, flashing lights, regulatory and directional signs and lights located upon said urban highway shall remain under the control of Commission except that City shall at its cost provide or cause to be provided electrical current for the operation of any such devices operated, controlled or illuminated by electrical current. The execution of this contract is authorized by Ordinance No. 6736 approved on the 20 day of May, 1959.
