HomeMy Public PortalAboutORD06772 ORDINANCE NO. 6772 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, FOR AND ON BEHALF OF THE CITY, TO EXECUTE A CONTRACT WITH THE STATE HIGHWAY COMMISSION OF MISSOURI RELATING TO SURFACE WATER STORM SEWERS WITHIN THE RIGHT OF WAY OF THE COMMISSION ON PROJECT U-(7) WITHIN THE CITY OF JEFFERSON. BE XT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and the City Clerk of the City of Jefferson, Missouri, are hereby authorized and directed for and on behalf of tba City to execute a contract with the State Highway Commission of Missouri relating to the construction, maintenance and incasement of certain storm sewers, and the disposition of surface waters therefro lying on the highway right of way of the Commission within the City of Jefferson, Missouri, as shown on the plans of Route 50, project U-1(7) . Section 2. Said contract shall be words and figures as follows. AGREEMENT This agreement made and entered into on the 4 day of August , 1959, by and between the State Highway Commission of Missouri hereinafter called "Commission," and the City of Jefferson City, Missouri, hereinafter called "City," WITNESSETH: In consideration of the mutual covenants contained herein to be faithfully kept and performed by the parties hereto, it is agreed as follows: 1. Commission shall, in its contract for the construction of Route 50, Cole County, project U-1(7) , through City, provide for the incasement of certain sewer lines which cross said highway as shown on Commission' s plans. 2. Commission shall construct the necessary storm water sewers within the right-of-way for said highway as may be necessary to accumulate and drain the storm water from said highway. 3. City shall assume the cost and .responsibility for the main- tenance, future replacement, and enlargement of its sanitary sewer system located within the right-of-way .for said highway, and City shall not cut the pavement of said highway for the repair, �aaintenance or replacement of existing sewers or for the installatio of new sewers. 4. City agrees to accept responsibility for receiviiig and disposing of storm waters which may be discharged from the storm sewer system constructed by Commission, into City's existing storm sewer facilities and natural drains. Commission, however, will �naintain that part of the storm sewer system which it constructs. 5. City shall, upon completion of said highway, enact and nforce the necessary ordinances to prohibit parking upon said ighway or the shoulders thereof throughout the entire length of the improvement.
