SECTION 2. All Ordinances or parts of Ordinances in conflict with

ORDINANCE NO. 6788
AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SEWERS IN SEWER
DISTRICT NO. 57 "A" WITHIN THE CITY OF JEFFERSON, MISSOURI.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the City Council of the City of Jefferson, Missour ,
hereby declares that it deems it necessary for the health and
comfort of the inhabitants of the City and for sanitary purposes
that there must be constructed as soon as possible in Sewer Distric
No. 57 "A' , as established by Ordinance, a sanitary sewer and it is
ordered that the same be constructed without unnecessary delay
and connected into the East- Main Sewer at Station 64 plus 69 .5.
SECTION 2. That the said sewer shall begin at the center line of
the sewer in the East Main Sewer (Station 64 plus 69.5) thence run
south along the center line of Water Street 274.4 feet to the cente
of the intersection of Water Street and Grant Street. Thence east
along the center line of Grant Street 300 feet. Also from the
center of the intersection of Water Street and Grant Street wester)
along the centerline of Grant Street 184.4 feet.
SECTION 3. Said sewer shall be constructed in all respects as
provided by Ordinance and shall be constructed of standard glazed
sewer pipe and shall be constructed according to the plans of the
City Engineer.
SECTION 4. This Ordinance shall take effect and be in force from
and after its passage and approval.

AN ORDINANCE AUTHORIZING THE MAYOR AND THE CITY CLERK OF THE CITY
OF JEFFERSON, MISSOURI, TO EXECUTE FOR AND ON BEHALF OF THE
ITY OF JEFFERSON AN AGREEMENT WITH HAROLD G. BUTZER AND CATHERINE L
UTZER, HIS WIFE.

ction 1. The Mayor and the City Clerk of the City of Jefferson,
ssouri, are hereby authorized and directed for and on behalf of
he -City to execute an agreement with Harold G. Butzer and Catherine
Butzer, his wife, said Agreement being stated in words and figure

AGREEMENT made this 1 day of Sept.
859, by and between HAROLD G. BUTZER and CATHERINE L. BUTZER, his
ife, hereinafter called "Butzer" , and City of Jefferson, Missouri,
ereinafter called "City" , WITNESSETH:
WHEREAS, Butzer is the owner of the following-described
ract of real estate in Jefferson City, Cole County, Missouri, to-wi :
All interests in all land owned by First Parties
in the Southeast quarter of the Northeast quarter
of Section 11, Township 44 North, Range 12 West,
in the City of Jefferson, Cole County, Missouri,
and more particularly, but without- limitation,
described as follows:
Beginning at an old iron pipe in a fence row, that
is on the East and West center line of said Section
11, and 716.0 feet West of an old Stone at the East
quarter corner of said Section 11; thence North 1
degree 06 minutes West 224.5 feet to a point that
is 903.95 feet south of a point on the south right
of way line of U. S. Highway 50 that is 735.5 feet
west of the east line of said Section 11; thence
South 88 degrees 54 minutes West 20 feet; thence
North 1 degree 06 minutes West 10.2 feet to the
point of beginning for this description;
Thence South 89 degrees 55 minutes West 188.46 feet
to an old iron 'pipe; thence North 1 degree 06 minutes
West 129 .3 feet to an old iron pipe; thence North 89

WHEREAS, City has a certain easement for a sewer right-of-way,
he deed therefor being recorded in Book 113, Page 258, ColeCounty
ecorder's Office;
NOW, THEREFORE, in consideration of the premises and the
greements herein, the following agreement is made:
1. Butzer shall be permitted and allowed to construct
uildings and other improvements on the above-described land, and
he same may be constructed above, near and on the existing sewer
Line across said property.
2. Butzer agrees that in the event it is necessary to
intain and repair said sewer, that City shall have the right at
11 times to go upon the above-described land to construct, maintain
nd repair said sewer, and City may go beneath and excavate under
said building and improvements. If it be necessary that the
